Police Station City, Rohtak sent up Tilak Raj<br \/>\nappellant and one Brij Mohan, to court for trial under<br \/>\nSections 392 and 397 of the Indian Penal Code (for short<br \/>\n&#8220;the Code&#8221;), on the allegations that on 14.12.1988 at 6<br \/>\nP.M. they stopped a diary owner, Jai Parkash, on the way<br \/>\nwhen he was taking milk to Kath Mandi, Rohtak on a cycle.<br \/>\nThey asked him to hand over to them whatever he had, after<br \/>\nplacing knife at his neck. Thereafter, they took out two<br \/>\ncurrency notes of the denomination of Rs. 100\/- each along<br \/>\nwith a bill, from his pocket, and fled away. Soon<br \/>\nthereafter, Ran Singh and Siri Bhagwan reached the spot<br \/>\nand chased them but they succeeded in running away. Jai<br \/>\nParkash lodged report with the police and on the basis<br \/>\nthereof this case was registered. The appellant was<br \/>\narrested on 22.12.1988. During investigation, he got<br \/>\nrecovered one hundred rupee currency note and the bill in<br \/>\nquestion from under the bushes by the side of railway-line<br \/>\nin pursuance of a disclosure statement made by him. The<br \/>\nother accused Brij Mohan was arrested on 30.12.1988. He,<br \/>\ntoo, got recovered a hundred rupee currency note from his<br \/>\nhouse in pursuance of a disclosure statement made by<br \/>\nhim.\n<\/p>\n<p>2. After receipt of the case by way of commitment,<br \/>\nlearned Additional Sessions Judge, Rohtak, tried the<br \/>\nappellant and his accomplice Brij Mohan. On completion<br \/>\nof trial, Brij Mohan was acquitted, while the appellant<br \/>\nwas convicted under Section 392 read with Section 397 of<br \/>\nthe Code and was sentenced to undergo rigorous<br \/>\nimprisonment for 7 years, on October 17, 1990.\n<\/p>\n<p>3. Against the judgment of trial court, the<br \/>\nappellant filed this appeal. As he had not engaged a<br \/>\ncounsel, the court provided the assistance of Shri<br \/>\nJ.S. Dhillon, Advocate, as Amicus curiae.\n<\/p>\n<p>4. When the appeal was taken up today for hearing,<br \/>\nnone appeared on behalf on the appellant.\n<\/p>\n<p>5. Shri Yash Pal, learned Assistant Advocate<br \/>\nGeneral, rightly pointed out that the complainant, Jai<br \/>\nBhagwan, had fully supported the prosecution case before<br \/>\nthe learned trial court by giving all the details of the<br \/>\noccurrence including that it was the appellant who had<br \/>\nplaced knife at his neck and thereafter the money and<br \/>\nthe bill were taken out from his pocket by him (appellant)<br \/>\nand his accomplice. He further pointed out that the<br \/>\ncomplainant was rightly believed by the learned trial<br \/>\ncourt as he was an independent person and did not have any<br \/>\nmotive to falsely implicate the appellant in this case.<br \/>\nIt is further to be found in the judgment under appeal<br \/>\nthat P.W. Ran Singh reached the spot and he was told by the<br \/>\ncomplainant that he had been robbed by two persons at the<br \/>\npoint of dagger. Further corroboration of the<br \/>\nprosecution case is forth coming from the testimony of the<br \/>\ninvestigating officer, Inspector Manohar Lal (PW-6), who<br \/>\ndeposed that the appellant got recovered a hundred rupee<br \/>\ncurrency note and the bill in question (Ex. PE) in<br \/>\npursuance of a disclosure statement made by him during<br \/>\ninvestigation, before him.\n<\/p>\n<p>6. Learned trial court had thus rightly held that<br \/>\nthe case against Tilak Raj appellant stood proved beyond<br \/>\ndoubt and as the case against the other accused Brij Mohan<br \/>\nwas not free doubt in so far as his identity was<br \/>\nconcerned, he was acquitted.\n<\/p>\n<p>7. Thus, finding no merit in the appeal on the<br \/>\npoint of conviction the same is dismissed. In so far as<br \/>\nthe verdict of sentence is concerned appellant appears to<br \/>\nbe a first offender. He was a young man of 24 years of age<br \/>\nat the time of occurrence. He has been suffering the<br \/>\nrigours of criminal trial for the last more than 14 years.<br \/>\nLearned Assistant Advocate General pointed out that he had<br \/>\nremained in custody in this case for a period of two<br \/>\nyears.
