In  December, 1990 the  respondent  while<br \/>\nofficiating  on\t the post of Senior Accountant\tapplied\t for<br \/>\nmutual\t transfer  with\t one   Shri  Paresh  Ghosh,   Senior<br \/>\nAccountmit,  working  in  the Office of\t the  Senior  Deputy<br \/>\nAccountant General (A &amp; E).  Sikkim.  As mutual transfer was<br \/>\nnot  permissible  in  the cadre of  Senior  Accountant,\t the<br \/>\nrespondent  was\t advised  to apply for\tunilateral  transfer<br \/>\nafter seeking reversion to the lower post of Accountant as a<br \/>\ndirect\trecruit.   In pursuance of the advice tendered,\t the<br \/>\nrespondent  applied for unilateral transfer in the cadre  of<br \/>\nAccountant  foregoing the status of a Senior Accountant,  in<br \/>\nthe  Office of the Senior Deputy Accountant General (A &amp; E),<br \/>\nSikkim\tin  July,  1992 and he was permitted  to  take\tsuch<br \/>\ntransfer  on certain terms and conditions.  The pay scale of<br \/>\nSenior\tAccountant at the relevant time was Rs.\t  1400-2600.<br \/>\nwhereas,  the  pay scale of Accountant was  Rs.\t  1200-2040.<br \/>\nThe  respondent having accepted the terms and conditions  of<br \/>\nunilateral  transfer was posted as an Accountant in the\t pay<br \/>\nscale  of Rs.  1200-2040.  However, his pay was\t erroneously<br \/>\nfixed  at Rs.  1560\/-, which he was drawing in the pay scale<br \/>\nof  Rs.\t 1400-2600 prior to his reversion to the lower post.<br \/>\nSubsequently,  it was found that the fixation of pay of\t the<br \/>\nrespondent  at\tthe  stage of Rs.  1560\/- was  due  to\tsome<br \/>\nmistake and, therefore, by a Memorandum dated<\/p>\n<p>      8.11.1994 the pay of the respondent was directed to be<br \/>\nre-fixed  and  a further direction for recovery&#8217;  of  excess<br \/>\npayment\t made  to the respondent was also issued.  It is  at<br \/>\nthis  stage the respondent filed Original Application before<br \/>\ntlie Central Administrative Triblinal, Calcutta, challenging<br \/>\nthe Memorandum dated 8.11.1994 contending that the pay which<br \/>\nhe  was\t drawing as Senior Accountant viz..  Rs.  1560\/-  in<br \/>\nthe  pay scale of Rs.  1400-2600 has to be protected even if<br \/>\nhe was reverted to tlie lower post of Accountant on transfer<br \/>\nand re-fixation of his pay at a lower stage, and recovery of<br \/>\nthe  alleged  excess payment of salary is unwarranted.\t The<br \/>\nappellants   herein   disputed\tthe   contentions   of\t the<br \/>\nrespondent,  inter  alia, on the ground that the  respondent<br \/>\nwas  bound  by the terms and conditions of  tlie  unilateral<br \/>\ntransfer  and as on acceptance of such terms and conditions,<br \/>\ntlie respondent was required to tender technical resignation<br \/>\nfrom  tlie  post of Senior Accountant and had to join  as  a<br \/>\ndirect\trecruit\t on  the lower post  of\t Accountant  ranking<br \/>\njunior\tmost  in  the  cadre of\t Accountant.   It  was\talso<br \/>\ncontended  that on such a transfer the pay of the transferee<br \/>\nis  not required to be protected and his pay was to be fixed<br \/>\nas  a direct recruit on the lower post in which post he\t was<br \/>\nreverted.   The tribunal took the view that since unilateral<br \/>\ntransfer   is\tnot  contemplated   by\t Fundamental   Rules<br \/>\n(hereinafter referred to as &#8216;F.R&#8221;) and as such, in a case<\/p>\n<p>      like  the present one the respondent has to be treated<br \/>\nas  having gone on transfer on request and.  therefore,\t his<br \/>\ncase  was to be governed by F.R.22 (1) (a) (3).\t In view  of<br \/>\nthe  provisions\t of above Rules, tile tribunal\tquashed\t the<br \/>\nimpugned   order   and\tallowed\t  the  application  of\t the<br \/>\nrespondent.   