Heard learned<br \/>\nadvocate Ms.K.D. Parmar for the applicant.\n<\/p>\n<p>3.\tThe<br \/>\napplicant- appellant- original accused has been convicted for the<br \/>\noffences punishable under sections 302, 323, 324 and 325 of the<br \/>\nIndian Penal Code to suffer imprisonment for life with fine of<br \/>\nRs.10,000\/-, in default to further undergo imprisonment for 2 years<br \/>\nas awarded vide judgement dated 5th October 2007 by the<br \/>\nlearned    Additional Sessions Judge, Fast Track Court, Junagadh in<br \/>\nSessions Case No.85 of 2003.\n<\/p>\n<p>4.\tThe learned<br \/>\nAPP has invited attention of the Court to the Jail remarks.   The<br \/>\nlearned APP also pointed out that in the year 2009 when the convict<br \/>\nwas granted temporary bail by this Court for 15 days he absconded for<br \/>\n317 days.\n<\/p>\n<p>On perusal, it<br \/>\nis noticed that he did abscond for 317 days, but then he of his own<br \/>\nreported back and has given explanation for the said unauthorised<br \/>\nabsence (the period for which  he absconded), stating that his wife<br \/>\nwas not well and there was responsibility of the family and he was<br \/>\ntrying to arrange for education of his children.  All the above<br \/>\nconditions required his presence as financial position of the<br \/>\nconvict&#8217;s family is very weak.  Except this belated surrender of 317<br \/>\ndays there is nothing adverse noticed in the Jail remarks.\n<\/p>\n<p>5.\tThe learned<br \/>\nadvocate for the petitioner submitted that to ensure his disciplined<br \/>\nconduct amount may be prescribed higher for deposit and besides that<br \/>\nhe may also be asked to report to the nearest Police Station at<br \/>\nsuitable intervals.\n<\/p>\n<p>6.\tTaking into<br \/>\nconsideration the contents of the application, the record of the<br \/>\nconvict and the submissions made by the learned advocate for the<br \/>\napplicant, the applicant-convict is ordered to be released on<br \/>\n temporary bail for a period of 30 (thirty) days from<br \/>\nthe date of his release subject to the following conditions:\n<\/p>\n<p>\t(i)\tThe<br \/>\n\tapplicant- convict shall execute a personal bond of Rs.10,000\/-<br \/>\n\t(Rupees ten thousand only) to the satisfaction of the Jail<br \/>\n\tauthorities.\n<\/p>\n<p>\t(ii)\tThe<br \/>\n\tapplicant- convict shall report to the nearest Police Station on<br \/>\n\tevery Monday between 08.00 A.M. and 12.00 noon.\n<\/p>\n<p>\t(iii)\tThe<br \/>\n\tapplicant shall surrender himself to the Jail authorities on expiry<br \/>\n\tof the above temporary bail period.\n<\/p>\n<p>7.\tThe<br \/>\napplication is allowed. Rule is made absolute.  Direct service is<br \/>\npermitted.\n<\/p>\n<p>(RAVI<br \/>\nR.
