Application is preferred by the applicants\/defendants to review<br \/>\nthe order dated 2.7.2007 passed in Special Civil Application No.23491<br \/>\nof 2006.\n<\/p>\n<p>2.\tMr.\n<\/p>\n<p>Pradeep Patel, learned advocate for the applicants made strenuous<br \/>\nefforts by submitting that there appears obvious errors at various<br \/>\nplaces in different paragraphs of the order and &#8216;plaintiff&#8217; is<br \/>\nreferred to as &#8216;defendant&#8217; and &#8216;defendant&#8217; as &#8216;plaintiff&#8217; and the<br \/>\norder can be reconciled by keeping in mind the order passed by the<br \/>\ntrial court, which came to be quashed and set aside by the appellate<br \/>\ncourt.  The order below Exh. 5 passed by the trial court, by which,<br \/>\nthe defendants were restrained from raising any objection when the<br \/>\nplaintiff visits the suit property to observe the outstanding crops.<br \/>\nIt was further directed that the suit land which was in the share of<br \/>\nplaintiff pursuant to Entry No. 540 and the land which was<br \/>\ncultivated, accounts of yield of the crops to be maintained and to be<br \/>\nsubmitted in the Court.  The above order of the trial court came to<br \/>\nbe set aside by the appellate court and, therefore, the above Special<br \/>\nCivil Application was filed.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Pravin Gondaliya, learned advocate for the respondent adheres to the<br \/>\ncontents of the order dated 2.7.2007 passed in Special Civil<br \/>\nApplication No.23491 of 2006 and submits that pursuant to the above<br \/>\norder, the original plaintiff is in possession of the land.\n<\/p>\n<p>4.\tHowever,<br \/>\nthere appears to be some substance in the arguments advanced by<br \/>\nlearned advocate for the applicants\/original defendants, but efforts<br \/>\nto reconcile words and sentences result into an anomaly, which cannot<br \/>\nbe resolved at this stage.  It is therefore, necessary that the trial<br \/>\ncourt be directed to dispose of the suit within six months and till<br \/>\nthen the original plaintiff shall submit the account of the yield of<br \/>\ncrops of the suit land before the Court below.\n<\/p>\n<p>5.\tBy<br \/>\norder dated 2.7.2007, the trial court was already directed to dispose<br \/>\nof the suit as expeditiously as possible and, therefore, the parties<br \/>\nare directed not to take unnecessary adjournments and the trial court<br \/>\nshall proceed with the suit so as to dispose of it within six months<br \/>\nfrom today without being influenced by the order dated 2.7.2007<br \/>\npassed in Special Civil Application No.23491 of 2007 and suit be<br \/>\ndecided on its own merit.\n<\/p>\n<p>6.\tThis<br \/>\nMisc.
