DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 5\/08\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1\tChallenge<br \/>\nin this appeal is to the order dated 19th<br \/>\nJuly 2010 passed by the learned City Civil Court, Ahmedabad, by which<br \/>\nnotice of motion Exh.6\/7 in Civil Suit No.1190 of 2010 filed by the<br \/>\nappellant [original plaintiff] came to be rejected.\n<\/p>\n<p>2\tIt<br \/>\nis the case of the plaintiff that a suit was filed for a declaration<br \/>\nthat he had 50% share in the suit land and the defendants would not<br \/>\ncarry out any construction thereon nor shall transfer, assign or<br \/>\nchange situation. The case of the plaintiff is that the suit property<br \/>\nand other properties were purchased by the defendants and others by<br \/>\nregistered sale deed in the year 2004 and the plaintiff paid Rs.10<br \/>\nlakhs in view of the good relation with the defendants. Later on, the<br \/>\ndefendants had signed agreement dated 7.1.2010 in which the above<br \/>\nfact of payment of Rs.10 lakhs was admitted. In the context of the<br \/>\nabove facts, the learned counsel for the appellant has argued that<br \/>\nthe admission of the defendants itself is sufficient to grant interim<br \/>\ninjunction and another co-owner had also filed an affidavit about<br \/>\npayment of Rs.10 lakhs. In view of the above, it is stated that the<br \/>\ninterim injunction ought to have been granted by the trial court. It<br \/>\nis further submitted that the defendants had not raised any dispute<br \/>\nabout the agreement in question and, considering the above,<br \/>\nprima-facie case, balance of convenience and irreparable loss is in<br \/>\nfavour of the appellant-plaintiff and the trial court has erred in<br \/>\nrefusing the injunction.\n<\/p>\n<p>3.\tHeard<br \/>\nthe learned advocate for the  appellant and perused the record.\n<\/p>\n<p>4\tPerusal<br \/>\nof the impugned order reveals that no documentary evidence was<br \/>\nproduced about payment of Rs.10 lakhs by the appellant to the<br \/>\ndefendants in the year 2004. Besides, the registered sale deed of<br \/>\n2004 had a recital of consideration of Rs.2,10,000\/- only. Even the<br \/>\nownership and possessory documents were also in favour of the<br \/>\ndefendants. Till the notice of motion was decided, the plaintiff had<br \/>\nnot produced the original partnership deed which was entered into<br \/>\nbetween the parties.\n<\/p>\n<p>5\tThe<br \/>\nabove reasoning and finding of the trial court to deny interim<br \/>\ninjunction in favour of the plaintiff cannot be said to be in any<br \/>\nmanner illegal, perverse or contrary to law, which deserves any<br \/>\ninterference.\n<\/p>\n<p>6\tThis<br \/>\nappeal is rejected summarily.
