Misc. 24705\/2011)\n\n                     For the State          : Mr. Umesh Lal Verma,\n                                                         APP\n                                              (In Cr.Misc.24710\/2011)\n\n\n3   19.09.2011<\/pre>\n<pre>              Heard       learned    counsel   for   the\n<span class=\"hidden_text\">                   2<\/span>\n\n\n\n\nPetitioners and          learned Additional Public\n\nProsecutor for the State.\n\n          Since       both   these   applications   are\n\n<\/pre>\n<p>interlinked, taken together and being disposed of<\/p>\n<p>by this composite order.\n<\/p>\n<p>         Petitioners are named in both the cases,<\/p>\n<p>i.e. Paranpur P.S. Case no. 47 and 48, both of the<\/p>\n<p>year 2011, with allegation that they were also<\/p>\n<p>participating in a Panchayat being conducted for<\/p>\n<p>demand of compensation to the heirs of the victim<\/p>\n<p>in Manihari P.S. Case no. 32 of 2011 relating to an<\/p>\n<p>accidental death of two labourers by a tractor<\/p>\n<p>trailer and suddenly friend of owner of the<\/p>\n<p>vehicle, informant of first case, was being<\/p>\n<p>persuaded to bring Rupees five lacs for payment<\/p>\n<p>to the victim. In that course he was mishandled<\/p>\n<p>and on arrival of Police situation could be brought<\/p>\n<p>under control but allegation of the informant in<\/p>\n<p>subsequent case, that is Officer in charge of O.P.<\/p>\n<p>concerned is that being member of Scheduled<\/p>\n<p>Caste, he had to also face some mishandling and<\/p>\n<p>abuse.   Submission is that there is neither any<br \/>\n<span class=\"hidden_text\">                  3<\/span><\/p>\n<p>injury report nor specific allegation attributed<\/p>\n<p>against either of the three petitioners. Moreover,<\/p>\n<p>subsequent case also appears squarely covered by<\/p>\n<p>the decision of the Apex Court in the case of<\/p>\n<p>Jorgia Pentiah Vrs. State of Andhra Pradesh;<\/p>\n<p>reported in 2009(1) BCCR 153 (SC).\n<\/p>\n<p>          In the facts and circumstances, the<\/p>\n<p>petitioners, in the event of arrest or surrender<\/p>\n<p>within four weeks from today, are directed to be<\/p>\n<p>enlarged on bail on furnishing bonds of Rs.<\/p>\n<p>10,000\/- (Rupees ten thousand) with two sureties<\/p>\n<p>of the like amount each to the satisfaction of the<\/p>\n<p>Chief Judicial Magistrate, Katihar in Pranpur<\/p>\n<p>P.S. Cases no. 47 and 48, both of the year 2011,<\/p>\n<p>subject to the conditions laid down in Section 438<\/p>\n<p>(2) of the Code of Criminal Procedure with<\/p>\n<p>additional condition that the petitioners       shall<\/p>\n<p>remain present before the court below on each<\/p>\n<p>and every date for one year or till disposal of the<\/p>\n<p>case, whichever is earlier.
