No. 775 of 2009\n                   ................................................\n                         Dated: 4th March, 2009\n\n                                    O R D E R\n<\/pre>\n<p>      In this Revision        Petition filed under Section 397 read with<br \/>\nSec. 401 Cr.P.C. the petitioner who was the accused in C.C. No. 902<br \/>\nof   2004 of J.F.C.M.I, Chengannur,                  challenges       the conviction<br \/>\nentered and the sentence passed against                         him for an offence<br \/>\npunishable under Sec. 138 of the Negotiable Instruments Act, 1881<br \/>\n(hereinafter referred to as &#8216;the Act&#8217;).            The cheque amount was<br \/>\nRs.30,000\/-.        The       fine\/compensation ordered by the lower<br \/>\nappellate court is Rs. 35,000\/-.\n<\/p>\n<p>      2.    I heard the learned counsel for the Revision Petitioner<br \/>\nand the learned Public Prosecutor.\n<\/p>\n<p>      3.    The learned counsel appearing for the Revision Petitioner<br \/>\nre-iterated the contentions in support of the Revision.\n<\/p>\n<p>      4.     The courts below have concurrently held that the cheque<br \/>\nin question was drawn by the petitioner                            in favour of the<br \/>\ncomplainant, that the complainant had validly complied with clauses\n<\/p>\n<p>(a) and (b) of the proviso to Section 138 of the Act.                   and that the<br \/>\nRevision Petitioner\/accused failed to make the payment within 15<br \/>\ndays of receipt of the statutory notice.                      Both the courts have<br \/>\nconsidered and rejected the defence set up by the revision<br \/>\npetitioner while entering the conviction.                 The said conviction has<br \/>\nbeen recorded       after a careful evaluation                      of the oral and<br \/>\ndocumentary evidence.           I do        not find any error, illegality or<br \/>\nimpropriety in the conviction               so recorded concurrently by the<\/p>\n<p><span class=\"hidden_text\">Crl.R..P. No. 775 of 2009          -:2:-<\/span><\/p>\n<p>courts below and the same is hereby confirmed.\n<\/p>\n<p>       5.       What now survives for consideration is the legality of<br \/>\nthe sentence imposed on the revision petitioner.       In the light of<br \/>\nthe recent decision of the Supreme Court in              Ettappadan<br \/>\nAhammedkutty v. E.P. Abdullakoya &#8211; 2008 (1) KLT 851 default<br \/>\nsentence cannot be imposed for the enforcement of an order for<br \/>\ncompensation under Sec. 357 (3) Cr.P.C.      I am, therefore, inclined<br \/>\nto modify the sentence to one of fine only. Accordingly, for the<br \/>\nconviction under Section 138 of the Act the revision petitioner is<br \/>\nsentenced to pay a fine of Rs. 27,000\/-       (Rupees twenty seven<br \/>\nthousand only) (giving credit to a sum of Rs. 10,000\/- deposited<br \/>\nby the revision petitioner pursuant to the orders of the court and<br \/>\nwhich amount            shall be permitted to be withdrawn by the<br \/>\nrespondent\/complainant).          The said   fine shall be paid as<br \/>\ncompensation under Section 357 (1) Cr.P.C. The revision petitioner<br \/>\nis permitted either to deposit the said fine amount before the Court<br \/>\nbelow or directly pay the compensation to the complainant within<br \/>\nfour months from today and produce a memo to that effect before<br \/>\nthe trial Court in case of direct payment. If he fails to deposit or<br \/>\npay the said amount within the aforementioned period he shall<br \/>\nsuffer simple imprisonment for three months by way of default<br \/>\nsentence.\n<\/p>\n<p>       In the result, this Revision is disposed of confirming the<br \/>\nconviction entered but modifying the sentence imposed on the<br \/>\nrevision petitioner.\n<\/p>\n<p>       Dated this the 4th day of March 2009.\n<\/p>\n<p>                                             V.
