NO. 7609 OF 2009 U\n                 --------------------------------------\n                Dated this the 26th March, 2009\n\n                           JUDGMENT\n<\/pre>\n<p>     Petitioners are the legal representatives of one late Haji<\/p>\n<p>E.M. Abdul Salam. It is stated that he was the Chairman of a<\/p>\n<p>Trust and it started a College and it decided to construct a pond<\/p>\n<p>in the campus for providing drinking water and to use the<\/p>\n<p>assorted sand for plastering the college building. It is stated that<\/p>\n<p>the request was originally given to the Revenue Divisional<\/p>\n<p>Officer, Kollam who granted sanction for digging a pond. But,<\/p>\n<p>the RDO did not grant sanction to use the sand for plastering the<\/p>\n<p>college building. It is further stated that the sand was collected<\/p>\n<p>near the pond itself. Now the petitioners challenge Exts.P5 to<\/p>\n<p>P14.\n<\/p>\n<p>     2. I heard the learned counsel for the petitioners and the<\/p>\n<p>learned Government Pleader. It is pointed out by the learned<\/p>\n<p>Government Pleader that there was a proceeding and after<\/p>\n<p><span class=\"hidden_text\">WPC.7609\/09 U                     2<\/span><\/p>\n<p>issuing notice to the predecessor in interest of the petitioners,<\/p>\n<p>orders were issued, but they were returned back noting the death<\/p>\n<p>of the predecessor in interest. Today, the learned Government<\/p>\n<p>Pleader handed over a copy of the decision to the learned<\/p>\n<p>counsel for the petitioners. Learned Government Pleader points<\/p>\n<p>out that it is open to the petitioners to approach the Appellate<\/p>\n<p>Authority under Rule 49 of the Kerala Minor Mineral<\/p>\n<p>Concession Rules, 1967. To the argument of the counsel for the<\/p>\n<p>petitioners that the very proceeding by the Geologist is without<\/p>\n<p>jurisdiction and it is only the State Government which can fix<\/p>\n<p>and recover the amount. It is pointed out that there is delegation<\/p>\n<p>apparently under Rule 62. Of course, counsel for petitioners<\/p>\n<p>disputes this. I feel that the petitioners can be relegated to prefer<\/p>\n<p>Appeal if they are otherwise competent to challenge the order, a<\/p>\n<p>copy of which has been served on the counsel for the petitioners<\/p>\n<p>today. Without prejudice to the right of the petitioners, if so<\/p>\n<p>advised, to approach the Authority under Rule 49 of the Kerala<\/p>\n<p><span class=\"hidden_text\">WPC.7609\/09 U                  3<\/span><\/p>\n<p>Minor Mineral Concession Rules, the Writ Petition is disposed<\/p>\n<p>of. The impugned proceedings will be kept in abeyance for a<\/p>\n<p>period of three weeks from today.<\/p>\n<pre>\n\n                                           Sd\/=\n                                    K.
