No.1952\/2008-G\n              ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n         Dated this the 14th day of December, 2010\n\n                    J U D G M E N T\n<\/pre>\n<p>    The matter arise from the Building Tax Act.     The<\/p>\n<p>petitioner  filed  a   revision   petition  before  the<\/p>\n<p>District Collector against Ext.P6 order passed by the<\/p>\n<p>third respondent in appeal.    Initially, that revision<\/p>\n<p>petition was rejected as per Ext.P8 order for non<\/p>\n<p>remittance of additional court fee stamp worth 0.5% of<\/p>\n<p>the amount involved in dispute.    He did not remit the<\/p>\n<p>50% of the building tax in terms of Section 13(4) of<\/p>\n<p>the Kerala Building Tax Act.     It is the case of the<\/p>\n<p>petitioner that thereafter, payments have been made and<\/p>\n<p>the petitioner produced evidence along with the Review<\/p>\n<p>Petition.  The District Collector rejected the Review<\/p>\n<p>Petition as per Ext.P9 order stating that there is no<\/p>\n<p>power for review in terms of the provisions of the Act.<\/p>\n<p>    2.   Heard the learned counsel for the petitioner<\/p>\n<p>and the learned Standing Counsel for the Corporation<\/p>\n<p>and the learned Government Pleader.\n<\/p>\n<\/p>\n<p>    3.   The only question is whether the petitioner<\/p>\n<p>has remitted the deposit of 50% even after filing the<\/p>\n<p>W.P.(C). No.1952\/2008<br \/>\n<span class=\"hidden_text\">                         -:2:-<\/span><\/p>\n<p>revision petition as well as 0.5% towards legal benefit<\/p>\n<p>fund.  If the petitioner has already produced evidence<\/p>\n<p>to show the payment, as contended by him, the orders<\/p>\n<p>Exts.P8 and P9 will stand quashed.   If the petitioner<\/p>\n<p>has not remitted the amounts so far, the said amounts<\/p>\n<p>will be remitted within a period of one month and the<\/p>\n<p>petitioner will accordingly produce evidence for the<\/p>\n<p>remittance  also.     If  the  District  Collector   is<\/p>\n<p>satisfied that the payments have been duly made in<\/p>\n<p>terms  of  the  above  direction,  then  the   Revision<\/p>\n<p>Petition will be disposed of in accordance with law, on<\/p>\n<p>merits.  The petitioner will produce a copy of this<\/p>\n<p>Judgment before the District Collector along with the<\/p>\n<p>evidence within one month, for compliance.    The writ<\/p>\n<p>petition is disposed of as above. No costs.<\/p>\n<p>                      (T.R.
