‘ _H.ero_”H:onda bearing registration No.KA–06–I-E-7681<\/p>\n
  the left side of the road in front of Raghu<\/p>\n
Petroi”;.BVunk, Pavagada, a Jayapadma bus bearing<\/p>\n
A  .Vre’gistration No. KA–16-B\u00bb\u00ab5445 came in a rash and<\/p>\n
‘negligent manner and dashed against his Hero Honda.<\/p>\n
As a result, the claimant fell down and sustained<\/p>\n

injuries. Hence, he filed a claim petition before the
\nMACT, Madhugiri, seeking compensation of<\/p>\n
Rs.5,00,000\/–. The Tribunal by impugned};-\u00e9tgriient<\/p>\n
and award has awarded compensation of  <\/p>\n

  just and proper, it is on the lower side and therefore<\/p>\n

teeth of  claimant. Ex.P.12, the discharge summary<\/p>\n
 ..issued~—-  Siddartha Hospital shows that claimant was<\/p>\n
it ‘gadniitted on 4–2~O2 and discharged on 20-2-02.<\/p>\n
 ‘V \u00bb-i\ufb02inother discharge card shows that he was admitted on<\/p>\n
13-12-01 and discharged on 19-1-02. Admission
\n$\/<\/p>\n
record — Ex.F.13 shows that he has taken treatment for
\n30 days from 13-12-01 till 12–1~O2.
\nP.W.2, the doctor in his evidence has stated that<\/p>\n
he found the following disabilities on the <\/p>\n
Left elbow 2 Flexion limited from 45 to 90
\nleft olecranon. Rotations of-~left~fo’i’eami isl <\/p>\n
completely absent; WS’L’I’\u20ac1″lg’t1’1_: left elbovirg
\nreduced to 3\/ 5 arid left Aha}:-,d to”2\/”filo;-rr.___ :3<\/p>\n
Partial claw hand left.\n<\/p>\n
Malunion of 6,7,8,9 ribs lefts’i–de. . _ s _ <\/p>\n
Thoracic 11 vetebral ter1def1?:esS_ Without neurological
\nde\ufb01cits.   *    <\/p>\n
Absence of two central’ incissjor  <\/p>\n
Healed abrassions over. both’ ‘hand,’ “both’_. knee.<\/p>\n
right ankle, nose, forehead a10fd,_upper”l’1p.<\/p>\n
Change in\u00a7~c’osrrietiC__ appear’ar1cie~V.QfVfi*ace due to loss of
\ntooth.  ‘ = ‘  = ”\n<\/p>\n
On clinical’  and verifying the x–rays, he
\nfound that theperc\ufb01entage of disabilities as follows:<\/p>\n
  to theleft elbow.\n<\/p>\n

\n ‘ iii) in  the left hand.\n<\/p>\n

vi) a ” 10% to facial dis\ufb01guration.<\/p>\n
H’Doctor has stated that there is disability of 38% to<\/p>\n
 46\u00b0\/o to the whole body.\n<\/p>\n<\/p>\n
8. Considering the nature of injuries indicated in the
\nwound certi\ufb01cate and discharge summary and
\nsupported by the evidence of the doctor, a sum of<\/p>\n
Rs.50,000\/– is awarded towards pain and <\/p>\n
9. Claimant has produced medicai  <\/p>\n
Rs.23,704\/– and the same is not   Vthe’_:oti’3._e’r ‘ . <\/p>\n
side. Therefore, Rs.23,750i\/fr  ”

10. Claimant was, .treated—  inpatientvv-forv\ufb01about 46<\/p>\n
days on the first o\u00a2\u00a2asm.2–o: to i9–1–o2<\/p>\n
andai 4–\u00e9}o~2_..Vt\u00a7i[2o{2r;Co2y at Siddartha I-isopital and
\nSiddartha_   Hospital. Considering the<\/p>\n
sa.;;11e,._ a4.Vs=1zVr1’of.”‘ Rvs.20,000\/– is awarded towards<\/p>\n
 ..incid’ent.ai\u00ab._eXpenses such as conveyance, nourishment<\/p>\n
A _ ‘and  charges.\n<\/p>\n
1″}.  claims to be earning Rs.10.000\/– per<\/p>\n
 ee months by doing LIC agency and agriculture. Ex.P.4 -~<\/p>\n
letter issued by LIC discloses, he has got commission of<\/p>\n
 Rs.28,237\/– for the year 2000-01. In addition to that,<\/p>\n

he has 2 1\/2 acres of iand as evidenced from revenue
\nrecords produced at EX.P.2 and Ex.P.5. Considering
\nthe same, his income can be assessed at Rs.4,000_\/– per<\/p>\n
month. Nature of injuries suggest, that he <\/p>\n
been under rest and treatment for a :<\/p>\n
months. Therefore, a sum   <\/p>\n
towards loss of income during   . \u00ab. it  <\/p>\n
12. Considering the disalsiiity  doctor<\/p>\n
and an amount of ‘di.scomforti..’an:d’ilnhappiriess which
\nthe claimant has to un~de1’go;for of his life, it is<\/p>\n

loss of amenitiae-s_,Vtdis\ufb01guration of face and loss of teeth

 his age group is ’15’. After sustaining<\/p>\n
fractures stated above, it cannot be said that he could<\/p>\n
it  it cioritiriue to earn the same amount from LIC and<\/p>\n
Adlgagriculture and there Will be reduction in his earning.<\/p>\n
H That is taken as Rs.3,000\/– per month. P.W.2 — doctor<\/p>\n

has stated, claimant has suffered disability of 38% to
\n40% to whole body. Considering the nature of injuries
\nindicated in the Wound certi\ufb01cate \u00ab\u00bb Ex.P.10, discharge<\/p>\n
summary -~ Ex.P.l2 and evidence of <\/p>\n
functional disability caused to the limb is  <\/p>\n
Therefore, future loss of _income    <\/p>\n
Rs.1,44,000\/– (Rs\/1,000\/~ x 2o\/1o_’_’o5x L2. ‘sis;<\/p>\n
