Sarla Grover\nPublic Authority:                                        Delhi Development Authority\n                                                         (through Mrs. Krishna Mehta, Deputy\n                                                         Director(MIG))\n\nDate of Hearing:                                         31\/12\/2008\n\nDate of Decision                                         31\/12\/2008\n\nFACTS<\/pre>\n<p>:-\n<\/p>\n<p>       By her letter of 27\/09\/2007, the Appellant had requested for the following<br \/>\ninformation:-\n<\/p>\n<blockquote><p>         &#8220;i)      How many total flats constructed showing the registration No.<br \/>\n                  &#8230;..from&#8230;..to&#8230;..\n<\/p><\/blockquote>\n<blockquote><p>         ii)      flats allotted in areas, registration No. &#8230;.. from &#8230;.. to &#8230;..\n<\/p><\/blockquote>\n<blockquote><p>                  a) under Cash Down\n<\/p><\/blockquote>\n<blockquote><p>                  b) under Hire Purchase\n<\/p><\/blockquote>\n<blockquote><p>                  c) There may be cases who have been allotted on Hire Purchase might<br \/>\n                  have opted and paid in lump sum i.e. Cash Down, please show the<br \/>\n                  Registration from &#8230;. To &#8230;.. Area wise.\n<\/p><\/blockquote>\n<blockquote><p>         The above information required for MIG Flats only and may kindly be provided<br \/>\n         within 30 days from the receipt of the letter.&#8221;\n<\/p><\/blockquote>\n<p>2.      By a subsequent letter dated 17\/06\/2008, the Appellant had sought information on<br \/>\nthe following ten points:-\n<\/p>\n<blockquote><p>         &#8220;1.      Total Number of Registered Holders &#8211; only for MIG Flats.\n<\/p><\/blockquote>\n<blockquote><p>         2.       Number of MIG Flats constructed under the Scheme.\n<\/p><\/blockquote>\n<blockquote><p>         3.       Number of (MIG) Flats constructed in various areas of Delhi under the<br \/>\n                  Scheme.\n<\/p><\/blockquote>\n<blockquote><p>         4.       Procedure of Allotment as per terms and conditions i.e. Cash Down and<br \/>\n                  Hire Purchase.\n<\/p><\/blockquote>\n<blockquote><p>         5.       Flats (MIG) Allotted in various areas on Cash Down and Hire Purchase<br \/>\n                  year wise\/per lot constructed.\n<\/p><\/blockquote>\n<blockquote><p>         6.       How many (MIG) flats cancelled on account aof payment not made on<br \/>\n                  your demand as Cash Down.\n<\/p><\/blockquote>\n<blockquote><p>         7.       There may be cases of H.P. Allottee applied for Cash Down and paid in<br \/>\n                  lump sum.\n<\/p><\/blockquote>\n<blockquote><p>         8.       Disposal of cancelled MIG Flats &#8211; procedure and at what cost\/price, Flats<br \/>\n                  disposed off.\n<\/p><\/blockquote>\n<blockquote><p>         9.       How many registered holders have been allotted and further cancelled<br \/>\n                  whatsoever reasons\/grounds may kindly give details etc.\n<\/p><\/blockquote>\n<blockquote><p>         10.      Since the Launch of the Scheme &#8211; if any policy changed &#8211; valid copy of<br \/>\n                  policy changed till date &#8211; provide the copy\/copies etc.<br \/>\n<span class=\"hidden_text\"> 584SarlaGroverDDA3112 9                     2<\/span><\/p>\n<\/blockquote>\n<p>3.     By letter dated 04\/07\/2008, Deputy Director (MIG)(H) had furnished the<br \/>\nfollowing information to the Appellant:-\n<\/p>\n<pre> Sl. Query                                                    Reply\n No.\n 1.  Total number of Registered Holders-only for MIG          Reply to be given by\n     Flats                                                    Systems Department(Awas)\n 2.  Number of (MIG) flats constructed under the              Pertains       to       Chief\n     scheme                                                   Engineer(HQ)\n 3.  Number of MIG Flats constructed in various areas         Pertains       to       Chief\n     of Delhi under the Scheme                                Engineer(HQ)\n 4.  Procedure of allotment as per terms and conditions       Allotment of flat is made on\n     i.e. cash down and hire purchase                         Cash Down and Hire\n                                                              Purchase ratio in the of 40%\n                                                              and 60% respectively\n 5.     Flats (MIG) allotted in various areas on Cash Down    Pertains      to      system\n        and HIRE Purchase - yearwise\/per lot constructed.     Department (Awas)\n 6.     How many (MIG) Flats cancelled on account of          Pertains      to      system\n        payment not made on your demand as Cash Down          Department (Awas)\n 7. Since the launch of the scheme-if any policy There is no major change in<br \/>\n        changed &#8211; valid copy of policy changed till date- policy of the scheme<br \/>\n        provide the copy\/copies, etc.<\/p>\n<p>4.    Dissatisfied with the information provided to him, the Appellant had filed an<br \/>\nAppeal before the Appellate Authority. The Appellate Authority had disposed of the<br \/>\nAppeal vide letter dated 20\/02\/2008.\n<\/p>\n<p>5.       The present Appeal has been filed against the order of CPIO\/AA.\n<\/p>\n<p>6.      The matter was heard on 31\/12\/2008. The Appellant is represented by her<br \/>\nhusband Shri G.D. Grover. DDA is represented by the officers named above. The main<br \/>\nsubmission of the appellant is that the CPIO has not provided to him point-wise specific<br \/>\ninformation. According to him, in the letter dated 04\/07\/2008 of Deputy Director(H) in<br \/>\nmost of the columns, it has been mentioned that the matter pertains to System<br \/>\nDepartment(Awas) but the System Department (Awas) has not furnished any information<br \/>\nto him.\n<\/p>\n<p><span class=\"hidden_text\"> 584SarlaGroverDDA3112 9                                        3<\/span><\/p>\n<p>7.      In addition to the above, Shri Grover has also drawn my attention to letter dated<br \/>\n11\/06\/2008 of Deputy director (MIG)(H) wherein it is mentioned that the Appellant&#8217;s<br \/>\nletter dated 12\/04\/2008 was received by him on 22\/04\/2008 whereas as per the<br \/>\nendorsement on this letter, the letter appears to have been delivered to DDA on<br \/>\n16\/04\/2008.\n<\/p>\n<p>8.      On the other hand, the submission of Smt. Mehta is that a lot of information has<br \/>\nbeen furnished to the Appellant in regard to the flats purchased on hire purchase basis as<br \/>\nwell as on cash-down basis.\n<\/p>\n<p>9.      After hearing both the parties, I am left with the impression that consolidated<br \/>\npoint-wise reply has not been furnished to the Appellant. It is of no help to the Appellant<br \/>\nthat the matter relates to the Systems Deptt. (Awas). In fact, the CPIO is required to<br \/>\ncollect requisite information from the sister offices and transmit the same to the<br \/>\nAppellant.\n<\/p>\n<p>                                                        DECISION<\/p>\n<p>10.     In view of the above, the matter is remanded to Smt. Asma Manzar,<br \/>\nCommissioner (Housing), with the direction to have the information compiled from the<br \/>\nconcerned Departments of DDA and furnish point-wise information to the Appellant in<br \/>\nsix weeks time. Further, she is also directed to look into the discrepancy regarding the<br \/>\ndate of receipt of letter as referred to in para 8 above.\n<\/p>\n<p>11.
