                     Judgment<\/p>\n
1.The petitioner filed WP(C).28668\/2009 seeking to<\/p>\n
 quash Exts.P6 and P6(a). Ext.P6 is a notice under<\/p>\n
 the Land Acquisition Act and Ext.P6(A) is a<\/p>\n
 notification issued under that Act. The said<\/p>\n
 notification No.8686\/A2\/2009\/Tran. issued through<\/p>\n
 the Secretary to Government of Kerala in the<\/p>\n
 Transport (A) Department was for acquisition of<\/p>\n
 lands  described   therein  for   the  purpose  of<\/p>\n
 improving   the  visibility   of   Unmanned  Level<\/p>\n
 Crossing No. 113 in view of safety of road users<\/p>\n
 of Haripad – Cheruthana Railway line at Haripad<\/p>\n
 and Cheruthana villages of Karthikappally Taluk<\/p>\n
 in Alappuzha district. When that writ petition<\/p>\n
 came  up  for  consideration,   the  Railways  had<\/p>\n
 placed on record a statement relating to that<\/p>\n
 acquisition producing Ext.R7(a). Accordingly, it<\/p>\n
 was pointed out by the learned standing counsel<\/p>\n
COC181\/10              -: 2 :-<\/span><\/p>\n
 for the Railways when the matter came up for<\/p>\n
 consideration on 17.12.2009, that the Southern<\/p>\n
 Railway is acquiring land only by a width of<\/p>\n
 three meters and not seven meters as alleged by<\/p>\n
 the     petitioner.  Recording      that   statement,<\/p>\n
 including Ext.R7 sketch, the writ petition was<\/p>\n
 ordered.\n<\/p>\n<\/p>\n
2.This contempt of court case is filed on the<\/p>\n
 premise that after the issuance of the judgment,<\/p>\n
 there was an attempt to mark land having width of<\/p>\n
 20 meters thereby violating the judgment.<\/p>\n
3.The   first  respondent     Special Tahsildar(L.A.),<\/p>\n
 Railways, has filed an affidavit refuting the<\/p>\n
 allegation. It is pointed out that the writ<\/p>\n
 petition     related   only      to   the   aforesaid<\/p>\n
 acquisition     whereas      the    proceedings  for<\/p>\n
 acquisition which is now being carried out is one<\/p>\n
 for the purpose of railway track doubling between<\/p>\n
 Haripad and Ambalapuzha and that the land to be<\/p>\n
 acquired for such purpose is being identified<\/p>\n
COC181\/10              -: 3 :-<\/span><\/p>\n
 pursuant to a joint inspection of the Railways<\/p>\n
 and Revenue authorities. The land to be acquired<\/p>\n
 for that purpose from Haripad to Ambalapuzha, is<\/p>\n
 on the eastern side of the existing railway line<\/p>\n
 and a portion of the petitioner’s property has<\/p>\n
 also    to  be   acquired.    A  different set of<\/p>\n
 notifications under the LA Act other than those<\/p>\n
 produced along with the writ petition relates to<\/p>\n
 the     acquisition  for     doubling  process of<\/p>\n
 Kayamkulam – Haripad railway line.<\/p>\n
4.The second respondent in this contempt of court<\/p>\n
 case, who was not issued with any notice in the<\/p>\n
 writ    petition,  has   clearly  stated  that the<\/p>\n
 allegations against him of having been present at<\/p>\n
 site etc. are false in as much as even long<\/p>\n
 before the institution of the writ petition, he<\/p>\n
 was working in Thrissur and obviously, therefore,<\/p>\n
 the Railways had not even represented him, though<\/p>\n
 he was impleaded in the writ petition by name. He<\/p>\n
 has also produced materials to show that he was<\/p>\n
 on duty otherwise, at the time and date on which<\/p>\n

 the alleged incident had occurred.<\/p>\n
5.With the aforesaid materials, the learned counsel<\/p>\n
 for the petitioner on the strength of the reply<\/p>\n
 affidavit, as also the contempt of court case and<\/p>\n
 other materials on record, states that the entire<\/p>\n
 exercise of the first respondent Tahsildar is a<\/p>\n
 malafide one generated by malice, owing to the<\/p>\n
 petitioner taking up the cause of the need to<\/p>\n
 repair a particular road in the locality and the<\/p>\n
 first    respondent is,     thereafter, bent upon<\/p>\n
 ensuring that the petitioner is put to loss,<\/p>\n
 including by deprivation of property.<\/p>\n
6.The jurisdiction in entertaining and considering<\/p>\n
 an application under the Contempt of Courts Act<\/p>\n
 is limited. All that is relevant is as to whether<\/p>\n
 there is material to hold that there is wilful<\/p>\n
 disobedience in obeying the judgment. With this<\/p>\n
 in mind, adverting to the judgment, it is to be<\/p>\n
 noted that all that has been done by this Court<\/p>\n
 was to record the submission of the Railways that<\/p>\n
COC181\/10              -: 5 :-<\/span><\/p>\n
 in relation to the acquisition which was subject<\/p>\n
 matter of the writ petition, the land required<\/p>\n
 for the Railway would be only three meters. That<\/p>\n
 writ    petition  did  not     deal  with  any  other<\/p>\n
 proposal of the Railways, including the proposal<\/p>\n
 for doubling of the line or any land for such<\/p>\n
 purpose. It is inappropriate for this Court to<\/p>\n
 hold that the Railway will have to be duty bound<\/p>\n
 and the Tahsildar has to be told to stand by the<\/p>\n
 judgment,     including      in   relation   to  any<\/p>\n
 acquisition for the doubling of the railway line,<\/p>\n
 which was, obviously, not subject matter of the<\/p>\n
 writ petition, though it may be true that the<\/p>\n
 petitioner may have his remedies elsewhere.<\/p>\n
 For the aforesaid reasons, without expressing<\/p>\n
 anything   on   the  merits    or   demerits  of the<\/p>\n
 petitioner’s    claim  that     the   acquisition in<\/p>\n
 relation to doubling is against his interest, I<\/p>\n
 do    not  find  any   ground    to   hold  that the<\/p>\n
 respondents are liable to be proceeded against<\/p>\n
 under the provisions of the Contempt of Courts<\/p>\n
COC181\/10             -: 6 :-<\/span><\/p>\n
 Act in relation to Annexure-I judgment. This<\/p>\n
 contempt of court case is accordingly closed<\/p>\n
 without prejudice to the petitioner’s right, if<\/p>\n
 any, in relation to the acquisition for the<\/p>\n
 purpose of doubling of the railway line.<\/p>\n
