Writ Petition No.40770 of 2010\n   Committee of Management, Janta Inter College, Lisadh, Muzaffar\n                             Nagar &amp; Another\n                                    Vs.\n                          State of U.P. &amp; Others\n                                  ~~~~~~~\n\nHon'ble Dilip Gupta, J.\n<\/pre>\n<p>      The petitioners have sought the quashing of the order dated 25th June,<br \/>\n2010 issued by the Special Secretary, Government of Uttar Pradesh under<br \/>\nSection 16-D(4) of the U.P. Intermediate Education Act, 1921 (hereinafter<br \/>\nreferred to as the &#8216;Act&#8217;) by which an Authorised Controller has been<br \/>\nappointed to take over the Management of the petitioner-Institution.\n<\/p>\n<p>      The records of the writ petition indicate that even earlier an order<br \/>\ndated 11th December, 2009 was passed by the State Government under<br \/>\nSection 16-D(4) of the Act for appointment of an Authorised Controller and<br \/>\nthis order was assailed by the present petitioner no.2-Rajiv Kumar in Writ<br \/>\nPetition No.3434 of 2010 which was allowed by the judgment and order<br \/>\ndated 27th January, 2010. The order is quoted below:-\n<\/p>\n<blockquote><p>                          &#8220;The petitioners have sought the quashing of the<br \/>\n                   order dated 11th December, 2009 issued by the State<br \/>\n                   Government under Section 16-D(4) of the U.P.<br \/>\n                   Intermediate Education Act, 1921 (hereinafter referred to<br \/>\n                   as the &#8216;Act&#8217;) by which an Authorised Controller has been<br \/>\n                   appointed to take over the Management of the petitioner-<br \/>\n                   Institution.\n<\/p><\/blockquote>\n<blockquote><p>                          It is the submission of learned counsel for the<br \/>\n                   petitioners that the said order deserves to be set aside as<br \/>\n                   not only does it not record any reason as are required to<br \/>\n                   be recorded under Section 16-D(4) of the Act but it also<br \/>\n                   does not take into consideration the reply filed by the<br \/>\n                   petitioner to the notice issued under Section 16-D(3) of<br \/>\n                   the Act.\n<\/p><\/blockquote>\n<blockquote><p>                          Learned Standing Counsel appearing for the<br \/>\n                   respondents and Sri P.S. Baghel, learned Senior Counsel<br \/>\n                   appearing for the Caveator state that it may not be<br \/>\n                   necessary to file the counter affidavit and the petition<br \/>\n                   may be disposed of at this stage.\n<\/p><\/blockquote>\n<blockquote><p>                          A perusal of the impugned order does indicate that<br \/>\n                   no reason has been recorded by the State Government for<br \/>\n                   appointing the Authorised Controller. Under Section 16-\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                         2<\/span><\/p>\n<blockquote><p>                     D(4) of the Act the State Government was required to<br \/>\n                     give reasons. The order dated 11th December, 2009<br \/>\n                     which has been impugned in the present petition,<br \/>\n                     therefore, cannot be sustained.\n<\/p><\/blockquote>\n<blockquote><p>                            The impugned order dated 11th December, 2009<br \/>\n                     also mentions that the petitioners have not filed any reply<br \/>\n                     to the show cause notice issued under Section 16-D(3) of<br \/>\n                     the Act. Learned counsel for the petitioner on the basis of<br \/>\n                     the averments made in paragraph 15 of the writ petition<br \/>\n                     states that in fact the reply was submitted by the<br \/>\n                     petitioners which was received in the office on 16th<br \/>\n                     September, 2009 but it has wrongly been recorded in the<br \/>\n                     order that no reply was submitted by the petitioners.\n<\/p><\/blockquote>\n<blockquote><p>                            The order dated 11th December, 2009 is,<br \/>\n                     accordingly, set aside.\n<\/p><\/blockquote>\n<blockquote><p>                            The State Government may pass a fresh order<br \/>\n                     under Section 16-D(4) of the Act after giving reasons.<br \/>\n                     While passing the order, the State Government shall also<br \/>\n                     consider whether the petitioner had submitted a reply to<br \/>\n                     the show cause notice issued under Section 16-D(3) of<br \/>\n                     the Act.\n<\/p><\/blockquote>\n<blockquote><p>                            The writ petition is, accordingly, allowed to the<br \/>\n                     extent indicated above.&#8221;<\/p><\/blockquote>\n<p>        A perusal of the order dated 25th June, 2010 shows that a reply was<br \/>\nfiled by the petitioner pursuant to the notice issued under Section 16-D(3) of<br \/>\nthe Act but all that has been stated in the impugned order is that the matter<br \/>\nwas re-considered and it was found that the Management was guilty of<br \/>\nfinancial irregularities.\n<\/p>\n<p>       Sri Ashok Khare, learned Senior Counsel appearing for the petitioners<br \/>\nsubmitted that the order deserves to be set aside as no reason has been given<br \/>\nas to how the Management was guilty of financial irregularities and only a<br \/>\nbald statement has been made without consideration of the reply filed by the<br \/>\npetitioner.\n<\/p>\n<p>       Learned Standing Counsel appears for all the respondents. Sri<br \/>\nManmohan Singh, Advocate has filed a Caveat Application on behalf of<br \/>\nAngraz Singh who had filed a complaint and Sri R.N. Singh, learned Senior<br \/>\nCounsel has made submissions on his behalf. Learned counsel for the<br \/>\nrespondents state that it is not necessary to file a counter affidavit and the<br \/>\npetition may be disposed of at this stage.\n<\/p>\n<p>       The Special Secretary, Government of U.P. was directed to pass a<br \/>\nreasoned order. The impugned order, however, does not give any reason and<br \/>\nnor does it deal with the reply that had been filed by the petitioner even<br \/>\n<span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>though there is a mention that a reply was filed by the petitioner. The Special<br \/>\nSecretary should have complied with the directions issued by the Court in<br \/>\nthe judgment and order dated 27th January, 2010.\n<\/p>\n<p>      The order dated 25th June, 2010 passed by the Special Secretary,<br \/>\nGovernment of U.P., therefore, cannot be sustained and is, accordingly, set<br \/>\naside.
