6.   15.11.2011.                This application, under Section 482 of the Code<\/p>\n
                        of Criminal Procedure, has been filed for quashing the<\/p>\n
                        order 9.9.2008 passed by the court of Sri S. Kaushar,<\/p>\n
                        Judicial Magistrate, Ist Class, Muzaffarpur, in Complaint<\/p>\n
                        Case No.2845 of 2006\/Trial No.2157 of 2008, summoning<\/p>\n
                        the accused-petitioners, on inquiry under Section 202 of<\/p>\n
                        the Code of Criminal Procedure, finding prima facie case<\/p>\n
                        under Sections 323\/448\/504 of the Indian Penal Code.<\/p>\n
                                2. The brief facts, leading to this application, are
\n               2<\/span><\/p>\n
that the complainant-opposite party no.2, Manish Kumar,<\/p>\n
filed the complaint petition, numbered as Complaint Case<\/p>\n
No.2845 of 2006, against the six accused persons<\/p>\n
including the petitioners, with the contention that he has<\/p>\n
filed the Divorce Case, numbered as Matrimonial Case<\/p>\n
No.133 of 2005 in the court of the Principal Judge, Family<\/p>\n
Court, Muzaffarpur, on 9.8.2005. On knowing about the<\/p>\n
said Matrimonial Case, all the accused persons including<\/p>\n
the petitioners armed with lathi, danda and rod came at the<\/p>\n
house of his father, who is a Senior Advocate, and started<\/p>\n
to abuse showing the paper of divorce. At that time, his<\/p>\n
father was doing the work behind the house after locking<\/p>\n
the grill of the house. All the accused persons including<\/p>\n
the petitioners entered into the house breaking the lock of<\/p>\n
the grill and started to assault the complainant-opposite<\/p>\n
party no.2.   The accused-petitioner no.1, Madhu Gupta<\/p>\n
and the accused-petitioner no.2, Rabindra Nath Gupta,<\/p>\n
snatched the gold chain from the neck of the complainant-<\/p>\n
opposite party no.2 and ordered to kill him. Thereafter, all<\/p>\n
the accused persons including the petitioners started to<\/p>\n
assault him again with an intention to kill. On raising<\/p>\n
‘hulla’ to save, his father rushed there and tried to save
\n               3<\/span><\/p>\n
him but the accused-petitioner no.1, Madhu Gupta, also<\/p>\n
assaulted his father through slipper and torn the cloth. It is<\/p>\n
also alleged that the accused no.6, Md. Asfi, damaged the<\/p>\n
television and threatened his father for dire consequences,<\/p>\n
if the case will be lodged about the occurrence and,<\/p>\n
thereafter, all the accused persons including the petitioners<\/p>\n
fled away. At that time, the accused no.3, Sweety Gupta,<\/p>\n
the wife of the complainant-opposite party no.2, Manish<\/p>\n
Kumar, took away all her personal belongings. On the<\/p>\n
next date, the matter was reported to the police but the<\/p>\n
police refused to register the case.\n<\/p>\n
         3. After filing of the aforesaid complaint petition<\/p>\n
by the complainant-opposite party no.2, Manish Kumar,<\/p>\n
on inquiry under Section 202 of the Code of Criminal<\/p>\n
Procedure, out of six accused, named in the complaint<\/p>\n
petition, the accused-petitioners, were summoned through<\/p>\n
the impugned order dated 9.9.2008 finding the prima facie<\/p>\n
case under Sections 323, 448 and 504 of the Indian Penal<\/p>\n
Code.\n<\/p>\n
         4. Learned counsel appearing on behalf of the<\/p>\n
petitioners submitted that the petitioners are none else but<\/p>\n
the mother-in-law and father-in-law of the complainant-
