SHAH\n\t\t\n\t\n\n \n\nDate\n: 19\/01\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tPresent<br \/>\nFirst Appeal under Section 173 of the Motor Vehicles Act has been<br \/>\npreferred by the appellant &#8211; original claimant challenging the<br \/>\nimpugned judgment and award dated 01.07.2009 passed by the learned<br \/>\nMotor Accident Claims Tribunal, Fast Track Court No.2, at Himatnagar,<br \/>\nSabarkantha in M.A.C.P. No.186\/2008 insofar as not awarding the full<br \/>\nclaim as prayed for.\n<\/p>\n<p>2.\tShri<br \/>\nSuthar, learned advocate appearing on behalf of the appellant has<br \/>\nsubmitted that the Tribunal has materially erred in awarding the<br \/>\nfuture economic loss of Rs.22,440\/- only considering the permanent<br \/>\npartial disability at 4% only.  No other submissions have been made.\n<\/p>\n<p>3.\tIt<br \/>\nis to be noted that the appellant produced the certificate of Dr.<br \/>\nP.N. Shah at Exh.29 assessing the permanent partial disability body<br \/>\nas a whole at 4% only, which was even agreed by the appellant and<br \/>\ntherefore, considering the above when the learned Tribunal has<br \/>\nawarded the future economic loss, it cannot be said that the learned<br \/>\nTribunal has committed any error and\/or illegality.  On the contrary,<br \/>\nconsidering the recent decision of the Hon&#8217;ble Supreme Court in the<br \/>\ncase of Rajkumar Vs. Ajay Kumar and Another reported in (2011)<br \/>\n1 SCC 343, when in fact the appellant &#8211; original claimant<br \/>\nhas not sustained any loss in income, it is very doubtful whether the<br \/>\nTribunal would have been justified in awarding the future economic<br \/>\nloss, though the appellant has not sustained any future economic<br \/>\nloss.
