In \u00a0 our \u00a0 order \u00a0 dated \u00a0 6 \u00a0 January\u00a0 2011, \u00a0 we \u00a0 had \u00a0 directed \u00a0 that \u00a0 the \u00a0 CPIO\u00a0<\/p>\n<p>concerned\u00a0should\u00a0appear\u00a0before\u00a0us\u00a0and\u00a0explain\u00a0the\u00a0reasons\u00a0for\u00a0the\u00a0delay\u00a0in\u00a0<\/p>\n<p>providing\u00a0information\u00a0to\u00a0the\u00a0information\u00a0seeker.\u00a0In\u00a0this\u00a0case,\u00a0the\u00a0RTI\u00a0application\u00a0<\/p>\n<p>had \u00a0 been \u00a0 filed \u00a0 in \u00a0 the \u00a0 Shankargarh \u00a0 Branch \u00a0 on \u00a0 22 \u00a0 July \u00a0 2009. \u00a0 The \u00a0 Branch\u00a0<\/p>\n<p>Manager\u00a0of\u00a0this\u00a0Branch\u00a0had\u00a0appeared\u00a0before\u00a0us\u00a0on\u00a0the\u00a0last\u00a0date\u00a0of\u00a0hearing\u00a0and\u00a0<\/p>\n<p>had\u00a0claimed\u00a0that\u00a0he\u00a0had\u00a0forwarded\u00a0the\u00a0RTI\u00a0application\u00a0to\u00a0the\u00a0CPIO\u00a0concerned\u00a0<\/p>\n<p>for\u00a0further\u00a0action.\u00a0Therefore,\u00a0we\u00a0had\u00a0concluded\u00a0that\u00a0the\u00a0reasons\u00a0for\u00a0the\u00a0delay\u00a0in\u00a0<\/p>\n<p>this\u00a0case\u00a0should\u00a0be\u00a0explained\u00a0by\u00a0the\u00a0CPIO\u00a0concerned.<\/p>\n<p>CIC\/SM\/A\/2010\/000615\n<\/p>\n<p> 3.      Today,\u00a0 during \u00a0 the \u00a0 hearing,\u00a0 Sri \u00a0 J \u00a0 Bhattacharya,\u00a0 the \u00a0 CPIO\u00a0 concerned,\u00a0<\/p>\n<p>appeared\u00a0and,\u00a0both\u00a0in\u00a0writing\u00a0and\u00a0orally\u00a0submitted\u00a0that\u00a0the\u00a0Branch\u00a0Manager\u00a0<\/p>\n<p>had\u00a0not\u00a0forwarded\u00a0the\u00a0application\u00a0at\u00a0all\u00a0and\u00a0that\u00a0he\u00a0came\u00a0to\u00a0know\u00a0about\u00a0the\u00a0<\/p>\n<p>application\u00a0only\u00a0when\u00a0the\u00a0information\u00a0seeker\u00a0sent\u00a0it\u00a0to\u00a0the\u00a0CPIO\u00a0directly.\u00a0It\u00a0was\u00a0<\/p>\n<p>only\u00a0then\u00a0that\u00a0he\u00a0had\u00a0initiated\u00a0action\u00a0to\u00a0get\u00a0the\u00a0record\/\u00a0information\u00a0from\u00a0the\u00a0<\/p>\n<p>Branch. \u00a0 He \u00a0 produced \u00a0 some \u00a0 documents \u00a0 to \u00a0 prove \u00a0 that \u00a0 the \u00a0 Branch \u00a0 had \u00a0 not\u00a0<\/p>\n<p>forwarded\u00a0the\u00a0application\u00a0to\u00a0the\u00a0office\u00a0of\u00a0the\u00a0CPIO\u00a0as\u00a0had\u00a0been\u00a0claimed\u00a0by\u00a0the\u00a0<\/p>\n<p>then\u00a0Branch\u00a0Manager\u00a0Sri\u00a0Ram.\u00a0Thus,\u00a0it\u00a0is\u00a0quite\u00a0clear\u00a0that\u00a0the\u00a0Branch\u00a0Manager\u00a0<\/p>\n<p>concerned\u00a0had\u00a0not\u00a0presented\u00a0the\u00a0facts\u00a0correctly\u00a0and\u00a0had\u00a0tried\u00a0to\u00a0pass\u00a0on\u00a0the\u00a0<\/p>\n<p>blame\u00a0to\u00a0the\u00a0CPIO.