On 4.2.2010, the<\/p>\n<p>  latter was filed seeking the issuance of a writ of habeas corpus<\/p>\n<p>  in relation to one Mr.Hassan Haji who is around 80 years of<\/p>\n<p>  age.\n<\/p>\n<\/p>\n<p>2.W.P(C).3237\/10, seeking a direction for police protection, was<\/p>\n<p>  filed by Khadeeja, one of the daughters of Hassan Haji. She is<\/p>\n<p>  the 4th respondent in W.P(Crl).56\/10, filed seeking issuance of<\/p>\n<p>  a writ of habeas corpus.\n<\/p>\n<p>WPC.3237\/10 &amp; WPCr.56\/10<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>3.Pending these matters, this Court issued a Commission to visit<\/p>\n<p>  the alleged detenue to ascertain as to whether he is in illegal<\/p>\n<p>  detention.       Such Commission was issued based on the<\/p>\n<p>  submissions on both sides that Mr.Hassan Haji      is frail in<\/p>\n<p>  health     having     regard to his  advanced   age.       The<\/p>\n<p>  Commissioner&#8217;s report is on record.       That evidences the<\/p>\n<p>  unfortunate plight of a person who is essentially bed ridden,<\/p>\n<p>  having hearing impairment and feeble and also under<\/p>\n<p>  emotional pressure from the manner in which his wives and<\/p>\n<p>  children are conducting themselves.\n<\/p>\n<\/p>\n<p>4.It appears that Mr.Hassan Haji has three wives living.<\/p>\n<p>  Khadeeja, the petitioner in W.P(C).3237\/10 is his daughter<\/p>\n<p>  through his eldest wife, with whom, he is now found to be<\/p>\n<p>  residing. Before the Commissioner, Hassan Haji appears to<\/p>\n<p>  have stated, quite feebly, certain things. But what came up<\/p>\n<p>  with sufficient amount of sorrow from him is recorded in<\/p>\n<p>  paragraph 3(b) of the Commissioner&#8217;s report.<\/p>\n<p>WPC.3237\/10 &amp; WPCr.56\/10<\/p>\n<p><span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>          &#8220;The detenue only said that he did not want to<\/p>\n<p>          move out of the house and did no wish to go to<\/p>\n<p>          any other house. Possibly, he was saying this on<\/p>\n<p>          account of the fact that he is bedridden.       He<\/p>\n<p>          expressed his desire that all his children should<\/p>\n<p>          visit him at least once in two days.       He also<\/p>\n<p>          expressed concern for his male children and<\/p>\n<p>          wanted them by his side often. When I put to the<\/p>\n<p>          4th respondent, she said that her make siblings<\/p>\n<p>          were not welcome to the house as the same<\/p>\n<p>          belonged to her husband and she feared that her<\/p>\n<p>          husband&#8217;s people may not take kindly to the visit<\/p>\n<p>          of her brothers.     She also said that they talked<\/p>\n<p>          loudly and were thus a nuisance to others<\/p>\n<p>          especially the other female members in the<\/p>\n<p>          household.     Petitioners 3 to 6 said that they<\/p>\n<p>          talked loudly only on account of the hearing<\/p>\n<p>          problem of their father (detenue).&#8221;\n<\/p>\n<\/p>\n<p>5.It is unfortunate that Mr.Hassan Haji, who is stated to have<\/p>\n<p>  toiled abroad to bring up his family, is in such a sad plight. We<\/p>\n<p>  hope that the wives and children will try to look inward unto<\/p>\n<p>  themselves searching for answers as to whether this is the<\/p>\n<p>  manner in which an elderly human being has to be treated.<\/p>\n<p>WPC.3237\/10 &amp; WPCr.56\/10<\/p>\n<p><span class=\"hidden_text\">                                 4<\/span><\/p>\n<p>  We are quite sure that the tenets of Islam is nothing but full of<\/p>\n<p>  love and compassion and no religious book or any sasthra for<\/p>\n<p>  that matter, would stand to advise any person against<\/p>\n<p>  practising basic human values of love and compassion. The<\/p>\n<p>  children of Hassan Haji should remember that what every<\/p>\n<p>  person would get from his successors would be what he gives<\/p>\n<p>  to his parents. The wives of Hassan Haji have necessarily to<\/p>\n<p>  play their role of appropriate motherhood to persuade and<\/p>\n<p>  keep the children of Hassan Haji through all of them as<\/p>\n<p>  siblings living in love and mutual respect.<\/p>\n<p>6.We do not find any ground to issue any direction for police<\/p>\n<p>  protection. The presence of police in the situation should be<\/p>\n<p>  the last thing. We are, however, clear that the little bickerings<\/p>\n<p>  between Khadeeja, the 4th respondent in W.P(Crl).56\/10 and<\/p>\n<p>  her siblings as also her husband should be given an end to.<\/p>\n<p>  Peace and love has to prevail to let Mr.Hassan Haji have his<\/p>\n<p>  long innings drawn to a close at some point of time when it<\/p>\n<p>WPC.3237\/10 &amp; WPCr.56\/10<\/p>\n<p><span class=\"hidden_text\">                                 5<\/span><\/p>\n<p>  may visit him, in peace and tranquility, having the feeling that<\/p>\n<p>  his wife and children love him and are with him.<\/p>\n<p>7.With the aforesaid, we hereby direct that the children of<\/p>\n<p>  Hassan Haji will have the opportunity to visit him at least once<\/p>\n<p>  in a week and if his health situation demands, more frequently,<\/p>\n<p>  in his present place of residence, i.e., the home (shall call it<\/p>\n<p>  merely a house?) of Khadeeja, the 4th respondent in W.P(Crl).<\/p>\n<p>  56\/10. The said daughter and her husband, as also the siblings<\/p>\n<p>  of Khadeeja will make the situation conducive even if they may<\/p>\n<p>  have any disputes among themselves on some materialistic<\/p>\n<p>  matters. It is further ordered that if any of the parties have<\/p>\n<p>  any difficulty in working out this order or if any of the parties<\/p>\n<p>  are of the view that any further indulgence from any person<\/p>\n<p>  outside the family is required, they will be at liberty to move<\/p>\n<p>  the Chairperson of the District Legal Services authority,<\/p>\n<p>  Malappuram who will do the needful even by making over the<\/p>\n<p>  matter to the appropriate Taluk Legal Service Authority for<\/p>\n<p>WPC.3237\/10 &amp; WPCr.56\/10<\/p>\n<p><span class=\"hidden_text\">                              6<\/span><\/p>\n<p> soothing intervention, having the affairs of Mr.Hassan Haji as<\/p>\n<p> the prime concern.
