THAKUR \n\n \n\nVersus\n \n\nSTATE\nOF GUJARAT THRO' SECRETARY AND ANOTHER\n \n\n====================================== \nAppearance\n: \nMR RC KAKKAD for\nAppellant. \nNone for Respondents.\n \n======================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\nDate\n: 07\/07\/2008 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this Second Appeal, the appellant &#8211; original plaintiff has<br \/>\nchallenged judgment of the appellate Court dated 17th<br \/>\nFebruary 2007, whereby the appellate Court allowed the appeal of the<br \/>\nState Government and set aside the decree passed by the trial Court.\n<\/p>\n<p>2.\tThe<br \/>\nfacts in brief, as emerging from record, are as under:\n<\/p>\n<p>3.\tIt<br \/>\nis the case of the plaintiff that he has filed the suit before the<br \/>\nlearned Civil Judge, Senior Division, Gondal to declare the order<br \/>\nNo.SB\/6-7-90 dated 27-02-1990 passed by defendant no.2 retiring<br \/>\nplaintiff compulsorily, as a result of departmental inquiry, as<br \/>\nunconstitutional, illegal, arbitrary, violative of principles of<br \/>\nnatural justice, null and void and not enforceable at law and sought<br \/>\npermanent injunction restraining the defendants from enforcing the<br \/>\nsaid order.  The plaintiff has also sought declaration that he is<br \/>\nentitled to be continued in service and also entitled to draw all the<br \/>\namounts, pay etc.   It was alleged against the plaintiff that on<br \/>\n13-8-1988 while he was on duty in Punjab at Ludhiyana on Bag Sufiya<br \/>\nNaka at 06:00 p.m., without permission of the commander, he had left<br \/>\nhis duty arbitrarily and intoxicated himself and thereafter, he<br \/>\nmisbehaved with transport operators and used abusive language.  The<br \/>\nplaintiff averred that he did not do so yet charge sheet of<br \/>\nmisbehaviour was issued against him; and inquiry officer was<br \/>\narbitrarily changed by the defendants and that principles of natural<br \/>\njustice were not followed during the departmental inquiry.  He also<br \/>\naverred that there was no evidence to establish that the plaintiff<br \/>\nhad consumed alcohol and witnesses also did not support the<br \/>\ndefendant&#8217;s case, even then inquiry officer held the plaintiff guilty<br \/>\nand a notice dated 20-1-1990 was given to him, which was replied by<br \/>\nthe plaintiff on 16-2-1990.  Thereafter, he was served with order<br \/>\ndated 27-2-1990, which was challenged before the trial Court.\n<\/p>\n<p>4.\tAfter<br \/>\nservice of summons, the defendants appeared before the trial Court<br \/>\nand filed written statement at Exh.20, wherein it was contended that<br \/>\nthe plaintiff is appointed in S.R.P. Group No.VIII, Gondal since<br \/>\n9-11-1968.  It was contended by the defendants that the plaintiff has<br \/>\nmisbehaved on duty on 13-8-1988, for which he was given charge sheet<br \/>\nand the plaintiff was given reasonable opportunity to defend himself<br \/>\nand  principles of natural justice were also followed.  Accordingly,<br \/>\ndefendants denied any arbitrariness and prayed for dismissal of the<br \/>\nsuit with costs.  After hearing both the parties and after<br \/>\nconsidering the documents on record, the trial Court decreed the suit<br \/>\nin favour of the plaintiff by its judgment dated 31-12-1994. Against<br \/>\nsaid judgment, an appeal was preferred by the State Government, which<br \/>\nwas allowed by the appellate Court by its judgment dated 17-2-2007.<br \/>\nThe appellate Court has observed as under in paragraphs 9, 10 and 11<br \/>\nof its judgment.\n<\/p>\n<p>\u00fdS9.\tFirst<br \/>\nof all, if we consider the findings recorded by the Learned Trial<br \/>\nCourt then it is required to be noted that the original plaintiff in<br \/>\nthe Departmental Inquiry in question never objected that<br \/>\nMr.P.N.Gohil, the Commandant, S.R.P.Gr.No.VIII, Gondal cannot preside<br \/>\nover as a Presiding Officer for the Departmental Inquiry in question.<br \/>\n After punishment order in the Departmental Inquiry, the original<br \/>\nplaintiff has also filed Departmental Appeal which has also been<br \/>\nrejected by Nayab Mukhya Police Adhikari [Armed Unit], Gujarat<br \/>\nPolice, Ahmedabad i.e. Additional I.G.P.  While, perusing entire<br \/>\nrecords of Regular Civil Suit No.74\/1990, the original plaintiff has<br \/>\ngot all the opportunities and the original plaintiff appeared in the<br \/>\nDepartmental Inquiry and resisted all the charges framed against him.