\nnine conditions… One”aniori\u00abg_:s’t…:them is the condition that the<\/p>\n
petitionerhas to V_pay’V–.Rs-._20′”,’000\/~ (Rupees Twenty thousand<\/p>\n
._orii~\/.)  e\u00a7.rery”Vrri*-ointh. The said permission came to be<\/p>\n
“Assistant Revenue Officer vide impugned<\/p>\n

 Sri P.K. Ponnappa, the iearned counsel for the<\/p>\n
 ‘peti.ti.oner submits that the permission order itself states that the<\/p>\n
iii”–\u00ab.AVA”petitioner is given the temporary permission to coliect the<\/p>\n
R314.\n<\/p>\n
parking fees until the tenders are called for. As the tenders are
\nnot yet cailed for, the permission cannot be revoked or<\/p>\n
withdrawn, so contends Sri Ponnappa. He also submits thatagthe<\/p>\n
permission is granted by the Assistant Revenue Officer–.parsu’anty<\/p>\n
to the Joint Commissioner’s order, dated   <\/p>\n
Additional Commissioner has no competen\ufb01er. to<\/p>\n
permission granted by the Joint Coim4’missio_ne~r.<\/p>\n
4. Sri Ponnappa Stgbf\ufb01itsvg,-thr:3-t’-.then pet’itio.ner\u00a7 has not
\nviolated any condition of theIpei’rnfi-ssiolnffferder. Further, the<\/p>\n
BBMP has not made.__any””alterr:a’tiy’e_V_arrangements for the<\/p>\n
collection ofthue <\/p>\n
5. Sr’ril’~–.(_l3.il  the learned counsel for the<\/p>\n
regspondyeflts iisubmV’i’ts._VV:tVhat:the petitioner h-as suppressed the<\/p>\n
.niateriallifacstsi.. ._l-‘ie further submits that as the petitioner was<\/p>\n
indul’lg_iril.g__\u00abAil1~collections, the public have lodged a<\/p>\n
 compiaint with the police. He also brings to my notice that the<\/p>\n
“.::’l.p4e’fei,htioner ‘\ufb01led O.S.Nos.26411\/O9, 26572\/09, 2115\/09,<\/p>\n
 \\ll(g\u00a7.’li.lVo’;’58O\/09 and W.A.l\\lo.387\/09 seeking similar reliefs. His<\/p>\n
T has already been negatived by all the Courts, so contends<\/p>\n

10. Admittedly the respondent No.2 is superior to the
\nrespondent No.3 in the hierarchy. There is no legai impediment
\nfor the respondent No.2 (the Additional Commissioner) to aiter<\/p>\n
the decisions of the Joint Commissioner (the respondent<\/p>\n
11. In the wake of the complaints, this <\/p>\n
difficult to iend any credence to the ci_ai.m__of the’pet_it\u00bbio’ne’\u00a7=.the-atu <\/p>\n
he has not violated the terms of the p’e&rrra’iA_Ssiion’}’~. ztfthe [\u00a7hiatt.er<\/p>\n

coliecting the user fee from the_m,~.__what .is\u00abo_f paramount<\/p>\n
