M. SAHAI)<\/p>\n<p>1.\tWe have<br \/>\nheard learned counsel Mr. Anuj K. Trivedi for Mr. Mihir H. Joshi, for<br \/>\nthe petitioner and  Mr. Jayant P. Bhatt for the respondent-Ahmedabad<br \/>\nMunicipal Corporation.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner was allotted plot in the estate of Gujarat  Industrial<br \/>\ndevelopment Corporation on 7.9.1992. The petitioner took over the<br \/>\npossession of the plot on 20.1.1993. Since then, the petitioners are<br \/>\nin possession of the GIDC Industrial plot.\n<\/p>\n<p>3.\tA notice<br \/>\nwas issued by the Ahmedabad Municipal Corporation  levying<br \/>\nRs.4,97,209\/- towards property tax on the petitioners, on the ground<br \/>\nthat the petitioners have not paid the property tax from 20.1.1993<br \/>\ntill the date of notice. Though the break-up and the period during<br \/>\nwhich the amount was due was not  mentioned in the notice,  but  the<br \/>\nlearned counsel for the respondent has fairly stated that the<br \/>\nAhmedabad Municipal Corporation has been demanding the amount of<br \/>\nproperty tax  from the date on which the petitioners came in<br \/>\npossession of the property i.e. on 20.1.1993.\n<\/p>\n<p>4.\tIn our<br \/>\nopinion, the learned counsel for the respondent has rightly confined<br \/>\nhis case to the date of possession taken by the petitioners on<br \/>\n20.1.1993 because, the provisions of Section 140(3) of the Bombay<br \/>\nProvincial Municipal Corporation Act, 1949 (for short, the &#8216;BPMC<br \/>\nAct&#8217;) do not permit the respondent to recover any amount of property<br \/>\ntax from the petitioners which had remained due for more than one<br \/>\nyear. In the present case, under the order of the Court, the<br \/>\npetitioners have deposited amount from 20.1.1993 till date  and are<br \/>\ncontinuing to pay property tax to the respondents. Therefore, we do<br \/>\nnot enter into the question, as to whether the amount claimed by the<br \/>\nAhmedabad Municipal Corporation  in the year 1997 from 20.1.1993  was<br \/>\nvalid or not ?\n<\/p>\n<p>5.\tAdmittedly,<br \/>\nthe petitioners were not in occupation of the industrial premises<br \/>\nprior to 1993 and they have deposited the property tax  from<br \/>\n20.1.1993 till 1997. Therefore, no dispute survives. However, under<br \/>\nthe orders of this Court, the petitioners have deposited the amount<br \/>\nof property tax prior to 20.1.1993 as demanded by the respondent in<br \/>\nnotice dated 8.12.1997. The learned counsel for the respondent has<br \/>\nurged that, according to their calculation, excess amount of property<br \/>\ntax has been paid by the petitioners.  Therefore, the respondents are<br \/>\nliable to refund the excess amount, as excess amount was not payable<br \/>\nby the petitioners in view of Section 140(3) of the BPMC Act.\n<\/p>\n<p>6.\tIn view<br \/>\nof the above-said argument, we direct the respondent- Ahmedabad<br \/>\nMunicipal Corporation to calculate the amount of property tax from<br \/>\n20.1.1993 till the period for which the notice was given on 8.12.1997<br \/>\nand if any excess amount of property tax was deposited by the<br \/>\npetitioners, which was to be paid by the occupier who was in<br \/>\npossession prior to 20.1.1993, the same shall be refunded to the<br \/>\npetitioners by the respondent-Ahmedabad Municipal Corporation within<br \/>\na period of three months.\n<\/p>\n<p>7.\tThis<br \/>\npetition is disposed of with a direction to the respondent- Ahmedabad<br \/>\nMunicipal Corporation to calculate the amount of property tax from<br \/>\n20.1.1993 till the period for which the notice was given on 8.12.1997<br \/>\nand after deducting the amount of property tax, payable by the<br \/>\npetitioners, from the amount deposited by the petitioner in pursuance<br \/>\nof the order of this Court, excess amount shall be refunded to the<br \/>\npetitioners within a period of three months from today.
