Justice K.T.SANKARAN\n\n Dated :25\/05\/2007\n\n O R D E R\n                H.L.DATTU, C.J.   &amp;   K.T.SANKARAN, J.\n\n                 ------------------------------------------\n\n                            W.P.(C) No.4299 of 2007\n\n                  ------------------------------------------\n\n                Dated, this the   25th day of May,  2007\n\n\n                                  JUDGMENT\n<\/pre>\n<p>H.L.Dattu, C.J.\n<\/p>\n<p>      An   advocate   who   calls   himself   a   public   spirited   citizen   is<\/p>\n<p>before   us   in   this   writ   petition   filed   under   Article   226   of   the<\/p>\n<p>Constitution   for   direction   to   the   respondents   to   take   immediate<\/p>\n<p>steps   for   selection   and   appointment   to   the   posts   of   Presidents<\/p>\n<p>and members of the District Consumer Protection Forums in the<\/p>\n<p>State   in   accordance   with   the   provisions   of   the   Consumer<\/p>\n<p>Protection Act, 1986 and the Consumer Protection Rules, 2005.\n<\/p>\n<p>      2. This Court after entertaining the writ petition had issued<\/p>\n<p>notice to the respondents.\n<\/p>\n<p>      3.  The second respondent has entered appearance and has<\/p>\n<p>filed his counter affidavit before  this  Court.      At paragraph  4 of<\/p>\n<p>the counter affidavit the second respondent has stated as under:\n<\/p>\n<blockquote><p>              &#8220;4.   Pursuant   to   the   panel   already   received,<\/p>\n<p>       interview was conducted on 1st, 2nd and 5th of March,<\/p>\n<p>       2007 and the Government are awaiting for the panel<\/p>\n<p>       for   recommendation   of   appointment   from   the<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.4299\/2007                     2<\/span><\/p>\n<p>       selection   committee.     It   is   submitted   that   State<\/p>\n<p>       Government   is   giving   top   priority   for   filling   up   the<\/p>\n<p>       post   of   various   forums   of   Consumer   Disputes<\/p>\n<p>       Redressal   Forums.     The   delay   in   filling   up   of   the<\/p>\n<p>       vacancy arose only due to administrative exigencies.<\/p>\n<p>       The   contention   raised   by   the   petitioner   that   the<\/p>\n<p>       delay occurred on account of the extraneous reasons<\/p>\n<p>       is  incorrect  and  hence  denied.   It   is   submitted  that<\/p>\n<p>       the   entire   process   of   selection   will   be   completed   at<\/p>\n<p>       the earliest.<\/p><\/blockquote>\n<p>      4.  In principle, the second respondent agrees that the posts<\/p>\n<p>of   Presidents   and   members   of   the   District   Consumer   Protection<\/p>\n<p>Forums in the State require to be filled up and he also states that<\/p>\n<p>the same will be done at the earliest.\n<\/p>\n<p>      5.     In   view   of   the   statement   made   by   the   second<\/p>\n<p>respondent   in   his   counter   affidavit,   in   our   opinion,   the   only<\/p>\n<p>direction that requires to be issued in this writ petition is to direct<\/p>\n<p>respondent No.2 to fill up the posts of Presidents and members of<\/p>\n<p>the   District   Consumer   Protection   Forums   in   the   State     as<\/p>\n<p>expeditiously as possible.\n<\/p>\n<p>      In   view   of   the   above,   the   following:     The   writ   petition   is<\/p>\n<p>allowed.  The second respondent is directed to fill up the posts of<\/p>\n<p>Presidents   and   members   of   the   District   Consumer   Protection<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.4299\/2007                       3<\/span><\/p>\n<p>Forums   in   the   State   in   accordance   with   the   provisions   of   the<\/p>\n<p>Consumer   Protection   Act,   1986   and   the   Consumer   Protection<\/p>\n<p>Rules,  2005   as   expeditiously  as   possible  and  at   any  rate  within<\/p>\n<p>four months from today.