\n              4<\/span><\/p>\n
opposite party no.2, Manish Kumar and much prior to the<\/p>\n
filing of the complaint petition by the complainant-<\/p>\n
opposite party no.2, on the basis of the written report of<\/p>\n
the accused-petitioner no.2, Rabindra Nath Gupta,<\/p>\n
Muzaffarpur Town P.S. Case No.281 of 2005 was<\/p>\n
instituted on 21.8.2005 under Sections 498(A) and 379 of<\/p>\n
the Indian Penal Code and Sections 3\/4 of the Dowry<\/p>\n
Prohibition Act regarding the occurrence of torture and<\/p>\n
harassment to his daughter, Sweety Gupta, named as<\/p>\n
accused no.3 in the complaint petition, for demand of<\/p>\n
dowry and removing her from the Sasural house after<\/p>\n
snatching   her    personal    belongings    against   the<\/p>\n
complainant-opposite party no.2 and his parents. In that<\/p>\n
case, the prayers for anticipatory bail of the complainant-<\/p>\n
opposite party no.2, Manish Kumar, have been rejected<\/p>\n
upto Hon’ble Supreme Court and due to that reason with<\/p>\n
oblique motive, Chandra Bhushan Prasad, the father of the<\/p>\n
complainant-opposite party no.2, who is Senior Advocate<\/p>\n
in Civil Courts, Muzaffarpur, got filed the present<\/p>\n
complaint case through the complainant-opposite party<\/p>\n
no.2, so that the petitioners may not pursue the case of<\/p>\n
Muzaffarpur Town P.S. Case No.281 of 2005 and also
\n               5<\/span><\/p>\n
could not create any hindrance to succeed in divorce case<\/p>\n
as alleged in the complaint petition of the complainant-<\/p>\n
opposite party no.2. It is also contended that from the<\/p>\n
complaint petition itself, it is clear that regarding the<\/p>\n
alleged occurrence of 16.8.2005, the present complaint<\/p>\n
case has been filed by the complainant-opposite party no.2<\/p>\n
on 26.12.2006, after about 16 months only to take defence<\/p>\n
in Muzaffarpur Town P.S. Case No.281 of 2005, as lodged<\/p>\n
for causing cruelty, harassment and removing the accused<\/p>\n
no.3, Sweety Gupta, by the complainant-opposite party<\/p>\n
no.2 and his family members on 15.8.2005 after snatching<\/p>\n
her personal belongings.\n<\/p>\n
         5. On the other hand, learned A.P.P. for the State,<\/p>\n
submitted that the learned Judicial Magistrate, has rightly<\/p>\n
summoned the accused-petitioners on perusal of the<\/p>\n
complaint petition and the statements of the witnesses as<\/p>\n
examined in course of the inquiry and there is no illegality<\/p>\n
in the impugned order for interference with the same at<\/p>\n
this stage.\n<\/p>\n
         6. Admittedly, the petitioners are mother-in-law<\/p>\n
and father-in-law of the complainant-opposite party no.2<\/p>\n
and it is also apparent from the complaint petition that for
\n                6<\/span><\/p>\n
the occurrence alleged to be taken place on 16.8.2005, the<\/p>\n
complaint case has been filed on 26.12.2006. The F.I.R.<\/p>\n
of Muzaffarpur Town P.S. Case No.281 of 2005,<\/p>\n
Annexure-‘2’ to this application, disclosed that the F.I.R.<\/p>\n
has been lodged under Section 498(A) and 379 of the<\/p>\n
Indian Penal Code and Sections 3\/4 of the Dowry<\/p>\n
Prohibition Act on the basis of the written report of the<\/p>\n
petitioner no.2, Rabindra Nath Gupta, causing cruelty and<\/p>\n
harassment of his daughter, Sweety Gupta, the accused<\/p>\n
no.3 to the complaint petition, for demand of dowry and<\/p>\n
also removing her from Sasural house after snatching her<\/p>\n
personal belongings on 15.8.2005 by the complainant-<\/p>\n
opposite party no.2 and his parents . It is also alleged in<\/p>\n
