In the appointment letter, it was<br \/>\nclarified that the engagement of the respondent-workman as a<br \/>\ntemporary Forklift Operator is purely on temporary and ad-hod basis<br \/>\nand shall be terminated by the management at any time without notice.\n<\/p>\n<p>4)\tIt<br \/>\nappears that the Company terminated the services of the<br \/>\nrespondent-workman on 24th December 1992.  This gave rise<br \/>\nto the Industrial Dispute and the Reference.\n<\/p>\n<p>5)\tThis<br \/>\nmatter was heard substantially on 30th September 2011 and<br \/>\nwas adjourned for today as it appeared that the dispute could be<br \/>\nresolved amicably on certain terms and conditions.  Today when the<br \/>\nmatter is taken up for hearing, learned advocate Mr.Patel, appearing<br \/>\nfor the petitioner-Company submits that the Company is ready and<br \/>\nwilling to pay a sum of Rs.50,000\/- to the respondent-workman towards<br \/>\nfull and final settlement, by way of compensation provided the<br \/>\nrespondent-workman gives up his claim of being reinstated as per the<br \/>\naward passed by the Labour Court.\n<\/p>\n<p>6)\tRespondent-workman<br \/>\nis present today in the Court.  He has been made to explain about the<br \/>\nproposal of the petitioner-Company, to which the respondent-workman<br \/>\nhas agreed.\n<\/p>\n<p>7)\tIn<br \/>\nlight of this consensus arrived at between the parties, further<br \/>\nadjudication of the petition on merits is not necessary.  The award<br \/>\npassed by the Labour Court is hereby quashed and set aside.<br \/>\nPetitioner-Company is directed to pay to the respondent-workman a sum<br \/>\nof Rs.50,000\/- by way of a demand draft within a period of 10 days<br \/>\nfrom today. The respondent-workman shall provide his current<br \/>\nresidential address to the learned advocate Mr.Patel appearing for<br \/>\nthe petitioner-Company so that the petitioner-Company can intimate<br \/>\nthe respondent-workman to come and collect the demand draft on a<br \/>\nparticular date.\n<\/p>\n<p>\tWith<br \/>\nthese directions, the petition stands disposed of with no order as to<br \/>\ncosts.
