PRAKASH TATIA, J.\n<\/pre>\n<p>Mr. RS Choudhary, for the petitioner.\n<\/p>\n<p>      Heard learned counsel for the petitioner.<\/p>\n<p>     The petitioner is aggrieved against the order dated<\/p>\n<p>28.4.2010 (Annex.13) as well as against the order of the<\/p>\n<p>same date dated 28.4.2010 (Annex.14).\n<\/p>\n<\/p>\n<p>     According to learned counsel for the petitioner, the<\/p>\n<p>petitioner was not guilty for any of the misconduct as<\/p>\n<p>alleged in the inquiry report. It is also submitted that<\/p>\n<p>petitioner was not given an opportunity of hearing and,<\/p>\n<p>therefore, the order dated 8.4.2010 is illegal.    Learned<\/p>\n<p>counsel for the petitioner also submitted that none of the<\/p>\n<p>act of the petitioner was under consideration nor it could<\/p>\n<p>have been under consideration because of the reason that<\/p>\n<p>petitioner was only a placement agency who could have<\/p>\n<p>forwarded the name of the persons to be appointed under<\/p>\n<p>Sarva Shiksha Abhiyan (hereinafter referred to as SSA) and<\/p>\n<p>the documents are verified by the officer of the SSA and<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>thereafter, appointments were given and not only that but<\/p>\n<p>the conditions were subjected to interview before giving<\/p>\n<p>approval.\n<\/p>\n<\/p>\n<p>     I considered the submissions of learned counsel for<\/p>\n<p>the petitioner and perused the material placed on record<\/p>\n<p>including the inquiry report. There are 4 allegations against<\/p>\n<p>the petitioner and in inquiry findings have been recorded<\/p>\n<p>and prima facie it appear that there is involvement of the<\/p>\n<p>petitioner. The detail reasons have been given in the inquiry<\/p>\n<p>report.     The District Collector, Nagaur considered the<\/p>\n<p>inquiry report and, thereafter, passed the impugned order<\/p>\n<p>and black listed the petitioner.   The matter has also been<\/p>\n<p>referred to the ACD for investigation and for further action.<\/p>\n<p>Therefore, it will not be proper for this court to record any<\/p>\n<p>finding on any of the allegations levelled against the<\/p>\n<p>petitioner. The petitioner&#8217;s contention that he was only an<\/p>\n<p>agency to provide man power and was not responsible for<\/p>\n<p>giving appointment is concerned, that plea cannot help the<\/p>\n<p>petitioner because of the plain and simple reason that<\/p>\n<p>placement agency is not an agency who can pick up any<\/p>\n<p>person from road and provided to the Government so as to<\/p>\n<p>put burden upon the Government to find out the credentials<\/p>\n<p>of the persons and the agency may take away the<\/p>\n<p>commission for providing manpower.\n<\/p>\n<p><span class=\"hidden_text\">                                          3<\/span><\/p>\n<p>                 Therefore, there is no illegality in the orders impugned<\/p>\n<p>            and the writ petition of the petitioner having no merit is<\/p>\n<p>            hereby dismissed.\n<\/p>\n<p>                                                 [PRAKASH TATIA],J.\n<\/p>\n<p>cpgoyal\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Ex Serviceman Kalyan Bahu-Udhe. &#8230; vs State Of Raj. &amp; Ors on 5 May, 2010 1 S.B.