the F.I.R. that on the next date, i.e., 16.8.2005, the<\/p>\n
petitioner no.2, Rabindra Nath Gupta, approached the<\/p>\n
complainant-opposite party no.2 and his parents to know<\/p>\n
about he cause of removal of his daughter, Sweety Gupta,<\/p>\n
on snatching her personal belongings.        The complaint<\/p>\n
petition filed on behalf of the complainant-opposite party<\/p>\n
no.2 itself, disclosed about the filing of the divorce case by<\/p>\n
him against his wife, Sweety Gupta, daughters of accused-<\/p>\n
petitioners.\n<\/p>\n
               7<\/span><\/p>\n
          7. It is well settled that the jurisdiction under<\/p>\n
Section 482 of the Code of Criminal Procedure could be<\/p>\n
exercised very sparingly in rare cases for quashing the<\/p>\n
prosecution. In case of State of Haryana and others Vs.<\/p>\n
Bhajan Lal and others {A.I.R. 1992 (SC) 604}, the<\/p>\n
Hon’ble Apex Court held that the power under Section<\/p>\n
482 of the Code of Criminal Procedure could be exercised<\/p>\n
either to prevent abuse of the process of any court of law<\/p>\n
or otherwise to secure the ends of justice, though it may<\/p>\n
not be possible to lay down any precise, clearly defined<\/p>\n
and sufficiently channelised and inflexible guidelines or<\/p>\n
rigid formulae and to give an exhaustive list of myriad<\/p>\n
kinds of cases wherein such power should be exercised,<\/p>\n
but noted the seven categories of cases wherein such<\/p>\n
power should be exercised, out of which one is where a<\/p>\n
criminal proceeding is manifestly attended with mala fide<\/p>\n
and\/or where the proceeding is maliciously instituted with<\/p>\n
an ulterior motive for wreaking vengeance on the accused<\/p>\n
and with a view to spite him due to private and personal<\/p>\n
grudge.\n<\/p>\n
          8. Admittedly, the petitioners are mother-in-law<\/p>\n
and father-in-law of the complainant-opposite party no.2
\n                8<\/span><\/p>\n
and the petitioner no.2 has lodged the F.I.R. about causing<\/p>\n
cruelty and harassment and removing his daughter, Sweety<\/p>\n
Gupta, accused no.3 to the complaint petition, from her<\/p>\n
sasural caused at the hands of the complainant-opposite<\/p>\n
party no.2 and his parents.        Prior to the filing of the<\/p>\n
complaint petition, the divorce case is also filed by the<\/p>\n
complainant-opposite party no.2 against his wife, Sweety<\/p>\n
Gupta, daughter of the petitioners. In that situation, it is<\/p>\n
quite improbable that the petitioners would go at the house<\/p>\n
of the complainant-opposite party no.2 and would commit<\/p>\n
the alleged offence, as detailed in the complaint petition.<\/p>\n
As such, the complaint petition, filed by the complainant-<\/p>\n
opposite party no.2, appears to be with oblique motive or<\/p>\n
wreaking vengeance on the accused-petitioners.<\/p>\n
         9.         Under   the   aforesaid   facts   and   the<\/p>\n
circumstances, the impugned          summoning order dated<\/p>\n
9.9.2008 passed by the court of Sri S. Kaushar, Judicial<\/p>\n
Magistrate, First Class, Muzaffarpur, in Complaint Case<\/p>\n
No.2845 of 2006\/Trial No.2157 of 2008 appears to be an<\/p>\n
abuse of the process of the court.\n<\/p>\n
         10.       Accordingly, the impugned order dated<\/p>\n
9.9.2008 passed by the court of Sri S. Kaushar, Judicial
\n                            9<\/span><\/p>\n
              Magistrate, First Class, Muzaffarpur, in Complaint Case<\/p>\n
              No.2845 of 2006\/Trial No.2157 of 2008 is hereby<\/p>\n
              quashed and the application is allowed.\n<\/p>\n<\/p>\n
