SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/05\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tPresent<br \/>\nJudges Summons has been taken out by the applicant   Ashok<br \/>\nGyanchand Jodhani -Ex-Workmen of Company in liquidation i.e. The<br \/>\nNanaram Shobhraj Mills Limited directing the Official Liquidator to<br \/>\nverify the claim of the petitioner and to pay the amount of legal<br \/>\ndues to the petitioner as per the orders passed by the Labour Court<br \/>\nas well as Industrial Court, Ahmedabad.\n<\/p>\n<p>2.\t\tIt<br \/>\nis the case on behalf of the applicant that against termination of<br \/>\nthe applicant by the respondent Company, applicant approached Labour<br \/>\nCourt by way of T.Application No.61 of 1986 challenging the order of<br \/>\ntermination and Labour Court, Ahmedabad by judgment and order dated<br \/>\n10.10.1993 allowed the said T.Application by directing Company to<br \/>\nreinstate the petitioner with 50% backwages.  It is submitted that<br \/>\nagainst the judgment and award passed by the Labour Court, Ahmedabad<br \/>\ndated 10.10.1993, respondent Company preferred Appeal (IC) No.131 of<br \/>\n1993 and it is submitted that even Workmen also preferred appeal<br \/>\nbefore the Industrial Tribunal by way of Appeal (IC) No.117 of 1993.<br \/>\nIndustrial Tribunal vide judgment and order dated 30.12.1986<br \/>\ndismissed the appeal preferred by the Company and partly allowed the<br \/>\nappeal preferred by the petitioner   Workmen by directing to pay<br \/>\n100% backwages from 21.12.1985 and ordering reinstatement of the<br \/>\npetitioner. It is the case on behalf of the petitioner that<br \/>\nthereafter after obtaining permission from the Company Court as<br \/>\nrequired under section 466 of the Companies Act, petitioner preferred<br \/>\nRecovery Application No.394 of 1997 to recover amount under the<br \/>\njudgment and award passed by the Labour Court further modified by the<br \/>\nIndustrial Tribunal. It is the case on behalf of the applicant that<br \/>\nPresiding Officer, Labour Court, Ahmedabad vide judgment and order<br \/>\ndated 12.02.2009 has allowed the said Recovery Application and<br \/>\ndirected Official Liquidator of the Company in liquidation to pay<br \/>\nRs.1,99,012\/- to the applicant (Rs.1,98,512\/- towards backwages from<br \/>\n21.12.1985 to September, 1994 along with cost and Rs.500 towards cost<br \/>\nof the recovery application).  Therefore, it is requested to pass an<br \/>\nappropriate order directing Official Liquidator of the Company in<br \/>\nliquidation to pay the said amount.\n<\/p>\n<p>3.\t\tIt<br \/>\nis submitted by Mr.Songara, learned Advocate for the applicant that<br \/>\nsubsequently the applicant has already submitted statement of claim<br \/>\nalong with proof of debt to the Official Liquidator, still said<br \/>\namount has not been paid, therefore, applicant has preferred present<br \/>\napplication.\n<\/p>\n<p>4.\t\tHaving<br \/>\nserved with the notice of this application, Official Liquidator of<br \/>\nthe Company in liquidation has submitted report dated 03.05.2010.  It<br \/>\nis submitted that claim of the applicant has been verified by<br \/>\nOfficial Liquidator through M\/s.K.V.Mehta and Co., Chartered<br \/>\nAccountant and as per the report submitted by the Chartered<br \/>\nAccountant, applicant is entitled to a sum of Rs.1,50,299\/-, out of<br \/>\nwhich Rs.56849\/- has been paid to the applicant. It is further<br \/>\nsubmitted that further sum of Rs.5490\/- has been paid by IDBI<br \/>\ndirectly to the applicant. Therefore, it is submitted that now<br \/>\nRs.87890\/- is due and payable to the petitioner which shall be paid<br \/>\nto the applicant at par with the workmen of the Company in<br \/>\nliquidation as and when said amount is paid to the workmen of the<br \/>\nCompany in liquidation.