Justice K.HEMA\n\n Dated :13\/07\/2010\n\n O R D E R\n                                K.HEMA, J.\n                             ------------------\n                        B.A. No. 3476 of 2010\n                       -----------------------------\n                Dated this the 13th day of July, 2010\n\n                                O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.\n<\/p>\n<p>      2.    The alleged offences are under Sections 405, 406, 417<\/p>\n<p>and 420 read with Section 34 of the Indian Penal Code. According to<\/p>\n<p>prosecution, petitioners(accused nos. 1 to 3) in furtherance of their<\/p>\n<p>common intention, while acting as the chairman and partners of one<\/p>\n<p>firm sold to property of the firm and misappropriated the amounts and<\/p>\n<p>committed cheating etc.<\/p>\n<p>      3. Learned counsel for petitioners submitted that an extent of<\/p>\n<p>property was sold, as per a decision of the general body meeting, as<\/p>\n<p>evidenced by Annexure-A. De facto complainant is the husband of one<\/p>\n<p>of the partners, who is also a signatory to Anenxure-A. Petitioners<\/p>\n<p>have not sold the property in any fraudulent manner and they have<\/p>\n<p>not misappropriated any fund, it is submitted.<\/p>\n<p>      4. Learned counsel for petitioners also submitted that petitioners<\/p>\n<p>requested for an opportunity to explain their innocence before the<\/p>\n<p>police by producing relevant documents. They were directed by this<\/p>\n<p>court to report before the investigating officer and accordingly they<\/p>\n<p>appeared and they were questioned by him.\n<\/p>\n<p><span class=\"hidden_text\">B.A. No. 3476\/ 2010              2<\/span><\/p>\n<p>      5. Learned Public Prosecutor submitted that petitioners were<\/p>\n<p>questioned by the investigating officer, when he appeared before him<\/p>\n<p>as per the directions of this court. He has no objection in granting<\/p>\n<p>anticipatory bail on conditions, it is submitted.<\/p>\n<p>      6. On hearing both sides, I am satisfied that petitioners can be<\/p>\n<p>granted anticipatory bail on the conditions. Hence, the following order<\/p>\n<p>is passed:\n<\/p>\n<blockquote><p>             1.   Petitioners shall, in the event of their arrest<\/p>\n<p>                   be released on bail on his executing bond<\/p>\n<p>                   for Rs. 25,000\/- each with two solvent<\/p>\n<p>                   sureties each for the like sum to the<\/p>\n<p>                   satisfaction of the      arresting officer on<\/p>\n<p>                   condition that petitioners shall report before<\/p>\n<p>                   the investigating officer as and when directed<\/p>\n<p>                   and co-operate with the investigation.<\/p>\n<\/blockquote>\n<blockquote><p>             2). This order will be in force only for a period of<\/p>\n<p>                   20 days from today and petitioners shall seek<\/p>\n<p>                   regular bail from the court concerned within<\/p>\n<p>                   such time.\n<\/p><\/blockquote>\n<blockquote>\n<p>       This petition is allowed.<\/p><\/blockquote>\n<p>                                             K.
