     The petitioner submits he and his brothers are the<\/p>\n
absolute owners of one acre of property in resurvey No.398\/3-4<\/p>\n
of A.R.Nagar Village in Tirurangadi Taluk. The predecessor in<\/p>\n
interest of respondents 2 to 6 filed a suit against the petitioner<\/p>\n
and his brothers seeking an injunction restraining them from<\/p>\n
trespassing into the property or causing any damage. The said<\/p>\n
suit was dismissed by the trial court by Ext.P1. The said<\/p>\n
judgment was confirmed by the 1st appellate court by Ext.P3.<\/p>\n
The petitioner submits, the said courts have found the title and<\/p>\n
possession of the petitioner and his brothers over the property.<\/p>\n
The second appeal attempted against Ext.P3 was dismissed by<\/p>\n
this Court by Ext.P4 judgment. In view of the above judgments,<\/p>\n
the party respondents have no semblance of right over the<\/p>\n
property, it is submitted. But, when the petitioner went to the<\/p>\n
property along with his workers, the respondents 2 to 6<\/p>\n

threatened them with physical violence for entering the<\/p>\n
property. Immediately, he filed Ext.P5 representation before the<\/p>\n
police. Alleging that the police did not take any effective action<\/p>\n
to protect him, this writ petition is filed.\n<\/p>\n<\/p>\n
     2.     The 2nd respondent has filed a counter affidavit<\/p>\n
disputing the right of the petitioner over the property.<\/p>\n
According to the said respondent, the suit was dismissed mainly<\/p>\n
on the ground that the property in respect of which injunction<\/p>\n
was sought cannot be identified. It is also submitted that there<\/p>\n
is no clear finding regarding the title of the petitioner or his<\/p>\n
brothers by the civil court. Because of the failure of the plaintiff<\/p>\n
to prove his title and possession, the suit was dismissed.<\/p>\n
     3.     The learned counsel for the petitioner in answer<\/p>\n
submitted that there is a clear finding by the appellate court<\/p>\n
regarding the title and possession of the petitioner and his<\/p>\n
brothers.\n<\/p>\n

      4.    The dispute between the parties is a civil dispute. If,<\/p>\n
the party respondents are causing obstruction to the enjoyment<\/p>\n
of the property by the petitioner and his brothers, the remedy of<\/p>\n
them lies before the civil court. They can move the civil court<\/p>\n
and try to get an injunction against the obstructors.        If the<\/p>\n
injunction order is violated, the civil court can address the police<\/p>\n
to render necessary assistance to the plaintiffs.      Even if, the<\/p>\n
petitioner has got a final decree against the party respondents in<\/p>\n
a suit filed by him and if that is violated by the defendants, the<\/p>\n
remedy of the petitioner is to move the court which passed the<\/p>\n
decree. In this case, there is no decree in favour of the petitioner<\/p>\n
except some findings in the judgments dismissing the suit of the<\/p>\n
contesting respondents. So, the petitioner cannot claim superior<\/p>\n
rights than a decree holder.       The police have no power or<\/p>\n
authority to go through the judgments in favour of the petitioner<\/p>\n
and thereafter come to his rescue if the alleged rights flowing<\/p>\n
from the decree are infringed by the parties to that suit. The<\/p>\n
police cannot be conferred any such jurisdiction. There is no law<\/p>\n
in force in India authorising the police to do that.        In this<\/p>\n
jurisdiction, we are concerned only with the failure of duty from<\/p>\n

the part of the police. We are not supposed to adjudicate the<\/p>\n
rights of the parties and thereafter order protection based on our<\/p>\n
findings. Accordingly, the writ petition fails and it dismissed<\/p>\n
without prejudice to the contentions of the petitioner and his<\/p>\n
right to move other forums for appropriate reliefs.<\/p>\n