<br \/>\n So, one could not say that the Principles of Natural Justice is<br \/>\nviolated so far as the facts of this case is concerned.\n<\/p>\n<p>10.\tIf<br \/>\nwe go through from the decision reported in 1964 A.I.R. [A.P.]<br \/>\n407 in the case of Abdul Rahim Vs. Chief Executive Officer, Andhra<br \/>\nPradesh, then<br \/>\nfirst of all it is required to be noted that this decision has not<br \/>\nrendered by the Full Bench of Hon&#8217;ble High Court of Madhya Pradesh.<br \/>\nBut this judgment has been delivered by the Division Bench of Hon&#8217;ble<br \/>\nHigh Court of Andhra Pradesh.  The Hon&#8217;ble High Court of Andhra<br \/>\nPradesh in cited decision in Head Note-B held that \u00fdSThe<br \/>\nEnquiry Officer to whom actual conduct of enquiry is delegated is not<br \/>\nentrusted with the power of imposing the punishment.  His duty<br \/>\ncommences and ends with finding the fact.  In other words, he is<br \/>\nmerely a fact-finding authority.  Therefore, the question as to<br \/>\nwhether the Enquiry Officer was capable of arriving at independent<br \/>\nconclusions being a subordinate officer does not rise in such a case.\n<\/p>\n<p>11.\tThe<br \/>\naforesaid principle holds good but the Learned Trial Court has<br \/>\nmisinterpreted and misconstrued it so far as the case on hand is<br \/>\nconcerned.  It is not in dispute that the Commandant, S.R.P.Gr.<br \/>\nNo.VIII, Gondal is an Appointing Authority and Appointing Authority<br \/>\nis capable of arriving at an independent conclusion and has power to<br \/>\npass any punishment upon the gravity and nature of charges proved<br \/>\nagainst the delinquent.  It is also required to be mentioned that in<br \/>\nthe present case, the Enquiry Officer&#8217;s duty is merely not limited as<br \/>\nthe fact-finding authority.  Here in the present case, the<br \/>\nCommandant, S.R.P.Gr.No.VIII, Gondal has all the powers to conduct<br \/>\nthe inquiry and is also entrusted with the powers of imposing the<br \/>\npunishment.  Hence, the reasons recorded by the Learned Trial Court<br \/>\nfor deciding issue No.1 in the affirmative is illegal, arbitrary, bad<br \/>\nin law, unconstitutional and against the Principle of Natural<br \/>\nJustice.  Hence, the finding recorded by the Learned Trial Court is<br \/>\nrequired to be disturbed and the judgment and decree passed in<br \/>\nRegular Civil Suit No.74\/1990 dated 31\/12\/1994 is required to be<br \/>\ndisturbed.  Therefore, this appeal is required to be allowed, as the<br \/>\nLearned Trial Judge has not considered the gravity and magnitude of<br \/>\nthe charges and unnecessarily committed an error of facts and law in<br \/>\ndecreeing the suit of the original plaintiff.  Hence, for the reasons<br \/>\nrecorded by this court hereinabove, the impugned judgment and decree<br \/>\npassed in Regular Civil Suit No.74\/1990 dated 31\/12\/1994 by the<br \/>\nlearned Trial Judge is required to be set aside.  Hence, I decide<br \/>\npoints No.1 and 2 in the affirmative and as such I pass the following<br \/>\norder.\u00fd\u00fd<\/p>\n<p>\t\t\t\/<br \/>\n\/  ORDER \\ \\<\/p>\n<p>\tPresent<br \/>\n\tappeal is hereby allowed with costs.\n<\/p>\n<p>\tImpugned<br \/>\n\tJudgment and Decree passed by the Learned Civil Judge, Senior<br \/>\n\tDivision, Gondal in Regular Civil Suit No.74\/1990 on dated<br \/>\n\t31\/12\/1994 is hereby quashed and set aside.\n<\/p>\n<p>\tRespondent-Original<br \/>\n\tplaintiff to pay costs of this appeal as well as the suit to the<br \/>\n\trespondents \u00fd  Original defendants and shall bear his own costs.\n<\/p>\n<p>\tRecord<br \/>\n\tand proceedings of Regular Civil Suit No.74\/1990 be immediately sent<br \/>\n\tto the Trial Court with one copy of this judgment.\n<\/p>\n<p>\tDecree<br \/>\n\tto be drawn accordingly.\u00fd\u00fd <\/p>\n<p>4.\tAccordingly,<br \/>\nappellate Court allowed the appeal by the impugned judgment. Being<br \/>\naggrieved by it, appellant has filed this appeal.\n<\/p>\n<p>5.\tI<br \/>\nhave considered the submissions made on behalf of the appellant and<br \/>\nalso gone through the judgment of the appellate Court and other<br \/>\nrelevant documents.  I am in complete agreement with the reasonings<br \/>\ngiven and view taken by the by the appellate Court.  No substantial<br \/>\nquestion of law has arisen in this appeal.
