Justice P.N.RAVINDRAN\n\n Dated :26\/11\/2008\n\n O R D E R\n                      P.N.RAVINDRAN, J.\n\n                   -------------------------------\n\n        R.P.No.1176 of 2008 in W.P.(C) No.22504 of 2008\n\n                   -------------------------------\n\n               Dated this the 26th November, 2008.\n\n                            O R D E R\n<\/pre>\n<p>               Heard    Smt.Anu       Sivaraman,   the      learned<\/p>\n<p>Government Pleader appearing for the review petitioner and<\/p>\n<p>Sri.Thaliyil R.Gopakumar, the learned counsel appearing for the<\/p>\n<p>respondent.\n<\/p>\n<\/p>\n<p>               2. The respondent, a person with disability, was<\/p>\n<p>appointed as Peon in the Government Homeo Dispensary,<\/p>\n<p>Pandalam, for a period of 179 days or till a regular hand joins<\/p>\n<p>duty, whichever is earlier. The term for which she was appointed<\/p>\n<p>expired on 31.7.2008.      She submitted Ext.P3 representation<\/p>\n<p>dated 17.7.2008 before the District Medical Officer (Homeo),<\/p>\n<p>Pathanamthitta, for permission to continue in service till a regular<\/p>\n<p>hand joins duty. She thereafter filed W.P.(C) No.22504 of 2008<\/p>\n<p>seeking continunace in service till a regular hand joins duty. In<\/p>\n<p>the said writ petition, the District Medical Officer (Homeo),<\/p>\n<p>Pathanamthitta, filed a statement which reads as follows:-<\/p>\n<p>RP.No. 1176 of 2008<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>             &#8220;4.   It is most respectfully submitted that the<br \/>\n       post of Peon in the Government Homeo Dispensary,<br \/>\n       Pandalam, is at present vacant and the service of a<br \/>\n       Peon is highly necessary was carried out it to the<br \/>\n       day today affairs of the hospital and its proper<br \/>\n       functioning and more than 100 patients are<br \/>\n       approached this dispensary every day and the<br \/>\n       service of a Peon is highly needed.        It is also<br \/>\n       submitted that there is no other person who has<br \/>\n       better claim as a physically handicapped person<br \/>\n       compared to the petitioner. So far this respondent<br \/>\n       has not made any appointment to the post held by<br \/>\n       the petitioner and this is submitted for kind<br \/>\n       consideration of this Hon&#8217;ble Court.&#8221;\n<\/p>\n<\/p>\n<p>                3. In the light of the stand taken by the District<\/p>\n<p>Medical Officer (Homeo), Pathanamthitta,          and    as it was<\/p>\n<p>conceded that the service of a Peon is highly necessary for the<\/p>\n<p>day today functioning of the hospital, I disposed of the writ<\/p>\n<p>petition with a direction to the review petitioners to reinstate the<\/p>\n<p>petitioner in service and to permit her to continue in service till a<\/p>\n<p>regular hand joins duty. In this review petition, the respondents<\/p>\n<p>in the writ petition, seek a review of the said judgment. They<\/p>\n<p>contend that the direction to re-appoint the petitioner in service<\/p>\n<p>offends the 9th proviso to Rule 9(a)(i) of Part II of the K.S. &amp;<\/p>\n<p>RP.No. 1176 of 2008<\/p>\n<p><span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>S.S.R. and also runs counter to the Full Bench decision of this<\/p>\n<p>Court in <a href=\"\/doc\/802444\/\">Radha v. District Medical Officer<\/a> (2002 (2) KLT 711).<\/p>\n<p>                4. I have considered the submissions made at the<\/p>\n<p>Bar by the learned counsel on either side. The 9th proviso to Rule<\/p>\n<p>9(a)(i) of Part II of the K.S. &amp; S.S.R. prohibits continuance in<\/p>\n<p>service of provisional employees appointed under Rule 9(a)(i)<\/p>\n<p>beyond the term for which they were appointed. Though their re-<\/p>\n<p>employment is permitted, such re-employment can be made only<\/p>\n<p>with the prior concurrence         of the Kerala Public Service<\/p>\n<p>Commission and that too, if candidates are not available for<\/p>\n<p>appointment through the local employment exchanges. In the<\/p>\n<p>instant case, these aspects were not noticed, when by judgment<\/p>\n<p>delivered on 7.8.2008, I directed the review petitioners to<\/p>\n<p>reinstate the petitioner in service and to permit her to continue in<\/p>\n<p>service till a regular hand joins duty.   The review petitioners or<\/p>\n<p>the writ petitioner    did not bring to my notice the statutory<\/p>\n<p>provisions contained in the 9th proviso to Rule 9(a)(i) of Part II<\/p>\n<p>of the K.S. &amp; S.S.R. or the Full Bench decision of this Court in<\/p>\n<p>RP.No. 1176 of 2008<\/p>\n<p><span class=\"hidden_text\">                                4<\/span><\/p>\n<p><a href=\"\/doc\/802444\/\">Radha v. District Medical Officer<\/a> (supra), at the time when W.P.<\/p>\n<p>(C) No.22504 of 2008 was heard and disposed of.              The<\/p>\n<p>directions issued in W.P.(C) No.22504 of 2008 were issued<\/p>\n<p>without noticing the fact that the 9th proviso to Rule 9(a)(i) of<\/p>\n<p>Part II of the K.S. &amp; S.S.R. does not permit re-employment of the<\/p>\n<p>petitioner.    There is also no material to show that the prior<\/p>\n<p>concurrence of the Kerala Public Service Commission had been<\/p>\n<p>obtained and that no one is available for appointment as Peon<\/p>\n<p>through the employment exchange. Further, the Full Bench of<\/p>\n<p>this Court has in <a href=\"\/doc\/802444\/\">Radha v. District Medical Officer<\/a> (supra) held<\/p>\n<p>that persons appointed under Rule 9(a)(i) of Part II of the<\/p>\n<p>K.S.&amp;S.S.R cannot continue in service beyond the term for which<\/p>\n<p>they were appointed or seek regularisation in service.     Such<\/p>\n<p>being the situation, the judgment in W.P.(C) No.22504\/2008,<\/p>\n<p>delivered on 7.8.2008, is liable to be reviewed and the writ<\/p>\n<p>petition dismissed.\n<\/p>\n<\/p>\n<p>                Accordingly, I allow the review petition.    The<\/p>\n<p>judgment delivered on 7.8.2008 in W.P.(C) No.22504 of 2008 is<\/p>\n<p>RP.No. 1176 of 2008<\/p>\n<p><span class=\"hidden_text\">                             5<\/span><\/p>\n<p>reviewed and recalled and the writ petition is dismissed.
