Wazirganj(Tankuppa),<br \/>\nDistrict Gaya<br \/>\n                                                                           &#8230;&#8230;Petitioners<\/p>\n<p>                                             Versus<\/p>\n<p>THE STATE OF BIHAR<br \/>\n                                                                           &#8230;&#8230;.Opposite Party<\/p>\n<p>                      For the Petitioners : Mr. Sanjay Kumar Jha, Advocate<br \/>\n                      For the O.P.-informant: Mr. Vinod Kumar, Advocate<\/p>\n<p> 03.     24.08.2010               Heard learned counsel for the two petitioners and Additional<\/p>\n<p>                        Public Prosecutor for the State, who is armed with the case diary.<\/p>\n<p>                                  The petitioners are named accused in this case carry<\/p>\n<p>                        allegation of arriving at the shop of the informant along with non-<\/p>\n<p>                        petitioner Arjun Singh well armed and petitioner no. 1 Parvendar<\/p>\n<p>                        Singh at pistol point over powered informant and his brother-in-law<\/p>\n<p>                        and petitioner no. 2 took brother of the informant at pistol point.<\/p>\n<p>                        Their associate started tying Sanjay Yadav, all the three were dragged<\/p>\n<p>                        out of the shop. Then at the dictates of non-petitioner Arjun Singh,<\/p>\n<p>                        petitioner no. 2 shot at deceased Sanjay Yadav and petitioner no. 1<\/p>\n<p>                        unsuccessfully shot at the informant, who anyhow arrived at the house<\/p>\n<p>                        and informed the family members and on return found his brother<\/p>\n<p>                        Sanjay Singh dead.     No doubt, police after investigation submitted<\/p>\n<p>                        final form, reporting the case true, but involvement of the named<\/p>\n<p>                        accused persons not supported from the evidence. However, court<\/p>\n<p>                        below on perusal of case diary took cognizance for the offences, there<br \/>\n<span class=\"hidden_text\">                                 -2-<\/span><\/p>\n<p>          are re-statement of informant and his brother-in-law as eye-witnesses.<\/p>\n<p>          No doubt, as pointed out by learned counsel for the petitioners that<\/p>\n<p>          brother-in-law of the informant has taken U turn and submitted one<\/p>\n<p>          application in writing before Deputy Superintendent of Police, stating<\/p>\n<p>          therein that occurrence was committed by some unknown persons, but<\/p>\n<p>          the said brother-in-law has already made statement before police<\/p>\n<p>          under Section 161 Cr.P.C. as an eye-witness, stating everything<\/p>\n<p>          against the two petitioners.\n<\/p>\n<p>                    Considering the facts and circumstances of the case, their<\/p>\n<p>          prayer for anticipatory bail, in connection with Wazirganj (Tankuppa)<\/p>\n<p>          P.S.
