T &#039;   ._ \n\n \n\nHeard Sri   ._  the appellant. Records\n\nperused.\n2. This is:  Section 173(1) of the Motor\n\nVehickjs    referred to as &#039;Act&#039; in short) awinst\ntl1e: z}3.v.:v a:~Vr\u00e9l&quot;   passed by MACT, Dhmwad, \ufb01x MVC\n\n  \n\n&#039;   was aged about 20 yams on 25.9.2002, when he\n\n  a motor mad accident, on account of rash and\n\n  V  driving of the tractor and trailer by its driver, owned by\n\n No.1 and insured with respondent No.2. Amcllant was<\/pre>\n<p>also driving his Kine\ufb02c Honda motor cycle.<\/p>\n<p>To<\/p>\n<p><span class=\"hidden_text\">3<\/span><\/p>\n<p>4. According to appellant, on the aforesaid date,__._l&#8217;1e was<\/p>\n<p>working as a Bar Tender] Sena&#8217; in the &#8220;Smuwar Bar 8; <\/p>\n<p>and was earning Rs.6,00\ufb02\/- per month. On <\/p>\n<p>sustained by him in right arm, he has l1f:e\u00a33&#8217;*p1;t  &#8216;lees.  <\/p>\n<p>earning eapmty.\n<\/p>\n<p>5. On the claim peti\ufb01en  1 15 of the<br \/>\nimpugned award, under  &#8216;appellate; has been<br \/>\nawarded a total amouat   with interest at<br \/>\nthe rate of 6%    actual payment The<br \/>\nappealis for     <\/p>\n<p>6. After   counsel for the appellant,<\/p>\n<p>We are of the apinie&#8217;11_   for enhancement has been made<\/p>\n<p>ou\ufb01; .\n<\/p>\n<p>   of any evidence led by appellant to show<\/p>\n<p>_    Rs.6,000\/&#8211; per month as salary, the Tribunal<\/p>\n<p>   his income at Rs.3,009\/~ per menth. Even<\/p>\n<p>    su\ufb01ered injtay only in his right arm to the extent of<\/p>\n<p> lmt Tribunal has still  that disability as 50% to his<\/p>\n<p> reliole body. Therwfter, the loss of earning capacity has been<\/p>\n<p>assessed at Rs.18,000\/- per annum and multiplier of &#8217;18&#8217; has been<\/p>\n<p>adopted. Under diifercnt heads, he has been awarded just}, proper<\/p>\n<p>and adequate compensation.\n<\/p>\n<p>8.
