Heard the parties.\n<\/p>\n<p>                                 The petitioners have filed this application, under<\/p>\n<p>                      Section 482 of the Code of Criminal Procedure, for<\/p>\n<p>                      quashing the order dated 30.5.2008 passed by the court of<\/p>\n<p>                      Sri S. Alam, Judicial Magistrate, First Class, Siwan, in<\/p>\n<p>                      Complaint Case No.C-743 of 2008\/Tr. No.4172 of 2008,<\/p>\n<p>                      summoning the accused-petitioners, under Section 204 of<\/p>\n<p>                      the Code of Criminal Procedure, on inquiry, finding prima<\/p>\n<p>                      facie case under Sections 420, 465, 471 and 120-B of the<\/p>\n<p>                      Indian Penal Code.\n<\/p>\n<p><span class=\"hidden_text\">                    2<\/span><\/p>\n<p>            In brief, the case is that the complainant-<\/p>\n<p>opposite party no.2, Mostt. Paspati Kunwar, filed the<\/p>\n<p>complaint petition, numbered as Complaint Case No.C-743<\/p>\n<p>of 2008, with the contention that she is an illiterate and old<\/p>\n<p>widow lady and has slight eye vision due to disease prior to<\/p>\n<p>the date of occurrence. Her elder son, Vinod Singh, who is<\/p>\n<p>in private service, with his family is residing at Delhi and<\/p>\n<p>used to look after his family and also used to fulfill her<\/p>\n<p>requirement of expenses of medicine and agricultural needs.<\/p>\n<p>The further case of the complainant-opposite party no.2 is<\/p>\n<p>that on 23.10.2007, the accused-petitioner no.2, Yogendra<\/p>\n<p>Rai and accused-petitioner no.3 Shailendra Rai, came to her<\/p>\n<p>house and told that the treatment of eyes is going on at the<\/p>\n<p>cost of the Government at Basantpur Registry Katchhery.<\/p>\n<p>On believing their statements, the complainant-opposite<\/p>\n<p>party no.2 went there alongwith the accused-petitioner<\/p>\n<p>nos.1, 2 and 3 and for admitting her, thumb impression on<\/p>\n<p>blank paper and register was taken. After 2-2 \u00bd hours, they<\/p>\n<p>told her that the doctor did not come today and treatment<\/p>\n<p>will be held on the next day. Again, on 24.10.2007, the<\/p>\n<p>complainant-opposite party no.2 was taken by the accused-<\/p>\n<p>petitioner nos.1, 2 and 3 on the pretext of her eyes treatment<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>at Basantpur Registry Katchhery and obtained her finger<\/p>\n<p>prints, thumb impression and photographs at many places<\/p>\n<p>and told her that on account of cancellation of programme<\/p>\n<p>of Government doctor, her treatment is not possible and,<\/p>\n<p>thereafter, they at the behest of the deed-writer, identifier,<\/p>\n<p>witnesses and staff of the registry got the sale deed executed<\/p>\n<p>from her regarding Plot No.763 of Khata No.29 by<\/p>\n<p>committing fraud. The complainant-opposite party no.2 has<\/p>\n<p>also alleged that she was not in need of money and she has<\/p>\n<p>neither put her thumb impression in the presence of the<\/p>\n<p>witness, accused-petitioner no.4, Rambriksh Rai and<\/p>\n<p>accused no.5, Magister Rai, nor they had put their signature<\/p>\n<p>on the draft of deed.    As such, all the accused persons<\/p>\n<p>including the petitioners, named in the complaint petition,<\/p>\n<p>by hatching conspiracy got the sale deed executed in their<\/p>\n<p>favour without payment of consideration money to the<\/p>\n<p>complainant-opposite party no.2.\n<\/p>\n<p>            Learned counsel appearing on behalf of the<\/p>\n<p>petitioners submits that the complaint case is totally false<\/p>\n<p>and the same has been filed with a view to harass the<\/p>\n<p>accused-petitioners for illegal gain after execution of sale<\/p>\n<p>deed.    It has also been submitted that, in fact, the<br \/>\n<span class=\"hidden_text\">                     4<\/span><\/p>\n<p>complainant-opposite party no.2 herself executed the sale<\/p>\n<p>deed on 24.10.2007 after receiving consideration amount as<\/p>\n<p>detailed in the sale deed in favour of the accused-petitioners.<\/p>\n<p>Learned counsel for the petitioner further submits that from<\/p>\n<p>bare perusal of the complainant petition, the dispute appears<\/p>\n<p>to be civil in nature.\n<\/p>\n<p>             On perusal of the complaint petition, it appears<\/p>\n<p>that the complainant-opposite party no.2 made allegation<\/p>\n<p>that by committing fraud, the accused-petitioners by<\/p>\n<p>obtaining    her   thumb    impression    and    pasting   her<\/p>\n<p>photographs got the sale deed executed after taking her to<\/p>\n<p>Basantpur Registry Katchhery on the pretext of her eyes<\/p>\n<p>treatment. From Annexure-&#8216;2&#8217; to this application, which is<\/p>\n<p>the photocopy of the sale deed, it appears that opposite party<\/p>\n<p>no.2 has executed the sale deed ion favour of petitioner<\/p>\n<p>no.1, Lakhpati Devi, wife of petitioner no.2, Yogendra Rai,<\/p>\n<p>and the sale deed has been properly registered by the<\/p>\n<p>Registry Office. From the complaint petition, the dispute<\/p>\n<p>appears to be civil in nature, which can be decided by the<\/p>\n<p>civil court of competent jurisdiction.\n<\/p>\n<p>             Having regard to the facts and the circumstances<\/p>\n<p>of the case setting in motion the criminal proceeding<br \/>\n<span class=\"hidden_text\">                         5<\/span><\/p>\n<p>       through the impugned order summoning the accused<\/p>\n<p>       petitioners, appears to be an abuse of the process of the<\/p>\n<p>       court.\n<\/p>\n<p>                  Accordingly,   the   impugned    order   dated<\/p>\n<p>       30.5.2008 passed in Complaint Case No.C-743 of 2008\/ Tr.<\/p>\n<p>       No.4172 of 2008, by the court of Sri S.
