No.879 of 1986,<br \/>\n\tthe certificates (NSCs), if renewed at the interval of every six<br \/>\n\tyears by the Postal Department, no prejudice will be caused and on<br \/>\n\tthe contrary, it would enable the authorised party, may be the<br \/>\n\tholder of the certificate or the assignee to get the amount with<br \/>\n\taccrued interest.  Further, the fact remains that the Postal<br \/>\n\tDepartment or the Government of India has not made any payment<br \/>\n\tpursuant to the said certificates and has continued to retain the<br \/>\n\tamount and, therefore, keeping in view the principles of<br \/>\n\tcompensatory liability, it would be just and proper to direct<br \/>\n\trespondents to renew such certificates, more particularly when it is<br \/>\n\tnot even the case of the respondents that such certificates are not<br \/>\n\trenewable if authority is given for such purpose.  However, the<br \/>\n\tpayment, if any, cannot be so authorised until the proceedings of<br \/>\n\tC.R.A. No.879 of 1986 are finalized in either way. Further it also<br \/>\n\tappears that with a view to have uniformity in the orders passed by<br \/>\n\tthis Court, may be in C.R.A., or in the present petition at the<br \/>\n\tfinal stage, it would be just and proper if both the matters namely;<br \/>\n\tthe present petition as well as C.R.A. No.879 of 1986 shall be heard<br \/>\n\tby one Bench of this Court.\n<\/p>\n<p>Hence<br \/>\n\tthe following order:-\n<\/p>\n<p>(a)\t\tRule.\n<\/p>\n<p>(b)\t\tBy<br \/>\n\tinterim order, it is directed that the respondents shall renew the<br \/>\n\tNational Saving Certificates, which are subject matter of this<br \/>\n\tpetition from the date on which it had become due and shall continue<br \/>\n\tto renew at the interval of every six years from time to time.<br \/>\n\tHowever, the payment, if any, including that of encashment, shall be<br \/>\n\tsubject to final order, which may be passed by this Court in the<br \/>\n\tpresent proceedings as well as in C.R.A. No.879 of 1986.\n<\/p>\n<p>\tOffice<br \/>\n\tto place the matter before the Hon&#8217;ble the Acting Chief Justice on<br \/>\n\tadministrative side for listing of C.R.A. No.879 of 1986 as well as<br \/>\n\tthe present petition before one Bench of this Court, as may be<br \/>\n\tordered by the Hon&#8217;ble the Acting Chief Justice on administrative<br \/>\n\tside.
