2.\t\tThe
\npresent application has been preferred for regular bail under section
\n439 of the Code of Criminal Procedure in connection with  the offence
\nregistered as Cr. No. I-67 of 2006 with Virsad police station for the
\noffences punishable under sections 406, 408, 420, 464, 465, 467, 468,
\n471, 120-B and 114 of the Indian Penal Code.\n<\/p>\n
3.\t\tThe
\nlearned advocate for the gs has made a statement that several
\ndeposits\/balance of nearby and close relatives of the applicants are

\t\tThe
\naforesaid amounts come to approximately Rs.2,62,000\/-. This can be
\nretained by the Credit Society without prejudice to the  rights and
\ncontentions of the present applicants. If this amount is already
\nencashed by the concerned persons, then the applicants will deposit
\nRs.2,62,000\/- with the Credit society on or before 23rd
\nMarch,2007.\n<\/p>\n
4.\t\tThe
\nInvestigating Officer will convey to the present applicants whether
\nthe balance\/deposits which are referred to hereinabove, are still
\nwith the concerned society or not. If this amount is already encashed
\nby the concerned depositors, immediately intimation will be given to
\nthe applicants so that without loss of time, the applicants can
\ndeposit the amount of Rs.2,62,000\/- on or before 23rd
\nMarch, 2007. This deposition of amount will not tantamount to
\nadmission on the part of the applicants of any of the facts and will
\nbe subject to the final outcome of the criminal proceedings. This
\nverification  of facts will be carried out by the investigating
\nofficer.\n<\/p>\n
5.\t\tHaving
\nheard the learned advocates for both the sides and looking to the
\nfacts and circumstances, statements of witnesses, gravity of the
\noffence, quantum of punishment, the manner in which the applicants
\nare involved in the offence, as per the allegations of the
\nprosecution, and also keeping in mind the above statement made by the
\nlearned counsel for the applicants,  this  application is allowed.
\nThe applicants are ordered to be released on bail in connection with
\nCrime Register No.I-67 of 2006 of Virsad Police station on each of
\nthem executing a bond of Rs. 10,000\/- (Rs. Ten thousand) with two
\nsureties of the like amount to the satisfaction of the lower Court
\nand subject to the conditions that they shall:\n<\/p>\n
(a)\tnot take undue advantage of their
\nliberty or abuse their liberty;\n<\/p>\n
(b)\tnot act in a manner injurious to
\nthe interest of the prosecution;\n<\/p>\n
(c)\tmaintain law and order;\n<\/p>\n
(d)\tshall mark their presence before
\nVirsad Police Station on every first day of English Calendar month
\nbetween 9.00 a.m. to 2.00 p.m.;\n<\/p>\n
(e)\tnot leave the State of Gujarat
\nwithout the prior permission of the Sessions Court concerned;\n<\/p>\n
(f)\tfurnish the address
\nof their residence at the time of execution of the bond and shall not
\nchange the residence without prior permission of this Court;\n<\/p>\n
(e)\tsurrender their passport, if any,
\nto the lower Court within a week.\n<\/p>\n
6.\t\tIn
\ncase of breach of any of the above conditions, the Sessions Judge
\nconcerned will be free to issue warrant or to take appropriate action
\nin the matter.\n<\/p>\n
7.\t\tBail
\nbond before the lower court having jurisdiction to try the case.\n<\/p>\n
8.\t\tRule
\nis made absolute. Direct service permitted.\n<\/p>\n