\n<\/p>\n<\/p>\n<p>4.      After \u00a0 carefully \u00a0 considering \u00a0 the \u00a0 records \u00a0 produced \u00a0 before \u00a0 us \u00a0 and \u00a0 the\u00a0<\/p>\n<p>submissions \u00a0 made \u00a0 by \u00a0 the \u00a0 CPIO \u00a0 concerned \u00a0 and \u00a0 after \u00a0 keeping \u00a0 in \u00a0 mind \u00a0 the\u00a0<\/p>\n<p>submissions\u00a0made\u00a0earlier\u00a0by\u00a0Sri\u00a0R\u00a0K\u00a0Ram,\u00a0the\u00a0then\u00a0Branch\u00a0Manager,\u00a0we\u00a0find\u00a0<\/p>\n<p>the\u00a0latter\u00a0totally\u00a0responsible\u00a0for\u00a0the\u00a0delay\u00a0in\u00a0the\u00a0case.\u00a0The\u00a0RTI\u00a0application\u00a0had\u00a0<\/p>\n<p>been\u00a0presented\u00a0in\u00a0the\u00a0Branch\u00a0on\u00a022\u00a0July\u00a02009.\u00a0It\u00a0should\u00a0have\u00a0been\u00a0transferred\u00a0<\/p>\n<p>within \u00a0 five \u00a0 days \u00a0 of \u00a0 receiving \u00a0 it \u00a0 and \u00a0 the \u00a0 CPIO \u00a0 should \u00a0 have \u00a0 provided \u00a0 the\u00a0<\/p>\n<p>information \u00a0 within \u00a0 30 \u00a0 days \u00a0 of \u00a0 receiving \u00a0 the \u00a0 RTI \u00a0 application. \u00a0 However, \u00a0 the\u00a0<\/p>\n<p>information\u00a0was\u00a0finally\u00a0provided\u00a0on\u00a014\u00a0October\u00a02009.\u00a0Thus,\u00a0there\u00a0was\u00a0a\u00a0delay\u00a0<\/p>\n<p>of\u00a0nearly\u00a050\u00a0days\u00a0in\u00a0this\u00a0case.\u00a0Since\u00a0the\u00a0Branch\u00a0Manager\u00a0had\u00a0not\u00a0transferred\u00a0<\/p>\n<p>the\u00a0application\u00a0resulting\u00a0in\u00a0the\u00a0consequent\u00a0delay,\u00a0he\u00a0alone\u00a0is\u00a0responsible\u00a0and\u00a0is\u00a0<\/p>\n<p>therefore\u00a0liable\u00a0for\u00a0imposition\u00a0of\u00a0penalty\u00a0in\u00a0terms\u00a0of\u00a0Section\u00a020\u00a0(!)\u00a0of\u00a0the\u00a0Right\u00a0to\u00a0<\/p>\n<p>Information\u00a0(RTI)\u00a0Act.\u00a0We\u00a0impose\u00a0a\u00a0penalty\u00a0of\u00a0Rs\u00a012,500\u00a0on\u00a0SRI\u00a0RK\u00a0Ram,\u00a0the\u00a0<\/p>\n<p>then\u00a0Branch\u00a0Manager\u00a0at\u00a0the\u00a0rate\u00a0of\u00a0Rs\u00a0250\u00a0per\u00a0day.\u00a0We\u00a0direct\u00a0the\u00a0present\u00a0<\/p>\n<p>CPIO\u00a0to\u00a0deduct\u00a0this\u00a0amount\u00a0from\u00a0the\u00a0monthly\u00a0salary\u00a0of\u00a0this\u00a0officer\u00a0in\u00a0five\u00a0equal\u00a0<\/p>\n<p>instalments\u00a0beginning\u00a01\u00a0April\u00a02011\u00a0and\u00a0remit\u00a0it\u00a0to\u00a0the\u00a0assistant\u00a0registrar,\u00a0CIC\u00a0by\u00a0<\/p>\n<p>the\u00a0way\u00a0of\u00a0demand\u00a0draft\u00a0drawn\u00a0in\u00a0favour\u00a0of\u00a0PAO,\u00a0and\u00a0payablel\u00a0at\u00a0New\u00a0Delhi.<\/p>\n<p>CIC\/SM\/A\/2010\/000615\n<\/p>\n<p> 5.      The\u00a0case\u00a0is\u00a0disposed\u00a0off\u00a0accordingly.\n<\/p>\n<\/p>\n<p>6.
