Justice ANTONY DOMINIC\n\n Dated :20\/02\/2008\n\n O R D E R\n                                ANTONY DOMINIC, J.\n\n                 ------------------------------------\n\n                              W.P.(C) 5962  of  2008\n\n                -------------------------------------\n\n                            Dated: February 20, 2008\n\n\n\n                                      JUDGMENT\n<\/pre>\n<p>       Exts.P5(1)   and     P5(2)   are   the   proceedings   under   challenge.\n<\/p>\n<p>According   to   the   learned   Government   Pleader,   these   proceedings<\/p>\n<p>have been issued under the Kerala Land Conservancy Act.  By these<\/p>\n<p>the   petitioner   has   been   asked   to   vacate   from   the   premises   within<\/p>\n<p>three   days   of   receipt   of   the   notice.     It   is   challenging   this,   mainly<\/p>\n<p>relying on the judgment of the civil court, that this writ petition has<\/p>\n<p>been filed.\n<\/p>\n<p>       2.   In   my   view,     since   the   proceedings   impugned   are   issued<\/p>\n<p>under the Kerala Land Conservancy Act, the petitioner has a right of<\/p>\n<p>appeal in terms of sec.17 thereof.   Therefore, it is for the petitioner<\/p>\n<p>to pursue the appellate remedy so available.\n<\/p>\n<p>       3.       In order to enable the petitioner to avail of the appellate<\/p>\n<p>remedy   under sec.17, I direct that further proceedings pursuant to<\/p>\n<p>Exts.P5(1)   and   P5(2)   will   be   deferred   for   a   period   of   three   weeks<\/p>\n<p>from   today.     In   the   meantime,   it   will   be   open   to   the   petitioner   to<\/p>\n<p>pursue   the   appellate   remedy   and   seek   interlocutory   orders<\/p>\n<p>WP(C) 5962\/08<\/p>\n<p>                                    Page numbers<\/p>\n<p>safeguarding its interests.\n<\/p>\n<p>        4.     Petitioner   also   prays   that   though     proceedings   No.VI-2-\n<\/p>\n<p>31242\/06   were   initiated   against   them,   they   have   not   been   issued<\/p>\n<p>any  order  in   those   proceedings.
