A suit filed  by\t the\nappellant,  contending\tthat the order\tof  termination\t was\nillegal and void and was opposed to the principles of  natu-\nral  justice, as no reason was given in the order, was\tdis-\nmissed\tby the trial court. It was also held that the  Civil\nCourt had no jurisdiction to entertain and try the suit.\n    The Additional District Judge, on appeal, held that\t the\nCivil  Court had jurisdiction to entertain and try the\tsuit\nand  set aside the impugned order of termination as  invalid\nas it was a non-speaking order not containing any reason.\n    In second appeal, the High Court affirmed the finding of\nthe Additional District Judge as to the jurisdiction of\t the\nCivil  Court,  but set aside his finding that  the  impugned\norder  was a non-speaking order and held that it  was  quite\nlegal and valid.\n    In\tthe appeal to this Court it was contended on  behalf\nof  the appellant that the punishing authority had  not\t ap-\nplied his mind before passing the impugned order, which\t was\napparent  from the fact that he had not given any reason  in\njustification  thereof\tand this had vitiated  the  impugned\norder of termination.\nDismissing the appeal, this Court,\n    HELD:  When\t the  punishing authority  agrees  with\t the\nfindings  of  the Enquiry Officer who  accepts\tthe  reasons\ngiven  by him in support of such findings, it is not  neces-\nsary for the punishing authority to again\n1058\ndiscuss\t evidence and come to the same findings as  that  of\nthe Enquiry Officer and give the same reasons for  the-find-\nings. [1060E]\n    In\tthe  instant case, it is difficult to say  that\t the\npunishing authority had not applied his mind. The  punishing\nauthority has placed reliance upon the report of the Enquiry\nOfficer,  which means he has not only agreed with the  find-\nings  of the Enquiry Officer but also accepted\tthe  reasons\ngiven by him for the same. When the punishing authority\t has\naccepted the findings of the Enquiry Officer and the reasons\ngiven by him, the question of non-compliance with the  prin-\nciples of natural justice does not arise. [1060E-F]\n    It\tcannot\tbe  said that the impugned order  is  not  a\nspeaking order and is vitiated. [1060F]\n    [In view of the fact that it is the first offence of the\nappellant, who is said to be the father of five minor  chil-\ndren  and has no other means of livelihood,  the  respondent\nmay consider the re-employment of the appellant to the\tpost\nof Conductor or to any other post, to which he may be  found\nto be suitable.] [1060G-H]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>    CIVIL  APPELLATE JURISDICTION: Civil Appeal No. 1870  of<br \/>\n1982.\n<\/p>\n<p>    From the Judgment and Order dated 2.9.1981 of the Punjab<br \/>\nand Haryana High Court in R.S.A. Subba Rao for\t the<br \/>\nRespondents.\n<\/p>\n<p>The Judgment of the Court was delivered by<br \/>\n     DUTT, J. In this appeal by special leave the appellant,<br \/>\na Bus Conductor of the Haryana Roadways, has challenged\t the<br \/>\nvalidity  of the order of termination of his service on\t the<br \/>\nground\tof  failure of the punishing authority to  give\t any<br \/>\nreason for the impugned order in violation of the principles<br \/>\nof natural justice.\n<\/p>\n<p>     A charge was levelled against the appellant that he did<br \/>\nnot issue tickets to nine passengers, although he had  taken<br \/>\nthe  fare from each of them. A disciplinary  proceeding\t was<br \/>\nstarted against the appellant. The<br \/>\n<span class=\"hidden_text\">1059<\/span><br \/>\nEnquiry\t Officer, after considering the allegations  consti-<br \/>\ntuting the charge, the plea of the appellant in defence\t and<br \/>\nthe evidence adduced by the parties including the appellant,<br \/>\nheld  that the charge against the appellant was proved.\t The<br \/>\npunishing authority agreed with the findings of the  Enquiry<br \/>\nOfficer and by the impugned order terminated the service  of<br \/>\nthe appellant.\n<\/p>\n<p>    Aggrieved,\tthe appellant filed a suit  challenging\t the<br \/>\nlegality  of the order of termination. It was  contended  by<br \/>\nthe  appellant that as no reason was given in  the  impugned<br \/>\norder,\tit  was\t illegal and invalid being  opposed  to\t the<br \/>\nprinciples of natural justice. The Trial Court overruled the<br \/>\nsaid  contention and also held that the Civil Court  had  no<br \/>\njurisdiction to entertain and try the suit. Accordingly, the<br \/>\nTrial Court dismissed the suit.