Justice M.C.HARI RANI\n\n Dated :22\/11\/2010\n\n O R D E R\n               K.M.JOSEPH &amp; M.C.HARI RANI, JJ.\n         ------------------------------------------------------\n                   W.P.(C) No.34488 of 2010-I\n             ----------------------------------------------\n          Dated, this the 22nd day of November, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>K.M.Joseph, J.\n<\/p>\n<p>                Petitioner has approached this Court seeking the<\/p>\n<p>following reliefs:\n<\/p>\n<blockquote><p>    &#8220;i) to issue a writ of mandamus or any other appropriate<\/p>\n<p>    writ or order or direction commanding the 6th respondent to<\/p>\n<p>    afford adequate and effective police protection to the life<\/p>\n<p>    and property of the petitioner.\n<\/p><\/blockquote>\n<blockquote><p>    ii) to issue a writ of mandamus or any other appropriate writ<\/p>\n<p>    or order     or direction commanding the 6th respondent to<\/p>\n<p>    proceed against respondents 1 to 5 in accordance with law<\/p>\n<p>    who committed criminal trespass and committed waste into<\/p>\n<p>    the property of the petitioner and threatened the petitioner<\/p>\n<p>    and members of his family endangering their life.&#8221;<\/p>\n<\/blockquote>\n<blockquote><p>              2.   Briefly put, the case of the petitioner is as<\/p>\n<p>follows: Petitioner is a retired government employee. He was<\/p>\n<p>granted Ext.P2 pattayam for 45 cents vide Ext.P1 proceedings<\/p>\n<p>of the Land Tribunal,Cherthala. Petitioner gifted 11.25 cents<\/p>\n<p>to the Thiruvenkidapura Sri.Krishnaswamy Kshetra Bhajna<\/p>\n<p>Samithy. It is stated that two years after the pattayam, one<\/p>\n<p><span class=\"hidden_text\">WPC 34488\/2010                   -2-<\/span><\/p>\n<p>Purushothaman Namboodiri        claiming to be legal heir of<\/p>\n<p>original owner filed appeal. The appeal was allowed and the<\/p>\n<p>matter was remanded. Petitioner had approached this Court<\/p>\n<p>by filing writ petition. This court vide Exts.P3 and P4 orders<\/p>\n<p>stayed the operation of the order of the appellate authority.<\/p>\n<\/blockquote>\n<p>While so, respondents 1 and 5 claiming        to be the office<\/p>\n<p>bearers    of  Thiruvenkidapura     Sri.Krishnaswamy    Temple<\/p>\n<p>Committee trespassed into the property of the petitioner and<\/p>\n<p>cut the trees and threatened the petitioner and members of<\/p>\n<p>his family with dire     consequences by stating that the entire<\/p>\n<p>property belong to the temple.\n<\/p>\n<p>            3.     We heard the learned counsel for the<\/p>\n<p>petitioner. We are of the view that this may not be an<\/p>\n<p>appropriate case for this Court to entertain the writ petition<\/p>\n<p>under Article 226 and to direct protection to be granted. We<\/p>\n<p>feel that petitioner has got      alternate remedy by taking<\/p>\n<p>appropriate steps before the competent Civil Court against the<\/p>\n<p>party respondents.     We also take notice of the pendency of<\/p>\n<p>proceedings which we have referred to.         Accordingly, we<\/p>\n<p>relegate the petitioner to approach the competent Civil Court<\/p>\n<p><span class=\"hidden_text\"> WPC 34488\/2010                -3-<\/span><\/p>\n<p>in the matter.
