Justice K.HEMA\n\n Dated :16\/08\/2010\n\n O R D E R\n                              K.HEMA, J.\n                           ------------------\n                        B.A. No. 4316 of 2010\n                  ------------------------------------\n                Dated this the 16th day of August, 2010\n\n                              O R D E R\n<\/pre>\n<p>       Petition for bail.\n<\/p>\n<p>       2. The alleged offences are under Sections 143, 147, 148,<\/p>\n<p>332 and 307 read with Section 149 of the Indian Penal Code and<\/p>\n<p>Section 3 of the Explosive Substances Act. According to<\/p>\n<p>prosecution,      on 29.05.2010 at about 3.30 P.M., 75 persons<\/p>\n<p>including petitioners(A2 and A9 respectively) formed themselves<\/p>\n<p>into an unlawful assembly and pelted stones against the police. A<\/p>\n<p>bomb was also hurled, though it did not explode.<\/p>\n<p>       3. Learned counsel for petitioners submitted that petitioners<\/p>\n<p>(A2 and A9) were arrested on 29.06.2010 and they are in custody<\/p>\n<p>for the past 49 days. The bomb which hurled did not explode. The<\/p>\n<p>co-accused were granted bail by this court, it is submitted.<\/p>\n<p>       4. Learned Public Prosecutor submitted that since similarly<\/p>\n<p>placed co-accused are granted bail, he has no objection in granting<\/p>\n<p>bail. But, stringent conditions may be imposed, while granting bail,<\/p>\n<p>it is submitted.\n<\/p>\n<p><span class=\"hidden_text\">B.A. No. 4316 \/ 2010                 2<\/span><\/p>\n<p>      5. On hearing both sides, I am satisfied that bail can be<\/p>\n<p>granted to petitioners on conditions. Hence the following order is<\/p>\n<p>passed:\n<\/p>\n<blockquote><p>                 Petitioners shall be released on bail on their<\/p>\n<p>          executing bond         for Rs.50,000\/- (Rupees fifty<\/p>\n<p>          thousand only) each with two solvent sureties each<\/p>\n<p>          for the like sum to the satisfaction of the Magistrate<\/p>\n<p>          Court concerned on the following conditions:<\/p>\n<blockquote><p>               i) Petitioners shall report before the Investigating<br \/>\n                     Officer on every alternate day, between 10<br \/>\n                     A.M. and 1 P.M.\n<\/p><\/blockquote>\n<blockquote><p>               ii)    Petitioners shall not enter the limits of the<br \/>\n                     police station within which the crime is<br \/>\n                     registered,   except    for   compliance    of<br \/>\n                     condition no.1.\n<\/p><\/blockquote>\n<blockquote><p>               iii)  Petitioners shall not influence or intimidate<br \/>\n                     any witness or tamper with the evidence.\n<\/p><\/blockquote>\n<blockquote><p>               iv)     In case, petitioners are involved in any<br \/>\n                     similar offence, their bail is liable to be<br \/>\n                     cancelled.\n<\/p><\/blockquote>\n<\/blockquote>\n<p>         This petition is allowed.<\/p>\n<p>                                         K.