\n<\/p>\n<p>    On appeal, the learned Additional District Judge held in<br \/>\ndisagreement  with  the\t Trial Court and,  in  our  opinion,<br \/>\nrightly\t that the Civil Court had jurisdiction to  entertain<br \/>\nand  try  the suit. The learned Additional  District  Judge,<br \/>\nhowever,  held\tthat the impugned order was  a\tnon-speaking<br \/>\norder  not  containing any reason and, as such, it  was\t in-<br \/>\nvalid.\tIn that view of the matter, the\t learned  Additional<br \/>\nJudge  allowed\tthe appeal, set aside the  judgment  of\t the<br \/>\nTrial Court and the impugned order of termination of service<br \/>\nof the appellant and decreed the suit.\n<\/p>\n<p>    The\t State of Haryana took the matter to the High  Court<br \/>\nin  a second appeal. The High Court affirmed the finding  of<br \/>\nthe learned Additional District Judge as to the jurisdiction<br \/>\nof  the\t Civil\tCourt, but set aside his  finding  that\t the<br \/>\nimpugned order was a non-speaking order. The High Court took<br \/>\nthe view that the impugned order was quite legal and  valid.<br \/>\nUpon  the said findings. the High Court allowed\t the  appeal<br \/>\nand  set aside the judgment and decree of the learned  Addi-<br \/>\ntional District Judge. Hence this appeal by special leave.<br \/>\n    It\thas  been  urged by Mr.\t Tarkunde,  learned  Counsel<br \/>\nappearing  on  behalf of the appellant, that  the  punishing<br \/>\nauthority  has not applied his mind before passing  the\t im-<br \/>\npugned\torder, which is apparent from the fact that  he\t had<br \/>\nnot given any reason in justification of the impugned order.<br \/>\nCounsel submits that non-application of the mind and failure<br \/>\nto  give any reason by the punishing authority vitiated\t the<br \/>\nimpugned order of termination and, accordingly, it should be<br \/>\nset aside.\n<\/p>\n<p>It has been pointed out by the High Court that the punishing<br \/>\n<span class=\"hidden_text\">1060<\/span><br \/>\nauthority  has\tpassed a lengthy order\trunning\t into  seven<br \/>\npages  mentioning therein the contents of the  charge-sheet,<br \/>\nthe detailed deposition of the witnesses, as accorded by the<br \/>\nEnquiry\t Officer, and the findings of the  Enquiry  Officer.<br \/>\nThe  explanation  submitted by the appellant has  also\tbeen<br \/>\nreproduced in the impugned order. Thereafter, the  punishing<br \/>\nauthority stated as follows:-\n<\/p>\n<blockquote><p>\t      &#8220;I have considered the charge-sheet, the reply<br \/>\n\t      filed to the charge-sheet, the statements made<br \/>\n\t      during  enquiry,\tthe report  of\tthe  Enquiry<br \/>\n\t      Officer,\tthe  show cause\t notice,  the  reply<br \/>\n\t      filed  by the delinquent and other papers\t and<br \/>\n\t      that no reason is available to me on the basis<br \/>\n\t      of  which\t reliance may not be placed  on\t the<br \/>\n\t      report  of  the  Enquiry\tOfficer.  Therefore,<br \/>\n\t      keeping these circumstances in view, I  termi-<br \/>\n\t      nate his service with effect from the date  of<br \/>\n\t      issue of this order.&#8221;<\/p><\/blockquote>\n<p>    In\tview  of the contents of the impugned order,  it  is<br \/>\ndifficult  to say that the punishing authority had  not\t ap-<br \/>\nplied  his mind to the case before terminating the  services<br \/>\nof  the appellant. The punishing authority has placed  reli-<br \/>\nance upon the report of the Enquiry Officer which means that<br \/>\nhe  has\t not only agreed with the findings  of\tthe  Enquiry<br \/>\nOfficer, but also has accepted the reasons given by him\t for<br \/>\nthe  findings. In our opinion, when the punishing  authority<br \/>\nagrees with the findings of the Enquiry Officer and  accepts<br \/>\nthe reasons given by him in support of such findings, it  is<br \/>\nnot  necessary for the punishing authority to again  discuss<br \/>\nevidence  and come to the same findings as that of  the\t En-<br \/>\nquiry Officer and give the same reasons for the findings. We<br \/>\nare  unable to accept the contention made on behalf  of\t the<br \/>\nappellant that the impugned order of termination is vitiated<br \/>\nas  it\tis  a non-speaking order and does  not\tcontain\t any<br \/>\nreason.\t When by the impugned order the punishing  authority<br \/>\nhas  accepted  the findings of the Enquiry Officer  and\t the<br \/>\nreason given by him, the question of non-compliance with the<br \/>\nprinciples  of\tnatural justice does not arise. It  is\talso<br \/>\nincorrect  to say that the impugned order is not a  speaking<br \/>\norder.\n<\/p>\n<p>    There  is,\ttherefore, no substance in the\tappeal.\t The<br \/>\nappeal is dismissed.
