In this case, Notice was issued by this Court on<br \/>\n6th December 2010, returnable on 27th December<br \/>\n2010.  Mr. JB Babaria, Director, ICDS is present before the Court.<br \/>\nOn perusal of the papers, he states that the said Notice was received<br \/>\nby the office on 9th December 2010 and one Ms. Anilaben<br \/>\nShah, State Programme Officer, was asked to attend the Court.\n<\/p>\n<p>2.1\tThe<br \/>\nDirector seeks time to inquire into the matter and collect further<br \/>\ndetails.\n<\/p>\n<p>3.0\tOn<br \/>\n27th December 2010, the matter was adjourned to<br \/>\n17th<br \/>\nJanuary 2011.  On that day, fresh Notice was issued by this Court,<br \/>\nreturnable on 27th January 2011.  Said Shri Babaria,<br \/>\nDirector, ICDS states, on perusal of the papers, that this Notice was<br \/>\nserved to the office on 21st January 2011.  This time, one<br \/>\nMr. Kakkad, Administrative Officer, was asked to attend the Court.\n<\/p>\n<p>3.1\tThe<br \/>\nDirector wants time to inquire into the matter and collect details as<br \/>\nto why Mr. Kakkad did not remain present before this Court on 27th<br \/>\nJanuary 2011, therefore, the Court was required to direct the<br \/>\nrespondent no. 2 &#8211; Commissioner, Women and Child Development,<br \/>\nGovernment of Gujarat, to remain personally present before this Court<br \/>\ntoday i.e. 2nd February 2011.\n<\/p>\n<p>4.0\tIn<br \/>\nthe first half, the matter was called out.  Two officers from the<br \/>\noffice of the Commissioner, Women and Child Development, were present\n<\/p>\n<p>&#8211; one Mr. Prakash Bhagat, Administrative Officer and other Mr.<br \/>\nNK Parmar, Senior Assistant, who pleaded ignorance about the nature<br \/>\nof engagement, which did not allow the Commissioner to attend the<br \/>\nCourt.  They were granted time to call a responsible officer to be<br \/>\npresent before the Court, preferably, the Commissioner.\n<\/p>\n<p>4.1\tIn<br \/>\nthe second half, Mr. JB Babaria, Director, ICDS, remained present.<br \/>\nHe prayed for time stating that, as the Commissioner is preoccupied<br \/>\nin &#8216;Chintan Shibir&#8217;, which has to take place in the presence of the<br \/>\nHonourable Chief Minister.  He<br \/>\nrequests that the matter be kept on some other day, after 6th<br \/>\nFebruary 2011, as the &#8216;Chintan Shibir&#8217; will be from 3\/2\/2011 to<br \/>\n6\/2\/2011.\n<\/p>\n<p>5.0\tThe<br \/>\nmatter is adjourned to 10th<br \/>\nFebruary 2011.\n<\/p>\n<p>5.1\tAs<br \/>\nprayed for, the Director is granted time to report the action taken<br \/>\nagainst Ms. Anilaben Shah, State Programme Officer and Mr. Kakkad,<br \/>\nAdministrative Officer, who were required to attend the Court on 27th<br \/>\nDecember 2010 and 27th January 2011 respectively, but have<br \/>\nnot attended the Court and they have not reported the matter to the<br \/>\nresponsible officer.\n<\/p>\n<p>5.2\tIt<br \/>\nwill be in fitness of things if the report of the action taken in the<br \/>\nmatter is placed on record on the next date of hearing i.e. 10th<br \/>\nFebruary 2011.\n<\/p>\n<p>[<br \/>\nRavi R.
