This Court had disposed of Criminal Writ Petition<\/p>\n<p>     No. 407 of 2009 on 9th December, 2009. By order passed today,<\/p>\n<p>     we     have    recalled   said    judgment,          and     taken      up     present<\/p>\n<p>     Criminal Writ Petition for hearing and disposal according to<\/p>\n<p>     law.\n<\/p>\n<p>     2.            Learned Adv., for the petitioner has argued that<\/p>\n<p>     the petitioner was a juvenile on the date of occurrence of<\/p>\n<p>     crime, and by virtue of Section 7-A of the Juvenile Justice<\/p>\n<p>     (Care and Protection of Children) Act, 2000, he needs a<\/p>\n<p>     differential      treatment      even    after   the        conviction         attains<\/p>\n<p>     finality.\n<\/p>\n<p>     3.            In support of his submissions, learned Adv., for<\/p>\n<p>     the petitioner has placed reliance on following Judgments:-\n<\/p>\n<p>     [I]           Dharambir Vs. State of [NCT of Delhi] &amp; another<br \/>\n                   [(2010 5 SCC 344],<br \/>\n     [II]          Ganesh Ramjivan Kaithwas Vs. State of Mah. &amp;<br \/>\n                   another [Criminal     Writ Petition No. 31\/2010,<br \/>\n                   decided on 28th July, 2010] [Coram A.P. Lavande<br \/>\n                   &amp; P.D. Kode, JJ.], and<\/p>\n<p><span class=\"hidden_text\">                                                          ::: Downloaded on &#8211; 09\/06\/2013 16:39:03 :::<\/span><br \/>\n<span class=\"hidden_text\">                                               3<\/span><\/p>\n<p>     [III]      Sunil Laxman Jawade Vs. State of Mah. &amp; another<br \/>\n                [Criminal       Writ     Petition        No.     509      of    2010,<br \/>\n                decided on 25th November, 2010], [Coram : A.H.<br \/>\n                Joshi &amp; A.R. Joshi, JJ.].\n<\/p>\n<p>     4.         We are satisfied that in view of Section 7-A of the<\/p>\n<p>     Juvenile   Justice        (Care    and    Protection        of     Children)       Act,<\/p>\n<p>     2000, that it shall be open to the Court, who has passed the<\/p>\n<p>     order of conviction and sentence, if an application is made<\/p>\n<p>     by the convict, to decide the age based on the correct date<\/p>\n<p>     of   birth,    and       record    a     finding      whether        the     convict-\n<\/p>\n<p>     petitioner     was   a    juvenile       on   the    date     of    commission         of<\/p>\n<p>     offence.      If the finding is in favour of the claim of the<\/p>\n<p>     convict-petitioner,          the       Court        will      be      within         its<\/p>\n<p>     jurisdiction to pass orders in accordance with law.\n<\/p>\n<p>     5.         We need to record that learned APP does not dispute<\/p>\n<p>     the legal position that the jurisdiction under Section 7-A<\/p>\n<p>     of the Juvenile Justice (Care and Protection of Children)<\/p>\n<p>     Act, 2000, applies equally to the Court passing the order of<\/p>\n<p>     conviction.\n<\/p>\n<p>     6.         In view of foregoing discussion, petitioner should<\/p>\n<p>     better file an application within fifteen days from today<\/p>\n<p><span class=\"hidden_text\">                                                          ::: Downloaded on &#8211; 09\/06\/2013 16:39:03 :::<\/span><br \/>\n<span class=\"hidden_text\">                                             4<\/span><br \/>\n     before the Sessions Court concerned who has passed the order<\/p>\n<p>     of conviction and sentence.            The Sessions Judge, to whom the<\/p>\n<p>     enquiry be allotted, shall have to decide the application<\/p>\n<p>     when filed in accordance with Section 7-A of the Juvenile<\/p>\n<p>     Justice (Care and Protection of Children) Act, 2000.\n<\/p>\n<p>     7.         Learned Adv., for the petitioner states that the<\/p>\n<p>     application shall        be filed      in the           Sessions    Court      within<\/p>\n<p>     fifteen days from today.\n<\/p>\n<p>     8.         We<\/p>\n<p>                     direct    learned          APP     to    communicate         to     the<\/p>\n<p>     District    Govt.    Pleader     to    appear       in    the    matter       on    20th<\/p>\n<p>     December,    2010,       for    taking      further       steps,      if    copy      of<\/p>\n<p>     application,    which     may    be        filed    by     the     applicant,         is<\/p>\n<p>     delivered to learned District Govt. Pleader.\n<\/p>\n<p>     9.         We hope and expect that the question of age of the<\/p>\n<p>     applicant, i.e., he being a juvenile as per the provisions<\/p>\n<p>     of the Juvenile Justice (Care and Protection of Children)<\/p>\n<p>     Act,   2000,     be    decided        by    Sessions       Court,      as     far     as<\/p>\n<p>     possible, within ninety days from the date of appearance.\n<\/p>\n<p>     10.
