No. 1451 of 2008\n             - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 5th day of February, 2010.\n\n                                   ORDER\n<\/pre>\n<p>          This is a petition filed under Section 482 of the<\/p>\n<p>Code of Criminal Procedure seeking to have Annexure A<\/p>\n<p>complaint quashed.\n<\/p>\n<p>          2.    Petitioner is the second accused in C.C.<\/p>\n<p>No.871 of 2003 before the Judicial Magistrate of the First<\/p>\n<p>Class, North Paravoor.\n<\/p>\n<p>          3.       Proceedings originated on a private<\/p>\n<p>complaint filed against the accused persons for having<\/p>\n<p>committed offence punishable under Section 37 read<\/p>\n<p>with Section 40 of the Air (Prevention &amp; Control of<\/p>\n<p>Pollution) Act, hereinafter referred to as the Act. The<\/p>\n<p>allegation is that the first accused, which is an industry,<\/p>\n<p>has conducting its affairs without complying with the<\/p>\n<p>directions issued by the Department and without valid<\/p>\n<p>consent of the second respondent herein under the Act.<\/p>\n<p>The petitioner would submit that the industry has not<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.1451\/208.              2<\/span><\/p>\n<p>been functioning since 14.6.2002.        On that day       an<\/p>\n<p>application for renewal of licence was submitted and it was<\/p>\n<p>rejected by the second respondent.       Even going by the<\/p>\n<p>statement made by the second respondent herein, company<\/p>\n<p>has not been      running from   27.11.2002 onwards.     It is<\/p>\n<p>therefore clear that the complaint itself is not maintainable.<\/p>\n<p>It is also pointed     out by the learned counsel for the<\/p>\n<p>petitioner that even assuming that what the complainant<\/p>\n<p>says is true, still the complaint is not maintainable for the<\/p>\n<p>simple reason that it was not laid by a person authorised to<\/p>\n<p>do so. Learned counsel drew the attention of this court to<\/p>\n<p>Section 40 of the Act and relied on the decisions reported in<\/p>\n<p><a href=\"\/doc\/1549889\/\">Mangulal Chunilal v. Manilal Maganlal (AIR<\/a> 1968 SC<\/p>\n<p>822) and A.K.Roy v. State of Punjab (AIR 1986 SC 2160)<\/p>\n<p>to point out that the complaint is not maintainable.<\/p>\n<p>             4.  Learned counsel appearing for the second<\/p>\n<p>respondent       made available a notification issued, which<\/p>\n<p>showed        the persons, who are competent to lay the<\/p>\n<p>complaint.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.1451\/208.                 3<\/span><\/p>\n<p>             5. This petition will have to be succeeded on a<\/p>\n<p>very short ground. Section 43 of the Act reads as follows:<\/p>\n<blockquote><p>      &#8220;43.     Cognizance of offences:-       (1) No court<\/p>\n<p>      shall take cognizance of any offence under this Act<\/p>\n<p>      except on a complaint made by:\n<\/p><\/blockquote>\n<blockquote><p>      (a) a Board or any officer authorized in this behalf<\/p>\n<p>      by it; or<\/p>\n<\/blockquote>\n<blockquote><p>      (b) any person who has given notice of not less<\/p>\n<p>      than sixty days, in the manner prescribed, of the<\/p>\n<p>      alleged offence and of his intention to make a<\/p>\n<p>      complaint to the Board or officer authorized as<\/p>\n<p>      aforesaid, and no court inferior to that of a<\/p>\n<p>      Metropolitan Magistrate or a Judicial Magistrate of<\/p>\n<p>      the first class shall try any offence punishable<\/p>\n<p>      under this Act.\n<\/p><\/blockquote>\n<blockquote><p>      (2)Where a complaint has been made under clause<\/p>\n<\/blockquote>\n<blockquote><p>         (b) of sub-section (1), the Board shall on demand<\/p>\n<p>         by such person, make available the relevant<\/p>\n<p>         reports in its possession to that person:<\/p>\n<p>         Provided, that the Board may refuse to make<\/p>\n<p>         any such report available to such person if the<\/p>\n<p>         same is, in its opinion against the public<\/p>\n<p>         interest.&#8221;\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">Crl.M.C.1451\/208.             4<\/span><\/p>\n<\/blockquote>\n<p>In the decision reported in Mangulal Chunilal&#8217;s case, it<\/p>\n<p>has been held that the person, who files a complaint must<\/p>\n<p>show that he has the authority to do so. In the decision<\/p>\n<p>reported in A.K.Roy&#8217;s case, it has been held that in cases<\/p>\n<p>where there is specific provision regarding the person, who<\/p>\n<p>can lay the complaint or initiate proceedings, that will have<\/p>\n<p>to be done only by that person and nobody else. In other<\/p>\n<p>words, when a thing is to be done in a particular manner, it<\/p>\n<p>can be done only in that way and not in any other way. In<\/p>\n<p>the case on hand, even going by the Notification made<\/p>\n<p>available by the learned counsel for the second respondent,<\/p>\n<p>the person who is competent to lay the complaint is the<\/p>\n<p>Chief Environmental Engineer. Annexure A1 complaint has<\/p>\n<p>been laid by the Assistant Environmental Engineer. There is<\/p>\n<p>nothing to show that he is authorised to lay the complaint.<\/p>\n<p>Section 43 enables the Board or any authorized officer in<\/p>\n<p>this behalf by it. The Board has only authorised the Chief<\/p>\n<p>Environmental Engineer to lay the complaint.      The Chief<\/p>\n<p>Environmental Engineer has no authority to delegate that<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.1451\/208.                 5<\/span><\/p>\n<p>function      to   the    Assistant     Environmental     Engineer.<\/p>\n<p>Therefore, the court could not have taken cognizance on the<\/p>\n<p>basis of the complaint filed by the Assistant Environmental<\/p>\n<p>Engineer.\n<\/p>\n<p>             In the result, this petition is allowed, the impugned<\/p>\n<p>proceedings are quashed and all further proceedings in C.C.<\/p>\n<p>871 of 2003 before the JFCM, North Paravur shall stand<\/p>\n<p>dropped.       However, this will not preclude the second<\/p>\n<p>respondent from taking such steps as are available to them<\/p>\n<p>in law.\n<\/p>\n<\/p>\n<p>                                                P.