It  is against the said judgment and order  of<br \/>\nthe tribunal the appellants are in appeal before us.\n<\/p>\n<p>      Learned  counsel\tfor  the appellants urged  that\t the<br \/>\ntribunal fell in error in applying F.R.22 (1) (a) (3) in the<br \/>\npresent\t case.\t The  argument\tis   that  the\tpay  of\t the<br \/>\nrespondent  was required to be fixed in accordance with\t the<br \/>\nterms  and conditions which were accepted by the respondent.<br \/>\nLearned\t counsel tlien referred to the terms and  conditions<br \/>\nof  the\t unilateral  transfer of  the  respondent.   Learned<br \/>\ncounsel\t for  the respondent urged that unilateral  transfer<br \/>\nnot  being  contemplated  in  F.R.,   the  transfer  of\t the<br \/>\nrespondent  necessarily\t has to be governed by F.R.  and  in<br \/>\nthe  present  case  it\tis  F.R.  22  (l)(a)  (3)  which  is<br \/>\napplicable,  and  on  an application of the said  rule,\t the<br \/>\njudgment and order of the tribunal has to be affirmed.\n<\/p>\n<p>      In  order\t to appreciate the arguments of the  learned<br \/>\ncounsel\t for the parties, it is necessary to refer F.R.\t  22<br \/>\n(1)  (a)  (2)  (3) and the relevant portions  are  extracted<br \/>\nbelow:\n<\/p>\n<p>      &#8220;FR  22 (1) (a) (2):  When the appointment to the\t new<br \/>\npost  does  not\t involve  such\t assumption  of\t duties\t and<br \/>\nresponsibilities  of  greater importance, he shall draw&#8217;  as<br \/>\ninitial pay&#8217;, tile stage of the time-scale which is equal to<br \/>\nins  pay in responst of the old post held by him on  regular<br \/>\nbasis,\tor, (ft here is no such stage, the stage next ahcn&#8217;e<br \/>\nhis  pa}&#8217; in respect of the old post lield by him on regular<br \/>\nbasis:\n<\/p>\n<p>      FR  22 (1) (a) (3):  When appointment to the new\tpost<br \/>\nis  made on his own request under sub-rule (a} of Rule 15 of<br \/>\nthe  said rules, and tile maximum pa)&#8217; in the time-scale  of<br \/>\nthat  post is lower than his pay&#8217; in respect of the old post<br \/>\nheld  regularly,  he shall draw that maximum as his  initial<br \/>\nPay&#8217;- &#8221;\n<\/p>\n<p>      The  relevant  terms  and\t  conditions  of  unilateral<br \/>\ntransfer,  as  accepted\t by the\t respondent,  are  extracted<br \/>\nbelow:\n<\/p>\n<p>      &#8220;The  transfer  mil be not in public interest  and  as<br \/>\nsuch  he  will not be entitled to any joining time,  joining<br \/>\ntime pay or T.A.\n<\/p>\n<p>      He  will\tbe  assigned  junior   to  the\tjunior\tmost<br \/>\nAccountant  on\tthe date he reports for duty in this  office<br \/>\nfor all intents and purposes.\n<\/p>\n<p>      He shall have to submit his technical resignation from<br \/>\nthe  post of Senior Accountant in the Office of the A.G.(A &amp;<br \/>\nE),  West  Bengal, Calcutta, in order to  join\tAccountant&#8217;s<br \/>\npost in the Office of the Senior Dy.  Accountant General ( A<br \/>\n&amp; E), Sikkim, Gangtok.\n<\/p>\n<p>      He  shall\t have  no right to seek re-transfer  to\t his<br \/>\nparent office or to any other office.\n<\/p>\n<p>      On unilateral transfer he is required to pass whatever<br \/>\ndepartmental  examination  as  prescribed  by  the  relevant<br \/>\nrecruitment rules.\n<\/p>\n<p>      This  pay\t shall be regulated in accordance  with\t the<br \/>\nrelevant rules in force in his U.T.  as Accountant&#8221;\n<\/p>\n<p>      It  is no doubt true that unilateral transfer which is<br \/>\nsaid  to  be  coined by the appellants is  not\tcontemplated<br \/>\nunder  the  Fundamental\t Rules What is contemplated  is\t the<br \/>\ntransfer  on written request under Fundamental Rule 15.\t But<br \/>\nif such a transfer is not contemplated under the Fundamental<br \/>\nRule.,\tit  is\tnot  necessarily  to  be  governed  by\t the<br \/>\nFundamental  Rule,  but by the terms and conditions of\tsuch<br \/>\nunilateral  transfer.