Patel,<br \/>\nlearned advocate waives service of notice of Rule on behalf of<br \/>\nrespondent No.2.\n<\/p>\n<p>2.\t\tIn<br \/>\nthe facts and circumstances of the case and with the consent of the<br \/>\nlearned advocates appearing on behalf of the respective parties, the<br \/>\npresent application is taken up for final hearing today.\n<\/p>\n<p>3.\t\tThe<br \/>\npresent application has been preferred by the applicants herein &#8211;<br \/>\noriginal petitioners to restore main Special Criminal Application<br \/>\nNo.378\/2011, which came to be dismissed for non-prosecution by this<br \/>\nCourt vide order dated 13\/07\/2011.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard learned advocates appearing on behalf of the respective parties<br \/>\nand considering the averments in the application in support of the<br \/>\nprayer to restore the main petition and subject to payment of cost,<br \/>\nwhich is quantified at Rs.750\/- to be deposited by the applicants<br \/>\nwithin a period of one week from today with the Registry of this<br \/>\nCourt, the present application is allowed. Special Criminal<br \/>\nApplication No.378\/2011 is hereby ordered to be restored to file on<br \/>\ndeposit of the aforesaid amount. Registry is directed to transmit the<br \/>\nsaid amount in the account of Gujarat High Court Legal Services<br \/>\nAuthority.
