BASANT, J.\n                  - - - - - - - - - - - - - - - - - - - - - -\n                     B.A.No. 368 of 2008\n                  - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 23rd day of January, 2008\n\n                               O R D E R\n<\/pre>\n<p>      Application for anticipatory bail.              The petitioner faces<\/p>\n<p>allegations in a crime registered under Sections 326 and 427<\/p>\n<p>I.P.C. He is the sole accused. The defacto complainant is a<\/p>\n<p>neighbour of the petitioner.           The defacto complainant was<\/p>\n<p>allegedly assaulted on account of ill-will and animosity which<\/p>\n<p>arose from a prior dispute between them. The allegation is that<\/p>\n<p>the petitioner had caused fracture of the rib by hitting the victim<\/p>\n<p>with a      dangerous stone.             Crime has been registered.<\/p>\n<p>Investigation is in progress. The petitioner apprehends imminent<\/p>\n<p>arrest.\n<\/p>\n<p>      2. The learned counsel for the petitioner initially submits<\/p>\n<p>that no offence under Section 326 I.P.C. would lie in as much as<\/p>\n<p>no grievous hurt has been suffered by the victim. But the records<\/p>\n<p>clearly show that fracture of the 6th rib has been caused. The<\/p>\n<p>counsel contends that the weapon used cannot be said to be a<\/p>\n<p>B.A.No. 368 of 2008<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>dangerous weapon. I am unable to agree. I am satisfied, in these<\/p>\n<p>circumstances, that there is merit in the opposition by the learned<\/p>\n<p>Prosecutor. The petitioner must be directed to resort to the ordinary<\/p>\n<p>and normal course of appearing before the Investigating Officer or the<\/p>\n<p>learned Magistrate having jurisdiction and then seek regular bail in the<\/p>\n<p>usual course, submits the Prosecutor.\n<\/p>\n<p>     3.   This application is accordingly dismissed. I may however<\/p>\n<p>hasten to observe that if the petitioner appears before the learned<\/p>\n<p>Magistrate and applies for bail after giving sufficient prior notice to<\/p>\n<p>the Prosecutor in charge of the case,     the learned Magistrate must<\/p>\n<p>proceed to pass orders on merits, in accordance with law and<\/p>\n<p>expeditiously.\n<\/p>\n<\/p>\n<p>                                            (R.
