Amanulla, Standing<\/p>\n<p>                 Counsel No. 17 who was present in Court to assist us in<\/p>\n<p>                 the matter on behalf of the State.\n<\/p>\n<p>                           The appellant constable was part of a train<\/p>\n<p>                 escort party. The allegations related to a firing made by<\/p>\n<p>                 him when after the vacuum of the train was cut by a<\/p>\n<p>                 passenger      who    was   apprehended,       a   mob      of<\/p>\n<p>                 approximately 400-500 persons surrounded the escort<\/p>\n<p>                 party and indulged in vigorous brick batting. Fire arms<\/p>\n<p>                 were allegedly attempted to be snatched also.           In the<\/p>\n<p>                 melee the appellant is alleged to have fired killing one<\/p>\n<p>                 person on the spot.\n<\/p>\n<pre>                           In    a    departmental     proceeding   he     was\n\n                 punished with dismissal.\n\n                           Learned     counsel   for    the   appellant    has\n\n<\/pre>\n<p>                 confined his submission to the issue of quantum of<\/p>\n<p>                 punishment only to urge that it was not a case of<\/p>\n<p>                 wanton reckless firing.     Being possessed of a weapon<\/p>\n<p>                 attacked by a large mob, it is possible that he may have<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>been of a weaker constitution than his compatriots. His<\/p>\n<p>conduct cannot be termed wholly unreasonable or<\/p>\n<p>excessive only because he was unable to exercise the<\/p>\n<p>necessary restraint in fear.\n<\/p>\n<p>          Shree A. Amanulla appearing for the State<\/p>\n<p>opposed the application to submit that the authorities<\/p>\n<p>have passed the punishment after a departmental<\/p>\n<p>proceeding which has not been found to be procedurally<\/p>\n<p>infirm by the Single Judge, the appeal merits no<\/p>\n<p>interference.\n<\/p>\n<p>          While, we agree with the counsel for the State,<\/p>\n<p>we are satisfied that what has been urged on behalf of<\/p>\n<p>the appellant is a matter which may merit consideration<\/p>\n<p>by the authorities in so far as the quantum of<\/p>\n<p>punishment only is concerned.\n<\/p>\n<p>          Without interfering with the impugned order,<\/p>\n<p>the appeal is disposed with the observation that any<\/p>\n<p>representation of the petitioner on the quantum of<\/p>\n<p>punishment only, if preferred within four weeks, shall<\/p>\n<p>be considered on its own merits by a reasoned order.<\/p>\n<p>The respondents may not feel inhibited on that question<\/p>\n<p>by reason of our refusal to interfere with punishment<\/p>\n<p>(distinct from the quantum).\n<\/p>\n<p>          It is made clear that this aspect of quantum of<\/p>\n<p>punishment in the departmental proceeding shall have<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>           no co-relation with the criminal case against the<\/p>\n<p>           petitioner which shall proceed on its own steam.<\/p>\n<p>                    The appeal stands disposed.<\/p>\n<pre>\n\n\n\n\n                                               ( Navin Sinha, J.)\n\n\n\nP.
