RAMASWAMY, G.T. NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted  . We  have heard learned counsel on both<br \/>\nsides.\n<\/p>\n<p>     This appeal  by special  leave arises from the judgment<br \/>\nof the\tdivision Bench\tof the\tDelhi High  court,  made  on<br \/>\n1.11.1996 in C.W. No. 2086\/95.\n<\/p>\n<p>     The admitted  position is\tthat the  respondent,  while<br \/>\nworking\t in  the  appellant  corporation,  had\tapplied\t for<br \/>\nvoluntary retirement,  pursuant to  the scheme framed by the<br \/>\nCorporation to relieve the surplus staff.\n<\/p>\n<p>     Initially, by  proceedings dated December 20, 1994, the<br \/>\nCorporation  accepted\this  resignation   subject  to\t the<br \/>\nclearance of  the outstanding dues. The acceptance was to be<br \/>\ngiven effect  from December 31,1994. By letter dated January<br \/>\n6, 1995,  he  requested\t for  deduction\t of  a\tsum  of\t Rs.<br \/>\n37,521.20 out  of the  outstanding dues.  He also  requested<br \/>\nthus:\n<\/p>\n<blockquote><p>     &#8220;I once  again request you that the<br \/>\n     formal relieving order relieving me<br \/>\n     for  me   immediately.  My\t service<br \/>\n     period  for   which  ex-gratia   is<br \/>\n     payable be\t informed to  me and  my<br \/>\n     dues be paid immediately.&#8221;<\/p><\/blockquote>\n<p>     Based thereon, it is contended by Mr. P.P. Rao, learned<br \/>\nsenior counsel\tfor the\t appellant, that  acceptance of\t the<br \/>\nvoluntary retirement of the respondent was a conditional one<br \/>\nHe himself  understood that  unless he\tis relieved  of\t the<br \/>\nduties after  payment of  outstanding  dues,  the  voluntary<br \/>\nretirement does\t not become  effective.\t In  the  meanwhile,<br \/>\nrealising  the\t mistake  committed  by\t the  appellant\t for<br \/>\neffecting the  voluntary retirement  scheme which  does\t not<br \/>\napply to  the Corporation  since there\tis no surplus staff,<br \/>\nthe appellant  withdrew the   scheme.  Therefore, there\t was<br \/>\nneither the  scheme  nor  a  concluded\torder  of  voluntary<br \/>\nretirement of  the respondent relieving him from the duties.<br \/>\nThe High  Court, therefore, is not right in holding that the<br \/>\norder dated  December 20,1994  created vested  right in\t the<br \/>\nrespondent and\tthe same  cannot be  divested by  subsequent<br \/>\norders.\n<\/p>\n<p>     Initially, Mr.  A.K. Sikri\t appeared on  behalf of\t the<br \/>\nrespondent and\targued the matter. Before the order could be<br \/>\ndictated, the  respondent himself appeared and said that his<br \/>\ncounsel may be relieved and he may be permitted him to argue<br \/>\nthe matter.  Accordingly, we  permitted\t him  to  argue\t the<br \/>\nmatter. He stated that\the was relieved from the duty on the<br \/>\nbasis of  an endorsement  made on  the letter dated December<br \/>\n20,1994 and  what he  meant  by\t writing  the  letter  dated<br \/>\nJanuary 6,1995\twas  to seek a certificate for relieving him<br \/>\nfrom the  duty. The  acceptance of  the voluntary retirement<br \/>\nhaving become  effective from  December\t  31,  1994,  vested<br \/>\nright had  been created\t in him.  Therefore, the view of the<br \/>\nHigh Court is in accordance with law.\n<\/p>\n<p>     Having  regard   to  the  respective  contentions,\t the<br \/>\nquestion that  arises  for  consideration  is:\twhether\t the<br \/>\nrespondent acquired  a vested  right after acceptance of the<br \/>\nvoluntary retirement by proceedings dated December 20, 1994?<br \/>\nIt is  seen that  the order  is a  conditional order in that<br \/>\nuntil  the   dues  are\tpaid,  the  order  does\t not  become<br \/>\neffective.  The\t  respondent  himself\tadmitted  that\t the<br \/>\noutstanding dues  could be adjusted from the  amount payable<br \/>\nto him.\t Admittedly, no\t such adjustment has been made. He ,<br \/>\ntherefore, rightly  understood that unless he is relieved of<br \/>\nthe duties of the post, after the payment of the outstanding<br \/>\ndues, the  order accepting his voluntary retirement does not<br \/>\nbecome effective.\n<\/p>\n<p>     It is  now\t settled  legal\t position  that\t unless\t the<br \/>\nemployee is  relieved of  the duty,  after acceptance of the<br \/>\noffer  of   voluntary  retirement   or\tresignation,   jural<br \/>\nrelationship of\t the employee and the employer does not come<br \/>\nto  an\t end.  since   the  order  accepting  the  voluntary<br \/>\nretirement was\ta conditional  one, the\t conditions ought to<br \/>\nhave been  complied with.  Before the  conditions  could  be<br \/>\ncomplied  with,\t  the\tappellant   withdrew   the   scheme.<br \/>\nconsequently, the  order accepting  voluntary retirement did<br \/>\nnot become  effective. Thereby\tno  vested  right  has\tbeen<br \/>\ncreated\t in  favour  of\t the  respondent.  The\tHigh  court,<br \/>\ntherefore, was\tnot right in holding that the respondent has<br \/>\nacquired a vested right and, therefore, the appellant has no<br \/>\nright to withdraw the scheme subsequently.\n<\/p>\n<p>     The appeal\t is accordingly allowed. The judgment of the<br \/>\nHigh  Court   stands  reversed.\t The  writ  petition  stands<br \/>\ndismissed.
