THE MUKHIYA OF GRAM PANCHAYAT PACHUKHAR, P.S.-DEO,\n          DISTT.- AURANGABAD\n                                -----------\n<\/pre>\n<p>02.   01.10.2010             A preliminary objection is raised on behalf<\/p>\n<p>                   of the State to the remedy of appeal available before<\/p>\n<p>                   the District Magistrate against the impugned order<\/p>\n<p>                   dated 16.12.2009.\n<\/p>\n<p>                             Only if the petitioner prefers such appeal<\/p>\n<p>                   within a period of 30 days from today, let the<\/p>\n<p>                   appellate authority decide the same after hearing all<\/p>\n<p>                   concerned   by   a    reasoned   and     speaking   order<\/p>\n<p>                   preferably within a maximum period of four months<\/p>\n<p>                   from the date of receipt\/production of a copy of this<\/p>\n<p>                   order along with the memo of appeal.\n<\/p>\n<p>                             Learned counsel for the State rightly points<\/p>\n<p>                   out that if any third party interests have intervened<\/p>\n<p>                   after issuance of impugned order dated 16.12.2009,<\/p>\n<p>                   such person\/persons are also required to be heard.<\/p>\n<p>                             The application is disposed off with the<\/p>\n<p>                   aforesaid directions.\n<\/p>\n<\/p>\n<pre>         P.K.