\tFundamental  Rule  22  (1)  (a)\t (2)<br \/>\nprovides  that,\t when  an employee is transferred to  a\t new<br \/>\npost,  which  does  not\t involve assumption  of\t duties\t and<br \/>\nresponsibilities  of  greater importance, he shall  draw  as<br \/>\ninitial\t pay, the stage of the time-scale which is equal  to<br \/>\nhis  pay  in respect of the old post held by him on  regular<br \/>\nbasis.\tThus F.R.22(l)(a)(2) would be applicable where there<br \/>\nis  an ordinary transfer which is not by way of reversion to<br \/>\nthe lower post and in such a case, the pay of an employee on<br \/>\ntransfer  to  a new post has to be  protected.\t Fundamental<br \/>\nRiile22(l)(a)(3)   is  applicable  where   an  employee\t  is<br \/>\ntransferred  to a new post on his own request under sub-rule\n<\/p>\n<p>(a)  of Rule 15, and further in such a transfer no reversion<br \/>\nis  involved.\tIn  such  a transfer to a new  post  if\t the<br \/>\nmaximum\t pay  in the time-scale of the transferred  post  is<br \/>\nlower than Ins<\/p>\n<p>      pay  in respect of the old post held regularly, he  is<br \/>\nrequired  to  draw  that maximum as his\t initial  pay.\t For<br \/>\nillustration  &#8211;\t an  employee working in a pay\tscale  ofRs.<br \/>\n1400-2600  was drawing pay at the stage ofRs, 2040 and he is<br \/>\ntransferred  on his own request not involving reversion to a<br \/>\npost  which  carries pay scale ofRs.  1200-2040.  in such  a<br \/>\ncase.\tthe  maximum  pay which lie was drawing\t viz..\t Rs.<br \/>\n2040  has  to  be protected on the  transferred\t post  which<br \/>\ncarries a pay scale ofRs.  1200-2040.&#8217;-.  It is not the case<br \/>\nhere.  Here.  what we find is that the respondent on his own<br \/>\nvolition  sought  transfer on certain terms  and  conditions<br \/>\naccepted  by  him.  The terms and conditions  of  unilateral<br \/>\ntransfer  are  very clear and there is no ambiguity  in\t it.<br \/>\nThe  terms  and conditions provided that the  respondent  on<br \/>\ntransfer  would be appointed to a post which is lower to the<br \/>\npost which he was occupying prior to his transfer and he was<br \/>\nalso  required to tender technical resignation from the post<br \/>\nwhich he was holding with a view to join the lower post as a<br \/>\ndirect\trecruit\t and  was  to rank  junior  to\tjunior\tmost<br \/>\nemployee  in  the  cadre  of  Accountant.   He\twas  further<br \/>\nrequired  to forego any benefit of passing any\tdepartmental<br \/>\nexamination  while  working in the higher post.\t In  such  a<br \/>\nsituation,  the\t pay of the respondent had to be fixed\twith<br \/>\nreference to the<\/p>\n<p>      lower  pay  scale\t and not with reference to  the\t pay<br \/>\ndrawn  by  him\tin  the\t higher post  since  he\t was  to  be<br \/>\nconsidered as a direct recruit in the lower post.\n<\/p>\n<p>      Under  the terms and conditions of tlic transfer,\t the<br \/>\npay  which the respondent was drawing on higher post was not<br \/>\nrequired  to  be protected when he joined the lower post  of<br \/>\nAccountant.\n<\/p>\n<p>      For the foregoing reasons, we are of the view that the<br \/>\npay  of\t the  respondent, as fixed  earlier,  was  correctly<br \/>\nrelfixed by Memorandum dated 8.11.1994.\t We, therefore, find<br \/>\nthat  the  judgment  and  order\t of  the  tribunal  is\t not<br \/>\nsustainable  in\t law and the same deserves to be set  aside.<br \/>\nWe  order accordingly.\tThe appeal is allowed.\tThere  shall<br \/>\nbe no order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Comptroller &amp; Auditor General Of &#8230; vs Falid Saltar on 7 April, 2000 Author: V.N.Kharej.
