PUBLIC PROSECUTOR for\nOpponent(s) : 1, \nSERVED BY AFFIX.-(R) for Opponent(s) : 2 - 3. \nMR\nVK JOSHI for Opponent(s) : 4, \nMR KANUBHAI I PATEL for Opponent(s)\n: 5, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 30\/08\/2011\n \n\nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tMr.Kirtidev Dave, learned counsel for the appellant and Mr.Kanubhai<br \/>\n\tPatel, learned counsel for respondent<br \/>\n\tNos.2 to 5.\n<\/p>\n<p>Mr.Patel,<br \/>\n\tlearned counsel for respondent<br \/>\n\tNos.2 to 5, has contended that the matter is resolved between the<br \/>\n\tparties outside the Court and on behalf of respondent<br \/>\n\tNos.2 to 5, a cheque bearing No.906960 of Rs.30,000\/- (Rupees Thirty<br \/>\n\tThousand Only) dated 16th August, 2011 drawn on State<br \/>\n\tBank of India, Vijaynagar Branch is handed over to the appellant.<br \/>\n\tMr.Patel has further contended that the parties have amicably<br \/>\n\tsettled their disputes and Terms of Compromise is arrived at between<br \/>\n\tthe parties and therefore, prayed to dispose of the present appeal<br \/>\n\tin view of compromise arrived at between the parties.\n<\/p>\n<p>Heard<br \/>\n\tMr.Dave, learned counsel for the appellant. He has submitted that a<br \/>\n\tcheque amounting to Rs.30,000\/- is received by him on behalf of the<br \/>\n\tappellant. He has also contended that the parties have amicably<br \/>\n\tsettled the dispute outside the Court. He, therefore, contended that<br \/>\n\tin view of compromise arrived between the parties, he may be<br \/>\n\tpermitted to withdraw the present appeal.\n<\/p>\n<p>Heard<br \/>\n\tlearned counsel for the respective parties. The Terms of Compromise<br \/>\n\tdated 30th August, 2011 arrived at between the parties is<br \/>\n\ttaken on record. As per the Terms of Compromise, learned counsel for<br \/>\n\trespondent Nos.2<br \/>\n\tto 5 has handed over a cheque amounting to Rs.30,000\/- to the<br \/>\n\tlearned counsel for the appellant as full and final settlement.\n<\/p>\n<p>In<br \/>\n\tview of above, present appeal stands disposed of as withdrawn.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
