No.22509 of 2010\n                      KISHORE KUMAR SINHA, Son of Late Devendra Kumar\n                                                Versus\n                           STATE OF BIHAR THRU.VIGILANCE\n                                              -----------\n<\/pre>\n<p>4\/   12.08.2010            Heard learned counsel for the petitioner and the Vigilance.<\/p>\n<p>                            Petitioner is an accused in vigilance case no. 25 of 2010<\/p>\n<p>                  dated 14.04.2010 under Sections 7\/13 (2) read with 13(1)(d) of the<\/p>\n<p>                  Prevention of Corruption Act.\n<\/p>\n<p>                            Learned counsel for the petitioner submits that he has been<\/p>\n<p>                  falsely implicated by the complainant, who is a P.D.S. dealer, namely<\/p>\n<p>                  Tanvir Alam. He further submits that necessary correction of<\/p>\n<p>                  allotment was already done. The complainant is a P.D.S. dealer, hence<\/p>\n<p>                  his grievance was over on 02.04.2010 itself and as such there was no<\/p>\n<p>                  occasion to take bribe. He further submits that in any view of the<\/p>\n<p>                  matter charge sheet has been submitted and he would cooperate in<\/p>\n<p>                  trial.\n<\/p>\n<p>                            Counsel for the Vigilance submits that petitioner was caught<\/p>\n<p>                  red handed while accepting bribe of Rs.5,000\/-<\/p>\n<p>                            After hearing the parties, this Court directs that petitioner,<\/p>\n<p>                  named above, is directed to be released on bail on furnishing bail bond<\/p>\n<p>                  of Rs. 5,000\/- (Five thousand) with two sureties of the like amount<\/p>\n<p>                  each to the satisfaction of Special Judge (Vigilance) North Bihar,<\/p>\n<p>                  Muzaffapur in connection with Vigilance P.S. case no. 25 of 2010,<\/p>\n<p>                  with the condition that he shall not physically absent for two<br \/>\n<span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>        consecutive dates at stretch, till four witnesses are examined.<\/p>\n<p>        Violation of the condition would make liable for cancellation of his<\/p>\n<p>        bail bond.\n<\/p>\n<\/p>\n<p>                          (Samarendra Pratap Singh, J.)<br \/>\nUday\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Kishore Kumar Sinha vs State Of Bihar Thru.Vigilance on 12 August, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
