Nanavati for the respondent.<br \/>\nLearned advocate Mr.Oza submitted that the University has denied<br \/>\nmedal relying on Rule 12, which is printed on re-assessment<br \/>\napplication form.  Rule 12 is to the effect that, on re-assessment if<br \/>\nmarks or result of any student is improved, such student will not be<br \/>\nentitled to receive any medal\/ scholarship\/ prize on the basis of<br \/>\nthat improved marks and\/ or result.  Learned advocate Mrs.Nanavati<br \/>\nfor the University will have to point out as to what is the nature of<br \/>\nthese re-assessment rules printed on the re-assessment application<br \/>\nform.\n<\/p>\n<p>2.<br \/>\n     The matter requires consideration.  Hence  rule.<br \/>\nAt the request of Mr.Oza rule is made returnable on 15th<br \/>\nApril 2009.  Mrs.Nanavati waives service of rule on behalf of the<br \/>\nrespondent-University.\n<\/p>\n<p>3.<br \/>\n     Mr.Oza may produce the rules prevailing in other Universities of<br \/>\nthe State on the same subject matter.  Learned advocate for the<br \/>\nUniversity may file additional reply to the petition pointing out as<br \/>\nto what is the nature of re-assessment rules and what is the sanctity<br \/>\nattached to these rules.  At the request of learned advocate Mr.Oza<br \/>\nfor the petitioner, the respondent-University is directed to place on<br \/>\nrecord mark sheets of the students who cleared their 3rd<br \/>\nB.Com. Examination and are awarded one or the other medal whose names<br \/>\nare at serial nos.102 to 112.\n<\/p>\n<p>(RAVI R.
