Considering the<br \/>\n\tsubmissions, made by both the parties, question involved and raised<br \/>\n\tin present petition requires detailed examination. Hence, Rule.<br \/>\n\tLearned advocate Mr.H.K.Patel waives service of notice of Rule on<br \/>\n\tbehalf of respondent. With consent of both the learned advocates,<br \/>\n\tthe matter is taken-up for final hearing.\n<\/p>\n<p>In<br \/>\n\teach matter, petitioner has challenged the interim order passed by<br \/>\n\tlearned Labour Court under Section 36(4) of Industrial Disputes Act,<br \/>\n\t1947. Before Labour Court on behalf of petitioner advocate<br \/>\n\tMr.Himanshu I. Shah filed Vakalatnama with application to permit him<br \/>\n\tto appear on behalf of petitioner, which was pending before learned<br \/>\n\tLabour Court, Bharuch. This application for engaging the advocate<br \/>\n\thas been objected by learned representative of respondent-employee<br \/>\n\tin each reference proceeding under provisions of Industrial Disputes<br \/>\n\tAct, 1947 if any advocate is required to be engaged, he may be<br \/>\n\tengaged with the consent of other parties and with the leave of the<br \/>\n\tLabour Court. Therefore, learned Labour Court has considered<br \/>\n\tobjection raised by representative of employee. Application which<br \/>\n\twas to engage the advocate was rejected by learned Labour Court by<br \/>\n\tthe order dated 13.01.2010.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr.H.K.Patel on behalf of respondent submitted that<br \/>\n\tinitially ex-parte award was passed by learned Labour Court because<br \/>\n\tof the negligence of petitioner. This ex-parte award was passed on<br \/>\n\t17.03.2005 in Reference (LCB) No.222 of 2003 and other allied<br \/>\n\treferences. Against<br \/>\n\tex-parte award, application for setting aside the said award was<br \/>\n\tmade by petitioner, which was allowed by learned Labour Court,<br \/>\n\tBharuch on 08.10.2008. Thereafter, the matter remained pending<br \/>\n\tbecause of non-cooperation of petitioner. Learned advocate Mr.Patel<br \/>\n\tsubmitted that if petitioner is permitted then, matter will get<br \/>\n\tfurther delay and representative of the employee rightly raised the<br \/>\n\tobjection because more than seven years have been passed from the<br \/>\n\tdate of each reference. He further submitted that there was some<br \/>\n\treason to raise objections, otherwise normally respondent-employee<br \/>\n\tis not raising objection in engaging advocate. He submitted that in<br \/>\n\tRecovery Application No. 148 of 2005, 149 of 2005 and 150 of 2005 in<br \/>\n\twhich no objection has been raised by representative of<br \/>\n\trespondent-Union against engaging advocate by petitioner. Learned<br \/>\n\tLabour Court after considering the objection raised by respondent<br \/>\n\trepresentative, rejected the application made petitioner.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr.Jadeja on behalf of petitioner submitted that they will<br \/>\n\tco-operate hearing before learned Labour Court, Bharuch, if<br \/>\n\tpermission to engage the advocate is given by respondent. He also<br \/>\n\tsubmitted that Deputy Executive Engineer or Executive Engineer<br \/>\n\tcannot remain present and cannot proceed with the Reference because<br \/>\n\tthey do not have sufficient legal knowledge to appear before learned<br \/>\n\tLabour Court, therefore, it may cause prejudice, if petitioner is<br \/>\n\tnot permitted to engage advocate.\n<\/p>\n<p>In<br \/>\n\tlight of these backgrounds, according to my opinion the reference is<br \/>\n\tof the year 2003 and more than seven years have been passed and<br \/>\n\tstill matter is not finally decided by learned Labour Court. If this<br \/>\n\tCourt, direct learned Labour Court to decide it within some<br \/>\n\treasonable time, while giving permission to engage the advocate,<br \/>\n\tthen, it will meet the ends of justice between parties.\n<\/p>\n<p>In<br \/>\n\tview of order passed by learned Labour Court, Bharuch on 13.01.2010<br \/>\n\tchallenged in each petition is hereby quashed and set aside with a<br \/>\n\tdirection to learned Labour Court to permit petitioner to engage the<br \/>\n\tadvocate in each reference proceedings and learned representatives<br \/>\n\tof respondent shall have to give their consent for engaging the<br \/>\n\tadvocate as learned advocate Mr.H.K.Patel has not raised any<br \/>\n\tobjection for giving consent to the petitioner to engage the<br \/>\n\tadvocate. It is further directed to learned Labour Court, Bharuch to<br \/>\n\tdecide each reference within a period of 6(Six) months from the date<br \/>\n\tof receiving a copy of this order. Petitioner is directed to<br \/>\n\tco-operate hearing before learned Labour Court in each case and not<br \/>\n\tto ask for any unnecessary adjournments except, unavoidable<br \/>\n\tcircumstances. It is further directed to petitioner-Deputy Executive<br \/>\n\tEngineer, Road and Building Sub Division, Dediapada, Dist. Narmada<br \/>\n\tto supply all the necessary details as required by advocate who will<br \/>\n\tbe engaged by petitioner.