\n<\/p>\n<p>5.\t\tMr.Songara,<br \/>\nlearned Advocate for the applicant has disputed the amount held to be<br \/>\nadmissible and due and payable to the applicant at Rs.1,50,299\/-.  It<br \/>\nis submitted that as such applicant is entitled to Rs.3,49,241\/-<br \/>\ninclusive of amount of gratuity; amount of retrenchment compensation;<br \/>\namount of leave salary; amount of closure and amount of backwages as<br \/>\nper the order dated 12.02.2009 passed by the Labour Court in Recovery<br \/>\nApplication No.394 of 1997.  It is submitted that Chartered<br \/>\nAccountant and\/or Official Liquidator cannot ignore and\/or go beyond<br \/>\njudgment and order passed by the Labour Court in reference and\/or in<br \/>\nrecovery application.  Therefore, it is submitted that an amount of<br \/>\nRs.62,339\/- is paid to the applicant and therefore, applicant is<br \/>\nentitled to Rs.2,86,902\/- and it is requested to direct Official<br \/>\nLiquidator to paid said amount.\n<\/p>\n<p>6.\t\tMr.Yadav,<br \/>\nlearned Advocate appearing for the Official Liquidator has fairly<br \/>\nconceded that as such Official Liquidator and\/or Chartered Accountant<br \/>\ncannot go beyond the judgment and order passed by the Labour Court<br \/>\nand\/or Industrial Court and \/or any other Court. Once order is passed<br \/>\nby the Competent Court, it attains finality. Official Liquidator is<br \/>\nrequired to consider the same while considering claim made by the<br \/>\nworkmen and\/or any other person.  As stated above, Labour Court,<br \/>\nAhmedabad in Recovery Application No.394 of 1997 has passed an order<br \/>\ndirecting Official Liquidator to pay sum of Rs.1,99,012\/- by way of<br \/>\nbackwages.  Therefore, alongwith other claims like, gratuity,<br \/>\nretrenchment compensation, leave salary, amount of closure, applicant<br \/>\nis entitled to sum of Rs.1,99,012\/- also by way of backwages for the<br \/>\nperiod between   21.12.1985 to September, 1994. Therefore, amount of<br \/>\nRs.1,50,229\/- determined by the Official Liquidator due and payable<br \/>\nto the applicant cannot be accepted. It is held that applicant is<br \/>\nentitled to sum of Rs.3,49,241\/-  out of which applicant has been<br \/>\npaid an amount of Rs.62,339\/-.  Therefore, applicant is entitled for<br \/>\nan amount of Rs.2,86,902\/- which the Official Liquidator is directed<br \/>\nto pay the same to the applicant at par with other workmen as and<br \/>\nwhen any amount is paid to the workmen of the Company in liquidation.\n<\/p>\n<p>7.\t\tBefore<br \/>\nparting with the present order, it is to be noted that from the<br \/>\njudgment and order passed by the Labour Court, Ahmedabad  in Recovery<br \/>\nApplication No.394 of 1997, it appears that though served nobody<br \/>\nappeared on behalf of the Official Liquidator of the Company in<br \/>\nliquidation and Recovery Application proceeded ex-parte. This Court<br \/>\nhas come across so many matters in which Official Liquidator though<br \/>\nserved, has not appeared and matters have proceeded further ex-parte<br \/>\nand ex-parte orders are  passed and matters are not defended at all.<br \/>\nUnder the circumstances, Official Liquidator is hereby directed to<br \/>\nhold inquiry against erring Officers inclusive of Official Liquidator<br \/>\nand submit report before this Court informing who is responsible for<br \/>\nnot appearing before the Labour Court, Ahmedabad in Recovery<br \/>\nApplications. Aforesaid exercise be completed within a period of<br \/>\n8(eight) weeks from today and necessary report be submitted before<br \/>\nthis Court in the present proceedings.
