         Petitioners             are        the      accused  in<\/p>\n
C.C.1049\/2008 on the file of Judicial First<\/p>\n
Class   Magistrate,                 Kunnamkulam            taken<\/p>\n
cognizance for the offence under Section 3<\/p>\n
read   with      Section              7        of      Essential<\/p>\n
Commodities Act and clause (5) of                         Kerala<\/p>\n
Rationing Order and Essential Commodities<\/p>\n
(Maintenance of Accounts and Display of<\/p>\n
Prices   and      Stocks             Order),          1966    on<\/p>\n
Annexure-A   complaint                 filed         by    first<\/p>\n
respondent,     District                 Supply         Officer.<\/p>\n
Allegation in Annexure-A complaint is that<\/p>\n
on 24\/4\/2008 at 12.30 p.m, first respondent<\/p>\n
along with rationing                Inspectors, reached<\/p>\n
the  godown  in       the        possession           of   first<\/p>\n

accused     and  owned   by  M\/s.T.A.Jose   and<\/p>\n
Company, Mundoor, Thrissur. First petitioner<\/p>\n
is     the    Managing   Partner   and   second<\/p>\n
petitioner is     his wife, who is also one of<\/p>\n
the partners of that firm. According to<\/p>\n
first respondent search was conducted as<\/p>\n
complaints were received that      Star Traders<\/p>\n
is    engaged   in   the  business  of   ration<\/p>\n
articles     illegally and   the  room  in  the<\/p>\n
possession     of  first  accused,  where  Star<\/p>\n
Traders is being run in       building bearing<\/p>\n
door     No.10\/171  consisting  of  two  rooms.<\/p>\n
From     there  it  was  found  that  48  sacks<\/p>\n
containing     50  Kgs.each    having  a  total<\/p>\n
weight of 24 quintal     of boiled rice, 37.62<\/p>\n
quintal     of raw rice in 76 sacks consisting<\/p>\n
of 49= Kg. per sack and 12.87 quintal having<\/p>\n
49= kgs. of boiled rice and 1 quintal       of<\/p>\n

wheat consisting of two sacks, 27 quintal of<\/p>\n
boiled rice in 36 sacks of 75 kgs. each     and<\/p>\n
13.5     quintal   of  raw  rice  in  18  sacks<\/p>\n
consisting of 75 Kgs.each     and 57.75 quintal<\/p>\n
of raw rice in 77 sacks weighing 75 Kgs. per<\/p>\n
sack and 417 sacks of raw rice each weighing<\/p>\n
50 Kgs., with       total   weight   of 208.50<\/p>\n
quintal and 118 sacks of paddy weighing<\/p>\n
48.15      quintal were  seized.  Complaint  is<\/p>\n
lodged      against the petitioners also on the<\/p>\n
allegations that first accused was engaged<\/p>\n
in storing the ration     articles in violation<\/p>\n
of      order, in the building owned by the<\/p>\n
petitioners and building was       permitted to<\/p>\n
be used by the petitioners and they thereby<\/p>\n
committed the offence. Petition is filed<\/p>\n
under      Section  482  of  Code  of  Criminal<\/p>\n
Procedure contending that continuation of<\/p>\n

the proceedings against the petitioners is<\/p>\n
an abuse of process of the court as they<\/p>\n
were implicated for the sole reason that<\/p>\n
they are the owners of godown, when final<\/p>\n
report itself shows that      godown was in the<\/p>\n
possession      of    the   first    respondent<\/p>\n
exclusively.\n<\/p>\n
            2. Learned counsel  appearing   for<\/p>\n
the petitioners     pointed out that except the<\/p>\n
allegation that petitioners are owners of<\/p>\n
the godown,     from which ration articles were<\/p>\n
seized, there is no material to connect the<\/p>\n
petitioners with the     ration articles seized<\/p>\n
or     the offence committed and hence, the<\/p>\n
case is to be quashed.      It was also argued<\/p>\n
that there is no material, whatsoever to<\/p>\n
connect petitioners with the ration articles<\/p>\n
seized, especially when the building from<\/p>\n

where it was seized was in the possession of<\/p>\n
first accused exclusively.\n<\/p>\n
            3. Annexure-A  complaint  does  not<\/p>\n
show that first respondent has a case that<\/p>\n
the building, from where ration articles<\/p>\n
were seized, was in the       possession of the<\/p>\n
petitioners exclusively or was in the joint<\/p>\n
possession     of   the  petitioners  and  first<\/p>\n
accused. On the other hand, the very case is<\/p>\n
that      first   accused   was   in   exclusive<\/p>\n
possession of the         building, though the<\/p>\n
building      was owned by the petitioners. When<\/p>\n
possession of building was transferred to<\/p>\n
first accused, first accused alone         could<\/p>\n
be    tried    and  convicted  for  keeping  any<\/p>\n
material,      like ration articles or any other<\/p>\n
contraband articles in that room, on the<\/p>\n
basis      that  the  building  belongs to   the<\/p>\n

petitioners.      That exactly   is  the  case<\/p>\n
herein. Though sixteen witnesses were shown<\/p>\n
in         Annexure-A complaint,   purpose   of<\/p>\n
examination of the witnesses do no show that<\/p>\n
any of the witnesses is to be examined to<\/p>\n
prove that the building from where ration<\/p>\n
articles were seized     was in the possession<\/p>\n
of the petitioners. On the other hand,       it<\/p>\n
is the specific case of the prosecution that<\/p>\n
the         building  was  in   the   exclusive<\/p>\n
possession of the first accused. Therefore,<\/p>\n
in the absence of any material to show that<\/p>\n
there was a     criminal conspiracy or a common<\/p>\n
intention with the first accused for the<\/p>\n
petitioners, to keep the ration articles in<\/p>\n
that room, petitioners cannot be prosecuted.<\/p>\n
Even      if  petitioners  are  to   be  tried<\/p>\n
consequent to the lack of materials, there<\/p>\n

\n                           7<\/span><\/p>\n
is      no    likelihood    of   a   successful<\/p>\n
prosecution. In such circumstances, it is<\/p>\n
not in the interest of justice to continue<\/p>\n
the prosecution as against the petitioners.<\/p>\n
            Petition is allowed.  C.C.1049\/2008<\/p>\n
on    the     file  of   Judicial  First  Class<\/p>\n
Magistrate,      Kunnamkulam   as  against  the<\/p>\n
petitioners, accused 2 and 3, is quashed. It<\/p>\n
is made clear that the case as against<\/p>\n
first accused can be proceeded.<\/p>\n
