BASANT, J.\n\n               -------------------------------------------------\n\n                         CRL.M.C.NO. 377 OF 2007\n\n               -------------------------------------------------\n\n            Dated this the 14th day of February, 2007\n\n\n                                     ORDER\n<\/pre>\n<p>       The   petitioner   faces   indictment   in   a   prosecution   under<\/p>\n<p>Sec.138   of   the   N.I.   Act.         The   case   was   filed   as   early   as   in<\/p>\n<p>2003.   The case has now reached the stage of evidence.<\/p>\n<p>       2.         The   petitioner   has   now   come   to   this   Court   with   a<\/p>\n<p>prayer   that   the   proceedings   initiated   against   him   under<\/p>\n<p>Sec.138  of the  N.I.  Act may be quashed invoking the  powers<\/p>\n<p>under   Sec.482   of   the   Cr.P.C.       What   are   the   reasons?       The<\/p>\n<p>learned   counsel   for   the   petitioner   submits   that   the<\/p>\n<p>complainant is the complainant in as many as 15 cases, the list<\/p>\n<p>of   which   is   produced   as   Annexure-B.       He   has   made<\/p>\n<p>complaints   against   various   individuals.       The   list   is   not<\/p>\n<p>exhaustive   and   there   are   more   cases   initiated   by   the<\/p>\n<p>complainant,   submits   the   learned   counsel   for   the   petitioner.<\/p>\n<p>According to the petitioner,  the complainant is, thus, a person<\/p>\n<p>who is misusing the provisions of  Sec.138 of the N.I. Act.   In<\/p>\n<p>these circumstances, it is prayed that the proceedings may be<\/p>\n<p><span class=\"hidden_text\">CRL.M.C.NO. 377 OF 2007                -: 2 :-<\/span><\/p>\n<p>quashed.   The learned counsel further submits that, as a matter<\/p>\n<p>of fact, the complainant &#8211; a moneylender, had advanced only an<\/p>\n<p>amount   of   Rs.10,000\/-   to   the   petitioner,   he   had   insisted   on   the<\/p>\n<p>petitioner handing over two blank signed cheques.       Interest is<\/p>\n<p>being paid regularly.    But the complainant, misusing one of the<\/p>\n<p>two   blank   cheques,   has   initiated   proceedings   against   the<\/p>\n<p>petitioner.     He   further   threatens   the   petitioner   that   if   the<\/p>\n<p>petitioner chooses to contest this proceeding, he shall make use<\/p>\n<p>of the other blank cheque also.\n<\/p>\n<\/p>\n<p>      3.     I   have   heard   the   learned   counsel   for   the   petitioner   in<\/p>\n<p>detail.   No valid reason has been shown to show that the powers<\/p>\n<p>under   Sec.482   of   the   Cr.P.C.   can   be   invoked   to   quash   the<\/p>\n<p>proceedings.       The   circumstances   urged   by   the   petitioner   are<\/p>\n<p>circumstances which the petitioner must urge in defence in the<\/p>\n<p>prosecution   initiated   against   him.       They   do   not   constitute   any<\/p>\n<p>valid reason to quash the proceedings.\n<\/p>\n<\/p>\n<p>      4.       In   conclusion,   the   learned   counsel   for   the   petitioner<\/p>\n<p>submits that a warrant of arrest has been issued by the learned<\/p>\n<p>Magistrate against the petitioner.       The petitioner must appear<\/p>\n<p>before   the   learned   Magistrate   and   apprise   the   learned<\/p>\n<p>Magistrate     of   the   circumstances   under   which   he   could   not<\/p>\n<p><span class=\"hidden_text\">CRL.M.C.NO. 377 OF 2007             -: 3 :-<\/span><\/p>\n<p>earlier appear before the learned Magistrate.   I have no reason<\/p>\n<p>to   assume   that   the   learned   Magistrate   would   not   consider   the<\/p>\n<p>application   for   bail   on   merits,   in   accordance   with   law   and<\/p>\n<p>expeditiously.  Orders must be passed on such application on the<\/p>\n<p>date of surrender itself.\n<\/p>\n<\/p>\n<p>        5.     There is a further grievance raised that an application<\/p>\n<p>to   recall   the   complainant   for   cross-examination   has   been<\/p>\n<p>dismissed   by   the   learned   Magistrate.     The   petitioner   will<\/p>\n<p>certainly be entitled to seek relief in accordance with law against<\/p>\n<p>such dismissal at the appropriate stage.\n<\/p>\n<\/p>\n<p>        6.
